Birth certificate battle for children of undocumented mothers grows

EL PASO, Texas — The birth certificate civil rights lawsuit against the state of Texas has grown with more plaintiffs coming forward. This week, lawyers with the Texas Civil Rights Project added more undocumented mothers to the case, who said they live in fear their children will be deported because they cannot prove citizenship.
Under federal law, children born on U.S. soil are automatically granted full citizenship rights. In October, a federal judge ruled Texas can continue to deny the Mexican identification card matricula consular immigrant parents had previously provided in order to be issued their U.S.-born child's birth certificate.

The Border Network for Human Rights in El Paso believes this is cutting off a constitutional right.

"Even if [the state] argues there are concerns about fraud or document security, those concerns are completely outweighed by the responsibilities to uphold individual rights," BNHR policy coordinator Robert Heyman said.

The 62-page lawsuit outlines the issues children of undocumented immigrants face without access to a birth certificate. Among them is the inability to access services like day care and medical care.

"We are starting to work with Texas Rio Grande Legal Aid, with one of the lead attorneys in the suit," Heyman said. "We are trying to document how this is affecting people in the community in El Paso to really demonstrate this is a statewide issue."

Texas Civil Rights Project attorney Efren Olivares said the trial begins in December.

Texas officials refuse birth certificates for citizen kids of illegal aliens

States need to fight against issuing birth certificates to children of illegal aliens. They are not citizens, not under the US Constitution or under the 14th Amendment to the US Constitution. Illegal aliens are not subject to our jurisdiction which is why they can escape to an embassy of their own country for protection. They are under the jurisdiction of the land of their citizenship and so are their children whether born here or not.

All non-citizens who give birth on US soil whether here on vacation, a Visa, here illegally or otherwise should be issued a "Certificate of Child Born Abroad". No US Birth Certificate or taxpayer benefits. They are NOT legal citizens of the United States of America.

Those that are here undocumented and in our Country illegally that give birth should be handed over into the care and custody of THEIR Embassy.

Absolutely Beezer! And also handed a bill for the cost of the delivery that if not paid is delivered to the nearest consulate or embassy for payment by their home country.

Uninsured American citizens would have to pay or destroy their credit rating and be sued!

- why would illegal aliens or their offspring's health costs be paid for by our gov't via citizen funds and non-citizens given a birth certificate that would have any bearing on right's to citizenship?

I have long believed the biggest issue regarding illegal immigration is the bestowment of U.S. citizenship to the offspring of illegal aliens. Birthing, feeding, educating, and providing Medicaid and a multitude of other benefits to these kids is responsible for much of the debt incurred by the states. And in ever increasing numbers, these children are reaching voting age and are responsible for much of the changing electorate in this county. Birthright citizenship is the elephant in the room with regards to illegal immigration. Our country is changing before our eyes in large part due to this issue.
