DOJ: Social Media Posts Trashing Muslims May Violate Civil Rights

In its latest effort to protect followers of Islam in the U.S. the Obama Justice Department warns against using social media to spread information considered inflammatory against Muslims, threatening that it could constitute a violation of civil rights.

The move comes a few years after the administration became the first in history to dispatch a U.S. Attorney General to personally reassure Muslims that the Department of Justice (DOJ) is dedicated to protecting them. In the unprecedented event, Attorney General Eric Holder assured a San Francisco-based organization (Muslim Advocates) that urges members not to cooperate in federal terrorism investigations that the “us versus them” environment created by the U.S. government, law enforcement agents and fellow citizens is unacceptable and inconsistent with what America is all about.

“Muslims and Arab Americans have helped build and strengthen our nation,” Holder said after expressing that he is “grateful” to have Muslims as a partner in promoting tolerance, ensuring public safety and protecting civil rights. He also vowed to strengthen “crucial dialogue” between Muslim and Arab-American communities and law enforcement.

Evidently that was a precursor of sorts for an upcoming Tennessee event (“Public Disclosure in a Diverse Society”) that will feature the region’s top DOJ official, who serves as U.S. Attorney for the Eastern District of Tennessee, and an FBI representative. The goal is to increase awareness and understanding that American Muslims are not the terrorists some have made them out to be in social media and other circles, according to a local newspaper report. The June 4 powwow is sponsored by the American Muslim Advisory Council of Tennessee.

The area’s top federal prosecutor, Bill Killian, will address a topic that most Americans are likely unfamiliar with, even those well versed on the Constitution; that federal civil rights laws can actually be violated by those who post inflammatory documents aimed at Muslims on social media. “This is an educational effort with civil rights laws as they play into freedom of religion and exercising freedom of religion,” Killian says in the local news story. “This is also to inform the public what federal laws are in effect and what the consequences are.”

The DOJ political appointee adds in the article that the upcoming presentation will also focus on Muslim culture with a special emphasis on the fact that the religion is no different from others, even though some in the faith have committed terrorist acts, Christians have done the same. As an example he offers that the worst terrorist attack in the U.S. prior to 9/11 was committed by American Christians in Oklahoma City. He also mentioned the Wisconsin Sikh temple shooting last year in which another Christian, an American white supremacist, fatally shot six people and wounded four others.

“Some of the finest people I’ve met are Muslims,” Killian said, adding later: “We want to inform everybody about what the law is, but more importantly, we want to provide what the law means to Muslims, Hindus and every other religion in the country. It’s why we came here in the first place. In England, they were using Christianity to further their power in government. That’s why the First Amendment is there.”

Over the years the Obama administration has embarked on a fervent crusade to befriend Muslims by creating a variety of outreach programs at a number of key federal agencies. For instance the nation’s Homeland Security covertly met with a group of extremist Arab, Muslim and Sikh organizations to discuss national security matters and the State Department sent a controversial, anti-America Imam (Feisal Abdul Rauf) to the Middle East to foster greater understanding and outreach among Muslim majority communities.

The Obama Administration has also hired a special Homeland Security adviser (Mohamed Elibiary) who openly supports a radical Islamist theologian and renowned jihadist ideologue and a special Islam envoy that condemns U.S. prosecutions of terrorists as “politically motivated persecutions” and has close ties to radical extremist groups.

The president has even ordered the National Aeronautics and Space Administration (NASA) to shift its mission from space exploration to Muslim diplomacy and the government started a special service that delivers halal meals, prepared according to Islamic law, to home-bound seniors in Detroit. Who could forget Hillary Clinton’s special order allowing the reentry of two radical Islamic academics whose terrorist ties have long banned them from the U.S.?

