Obamacare 2.0 Guts Enforcement, Gives Illegal Aliens Health Care Through Identity Fraud

The Obamacare 2.0 bill pushed by some Republicans strips out even Obamacare’s weak protections preventing illegal aliens from signing up for health care meant for citizens.

A draft of the bill, released by the House Committee on Ways and Means, cannot even include bare-bones provisions requiring officials to check an enrollee’s immigration status, the Conservative Review’s Daniel Horowitz warns, calling it a “gift to illegal aliens.”


Obamacare included provisions from an earlier bill allowing illegal aliens with fraudulent documents to apply while the government and Obamacare managers looked the other way. Eager for welfare state clients and looking to grease the skids for a massive amnesty down the road, Obamacare navigators signed up thousands of illegal aliens for benefits.


“President Obama had already paved the path for illegal alien Obamacare when he signed the massive expansion of the State Children’s Health Insurance Program (S-CHIP) in 2009,”

conservative author Michelle Malkin explained in March 2014. “As I’ve reported previously, the law loosened eligibility requirements for legal immigrants and their children by watering down document and evidentiary standards—making it easy for individuals to use fake Social Security cards to apply for benefits with little to no chance of getting caught. In addition, Obama’s S-CHIP expansion revoked Medicaid application time limits that were part of the 1996 welfare reform law.”


Obamacare has no meaningful, robust protections in place against illegal aliens claiming health care. The law claimed to exclude illegals, but in practice, made no effort to verify that the people applying for health care were citizens. Now, Republicans are about to take that problem and make it much worse by gutting enforcement, Horowitz says:

Although Obamacare didn’t require photo ID and fingerprints to verify identity, it did harness the Department of Homeland Security’s Systematic Alien Verification for Entitlements (SAVE) database. Thus, officials were at least able to check immigration status against Social Security numbers.


The problem with this bill is that because it tweaks Obamacare and creates a new massive entitlement system through the budget reconciliation process, it cannot have the statutory effect of mandating HHS and IRS work with Citizenship and Immigration Services to use the SAVE database because that issue is outside the jurisdiction of the reporting committees. And no subject matter from other committees can be included in reconciliation.


Thus, to pass Obamacare 2.0 instead of plain repeal via budget reconciliation, Republicans must use weaker verification language.

Allowing illegals access to health care through fraud is a disastrous move, Horowitz shows. What Republicans are doing is almost inexplicable: Ramping up the most punishing aspects of Obamacare while removing even its fig-leaf requirements against granting illegal aliens health care. Except, according to Horowitz, they never intended to repeal the “meat and potatoes” of Obamacare at all.


There’s also the deeply troubling aspect of Republicans encouraging illegal immigration with enticing incentives and promises not to punish law-breakers. Illegal alien identity theft is a serious, widespread problem. Since it’s all but impossible to work and collect benefits in the U.S. without valid ID and documentation, illegals commit felonies to steal Americans’ Social Security numbers and forge tax documents.


“The demand is so great for counterfeit documents because the illegal alien population wants to work—that’s the majority of their motivation for wanting to come to this country,” one former immigration officer told Fox News in December. “So there’s a huge demand for those documents that are required to pass the employment eligibility verification procedures…. In every neighborhood where there’s a significant illegal alien population, there are at least several document vendors who supply this service,” he said. Illegals typically buy three fraudulent documents: A counterfeit resident alien card or work authorization card, plus a counterfeit California driver’s license, and a counterfeit Social Security card, which costs about $120 to $300. He encountered at least one hundred illegals during his career with voter registration cards who admitted they had voted in a U.S. election.


With well over ten million illegals in the U.S. and so many buying up fake documents, there will almost certainly be a massive rush to claim health care benefits, especially with liberals looking to sign up illegals to “resist” against the Trump administration.

It’s an insult to injury for Americans victimized by mass immigration policies and punishing healthcare regulations. Yet some Republicans seem eager to inflict more pain on the very voters who put them in power. Poll after poll shows Trump’s immigration policies prioritizing Americans, particularly struggling and vulnerable citizens, over foreigners are hugely popular with voters. Republicans in Congress ignore these voters and their pleas for affordable health care and immigration enforcement at their own peril.

There are no subsidies. The subsidies have been changed to tax credits. The Treasury Department handles those, right? DHHS has nothing to do with it. The Treasury Department has every obligation to refuse tax credits to illegal aliens using TIN numbers and fake SSN's which show-up as a "no match".

The goals of Phase 1 are to repeal Obamacare provisions like the mandates on employers, the mandates on individuals, convert the Mediicaid Expansion to a block grant program of some type giving states a greater role in dealing with their people, get rid of the "exchanges" and revert to a more free enterprise more flexible varied system to encourage more companies to sell insurance creating competition while preserving the prohibition on pre-existing conditions and also allowing children to remain on parents policies until they're 26 at least for now.

I'm good with that, because separately there will be an attempt to pass a repeal of McCarran-Ferguson and tighten up the tax credits and a host of other details once the new law is in place. There's a Phase 2 and a Phase 3, and I'm good with that.