U.S. Militants Jailed for Internet Threats Still Posting from Prison

American Islamist militants jailed for threatening violence over the Internet are still posting political writings on the Web -- while serving time in federal prison.
Jesse Curtis Morton, a convert to Islam who writes under the name Younus Abdullah Muhammed, posted a lengthy tract opposing U.S. drone policy, on May 21, on the www.islampolicy.com website that he launched in 2010.
Morton is serving a prison term of more than 11 years in a Pennsylvania federal prison after pleading guilty in 2012 to conspiring to solicit murder, make threatening communications and "use the Internet to place others in fear."
Morton, from Brooklyn, New York, and previously a student at Columbia University, was jailed for threatening the writers of the satirical television show "South Park" for their depiction of the Prophet Mohammed in a bear outfit.
Morton wrote in his latest essay that U.S. use of lethal drones against al-Qaida in Afghanistan and Yemen had encouraged homegrown Islamist extremism.
"The drone assassination of Anwar Awlaki in Yemen, an Islamic preacher with tens of thousands of ardent Western followers, has yet to be avenged but his popularity has only risen after death," Morton wrote, referring to the American Muslim preacher killed in a 2011 U.S. drone strike in Yemen.
Another American militant, Zachary Chesser, who was found guilty of conspiring with Morton to encourage attacks via the Internet on the creators of "South Park," has also posted material while in prison. His postings appear on another website www.aseerun.org and mainly air personal grievances, along with some political material.
Chesser is serving a 25-year prison sentence in Marion, Illinois, for the "South Park" case and for attempting to join the Somali militant group al Shabaab.
Neither Morton nor other representatives of IslamPolicy responded to a request for comment sent to an email address posted on the website. A telephone number posted on the site was out of order.
Lawyers for Morton and Chesser did not respond to requests for comment.
Under free-speech guarantees in the U.S. Constitution, federal authorities cannot impose blanket bans on such postings by convicts, although email access is limited for prisoners, and messages inciting violence are prohibited.
Morton and Chesser were involved in running the now defunct website RevolutionMuslim.blogspot.com.
That was linked to a U.S. affiliate of banned British group Al Muhajiroun, whose followers have included a man arrested for the brutal killing of a British soldier in London last week.
Since federal prisoners are allowed to transmit closely vetted email messages via special channels only to a small list of approved recipients, it is possible that messages and essays by prisoners such Morton and Chesser first went to some of those recipients, who then arranged for posting on the Internet.
PROTECTED SPEECH
Officials said they did not know precisely how Morton and Chesser arranged for the posting of their messages.
"Their communications with the outside are limited to approved contacts only and subject to careful monitoring and review to ensure that they do not facilitate criminal activity or pose a threat to the public or the correctional facility," said Dean Boyd, a Justice Department spokesman.
"While we may disagree with some opinions expressed by inmates in their limited communications to approved contacts outside prison, we may not prosecute individuals for speech protected under the First Amendment," Boyd said.
U.S. law enforcement sources said authorities would likely move quickly against Morton if Internet materials posted while he is in prison directly encouraged violence.
Morton apologized after his sentencing in 2012 and his most recent writings are not extremist by Islamist militant standards. They are mostly musings on the role of Islam in Middle Eastern political life.
A senior U.S. law enforcement official said Morton's current website was still important among U.S. militants, although Morton had toned down his writings.
Older material still accessible on the site includes communiques from Afghanistan's Taliban group, videos promoting the views of Abdullah al Faisal, a Jamaican imam who was jailed by British authorities in 2003 for soliciting the murder of Jews and Hindus, and exhortations including, "No peace with the Jews!"
"It is surprising and ironic that two individuals, whose extensive online activity influenced and inspired a wide network of would-be jihadists, are still able to reach those audiences from prison," said Oren Siegel, director of the Center on Extremism at the Anti-Defamation League.

DOJ OFFICIAL VOWS TO USE HIS OFFICE TO UPHOLD MUSLIM SHARI’A ANTI-BLASPHEMY LAWS IN TN

The first Holder Department of Justice push to publicly defend Islamic Shari’a’s anti-blasphemy laws is scheduled for June, 4, 2013, in TN.
Brian Justice, the City Editor for a local TN paper, Tullahoma News, reported that Bill Killian, U.S. Attorney for the Eastern District of Tennessee, and Kenneth Moore, special agent in charge of the FBI’s Knoxville Division will be giving a community talk on the DOJ’s new effort to curtail potential offensive speech to Muslims in social media next week.
Tullahoma News reported that the speech will be called, “Public Disclosure in a Diverse Society [and] will be held from 6:30 to 8:30 p.m. on Tuesday, June 4, at the Manchester-Coffee County Conference Center, 147 Hospitality Blvd.”
Killian says that the meeting is supposed to be, “an educational effort with civil rights laws as they play into freedom of religion and exercising freedom of religion.”
The senior DOJ officer said that his “presentation will also focus on Muslim culture and how, that although terrorist acts have been committed by some in the faith, they are no different from those in other religions.”
He also told local reporters that the DOJ and FBI would be working hand in hand with a pro-Shari’a Law Muslim civic group, called, American Muslim Advisory Council of Tennessee, to sponsor the event next week.
Killian said that the event will focus heavily on “educating” local citizens about the Muslim culture with the goal of making the citizens aware of the perspective that Islam is a religion of peace, that happens to have a few radicals, who happen to, on occasion, pervert the religion into justification for terrorist attacks on people of other faiths.
Killian said that the DOJ would be prosecuting people who make posts in social media that violate Muslim people’s “civil rights.” He said that “people need to understand” that “that is what the law is.”
If you need any more evidence that the strict construction approach to interpreting the First Amendment is all but dead in Eric Holder’s Justice Department, Killian explained that his view of why the settlers came to America was that they were fleeing an oppressive Christian government in London.
He said, “It’s why we came here in the first place. In England, they were using Christianity to further their power in government. That’s why the First Amendment is there.”
It is important to note that Killian never once said that DOJ would defend American Christian’s rights to express their theological position on why they believe Islam and the facts surrounding historical patterns of Islamist terrorism are being misrepresented by Killian and the event’s Muslim organizers.