I'm happy with what's going on, so long as no employer or individual is required purchase health insurance, and they eventually repeal McCarran-Ferguson, I'm a happy little lark singing away in the morning dawn.

The IRS has been paying thousands per illegal yearly for child and earned income tax credits WITHOUT SS, tax# id checks and they were told not to worry about matching - there was no matching or checking.

Yes, but that's going to change almost immediately. Mnuchin just got confirmed as Secretary of the US Department of the Treasury who overseas the IRS. Trust me, this will change. That rule is a terrible policy by the Obama Administration and the current IRS Commissioner. Mnuchin can stop it, it will be technical and another battle, but I believe he can do it. He can order a hold on it. In fact, Trump may have already done it. There was a delay in sending refund checks, and I believe that was due to verification of EITC checks.

Unlike previous administrations, we have some very very very smart and clever people running our government now who know how to accomplish their missions. Lets give them some time. Trump has signed over 30 Executive Orders, news coverage has only been on a few of those. There's a lot being done that hasn't made it into the MSM.

Phase 2 - All the regulatory reviews, eliminating Obamacare "rules and regulations" that aren't what we want or need. That comes after the Phase 1 bill is passed.

Phase 3 - New bill that allows for cross-state sales (repeal of McCarran-Ferguson), expands Health Savings Accounts and some other things that require legislation but can't be part of Phase I as part of a budget reconciliation bill.

We have some very very very smart people in charge of our government now. They are high achievers who know how to accomplish their mission. Lets trust them, keep the faith, and give them time they need to deliver what we want. Some of these guys and gals in Trump's Administration haven't even been in their office for more than a couple to 3 weeks, so I know we're anxious but fixing a country in serious trouble that took 40 years to get to this mess, might take a couple of months.

GOP Healthcare Plan Could Allow Illegal Aliens to Access Tax Credits

Healthcare reform legislation unveiled by GOP Leaders on Monday night would, at best, leave in place a verification system that allowed up to 500,000 illegal aliens to access taxpayer-funded benefits over the last several years. According to a 2016 Senate report, the government issued $750 million of Obamacare subsidies to individuals whose immigration status couldn't be verified. The GOP plan would leave in place that failed verification process, or worse, eliminate the verification process altogether.
According to the 2016 Senate report, the Obamacare framework gave benefit of the doubt to illegal aliens when they applied for subsidies, but if the alien failed to file the necessary paperwork, the IRS was supposed to retrieve the funds. A lack of cooperation between Health and Human Services and the IRS, however, prevented the money from being recouped.
But according to multiple Hill contacts, GOP Republicans may not even be able to get the failed verification process, which would leave their entire plan open to illegal aliens. Under the plan, subsidies for health insurance would no longer be awarded, but individuals could receive tax credits for purchasing healthcare on the government exchanges.

One of the most memorable moments of Obama’s presidency was when Rep. Joe Wilson, R-S.C. (D, 65%) could no longer contain his anger as the president touted his signature health care legislation before a joint session of Congress. When Obama promised that illegal aliens would not be able to access the subsidies, Wilson shouted, “You lie!” Sadly, eight years later, Paul Ryan, R-Wis. (F, 51%) and Mitch McConnell, R-Ky. (F, 40%) are well on their way to tweaking Obamacare and owning it for themselves under the stratagem of calling it “repeal and replace.” Now it appears that we might need Joe Wilson to direct his truth bomb at his own party. If nothing is done, Obamacare 2.0 will contain the same verification provisions as the original version that have enabled illegal aliens engaging in identity fraud to access the subsidies.
On page 37 of the draft legislation released by the Committee on Ways and Means, the bill calls for the use of the same verification methods as spelled out in sections 1411 and 1412 of … Obamacare!
Obamacare was based on verification provisions passed in the Democrats’ 2009 SCHIP bill, which required verification of citizenship but NOT identity. During the Obamacare debate, our side constantly said using the SCHIP provisions would encourage identity fraud and could qualify illegal immigrants for subsidies.

Please. You obviously have a lot more faith in government than I do. How is this any different than the illegal immigrant amnesty plan Reagan signed in 1986? Remember amnesty today for security tomorrow? How would you feel about the plan if phase 2 & 3 never materialized?

Well, this is only one of several problems I have with the plan being put forth by Paul Ryan and his minions.

It would still be progress because it gets rid of the employer mandates costing Americans their jobs or hours and the individual mandate that forces citizens to purchase these crappy policies or pay a tax penalty. Trump has already proven his Cabinet is going to cut regulations including these crazy Obamacare regulations so there's no intelligent treason to doubt Trump and his administration on Phase 2. Trump ran on erasing the lines and that's repeal of McCarran-Ferguson, so if it doesn't materialize, we're just where we are now, but I know he'll try and as the debate grows on that issue during Phase 3, I believe most people will understand why this 1945 McCarran-Ferguson Law needs to be repealed to increase competition that will lower prices and improve services. But if Congress won't repeal it, we're no worse off because of it, we're just not any better off because of it, meanwhile employers and citizens are free of the mandates and regulations will have been greatly reduced making it easier for companies to offer a variety of options at lower costs.
