    CA. TAXPAYER PROTECTION ACT (Birthright Citizenship) UPDATED

    CALIFORNIA TAXPAYER PROTECTION ACT

    Sponsored by Taxpayer Revolution

    The Initiative’s Laws Will:

    REQUIRE issuance of the official "CALIFORNIA BIRTH CERTIFICATE" for births to ONLY citizens and legal permanent residents.
    Birth to Foreign Parent document issued to all others.


    STOP 18 years of WELFARE payments to illegal aliens for their U.S. born children.

    ALLOW only CITIZENS AND PERMANENT LEGAL RESIDENTS eligibility for all public benefits including non-emergency and pre-natal care.

    ALLOWS Immigration and Customs Enforcement to review approved applications for federal benefits that illegal aliens are permitted to receive due to a U.S. born child. (Please see the initiative summary.)

    An article in the Sacramento Bee on September 10, 2007 by Washington correspondent David Whitney summed up automatic citizenship: "Although Congress has never passed a law saying so, no president has ever ordered it, and no court has ever ruled on the issue, each of these babies automatically becomes a U.S. citizen when it takes its first breath." This is taxpayer injustice.

    Our citizen’s movement will launch the national debate we need to bring an END to AUTOMATIC CITIZENSHIP in the United States of America.

    The movement will uphold the recorded words and real intent of the authors of our Constitution. To the authors and the states which passed the 14th Amendment "subject to the jurisdiction" is to mean that citizens are born to parents who are "NOT subjects of a foreign power."

    The goal to stop automatic citizenship is critical toward reducing the crime problem. A major reason deported criminal illegal aliens return immediately to the United States after deportation is because they have left behind children born here. Michael Chertoff, Homeland Security, reported there are two million criminal illegal aliens.

    There will never be "BORDER SECURITY" without ending automatic citizenship.

    The initiative petitions will be circulating in 2009 to qualify for the JUNE 2010 ballot and can be downloaded at this site. Please volunteer to obtain signatures.

    Rethinking Birthright Citizenship

    A recent article in the Houston Chronicle discusses the problem of so-called anchor babies, children born in U.S. hospitals to illegal immigrant parents. These children automatically become citizens, and thus serve as an anchor for their parents to remain in the country. Our immigration authorities understandably are reluctant to break up families by deporting parents of young babies. But birthright citizenship, originating in the 14th amendment, has become a serious cultural and economic dilemma for our nation.

    In some Houston hospitals, administrators estimate that 70 or 80% of the babies born have parents who are in the country illegally. As an obstetrician in south Texas for several decades, I can attest to the severity of the problem. It’s the same story in California, Arizona, and New Mexico. And the truth is most illegal immigrants who have babies in U.S. hospitals do not have health insurance and do not pay their hospital bills.

    This obviously cannot be sustained, either by the hospitals involved or the taxpayers who end up paying the bills.

    No other wealthy, western nations grant automatic citizenship to those who simply happen to be born within their borders to non-citizens. These nations recognize that citizenship involves more than the physical location of one’s birth; it also involves some measure of cultural connection and allegiance. In most cases this means the parents must be citizens of a nation in order for their newborn children to receive automatic citizenship.

    Make no mistake, Americans are happy to welcome immigrants who follow our immigration laws and seek a better life here. America is far more welcoming and tolerant of newcomers than virtually any nation on earth. But our modern welfare state creates perverse incentives for immigrants, incentives that cloud the issue of why people choose to come here. The real problem is not immigration, but rather the welfare state magnet.

    Hospitals bear the costs when illegal immigrants enter the country for the express purpose of giving birth. But illegal immigrants also use emergency rooms, public roads, and public schools. In many cases they are able to obtain Medicaid, food stamps, public housing, and even unemployment benefits. Some have fraudulently collected Social Security benefits.

    Of course many American citizens also use or abuse the welfare system. But we cannot afford to open our pocketbooks to the rest of the world. We must end the perverse incentives that encourage immigrants to come here illegally, including the anchor baby incentive.

    I’ve introduced legislation that would amend the Constitution and end automatic birthright citizenship. The 14th amendment was ratified in 1868, on the heels of the Civil War. The country, especially the western territories, was wide open and ripe for homesteading. There was no welfare state to exploit, and the modern problems associated with immigration could not have been imagined.

    Our founders knew that unforeseen problems with our system of government would arise, and that’s precisely why they gave us a method for amending the Constitution. It’s time to rethink birthright citizenship by amending the 14th amendment.

    Don't worry. Some group will sue the crap out of this movement and Taxpayer Revolution will spend years in court before anything decent is done.
    I am sure Ron Paul, who was an obstetrician, probably got sick of birthing little anchor Americans for free as the illegals had no way of paying their bills.

    Huckabee vows to defy birthright citizenship

    Tuesday, January 8, 2008

    Mike Huckabee wants to amend the Constitution to prevent children born in the U.S. to illegal aliens from automatically becoming American citizens, according to his top immigration surrogate — a radical step no other major presidential candidate has embraced.

    Mr. Huckabee, who won last week's Republican Iowa caucuses, promised Minuteman Project founder James Gilchrist that he would force a test case to the Supreme Court to challenge birthright citizenship, and would push Congress to pass a 28th Amendment to the Constitution to remove any doubt.

    The former Arkansas governor thinks the case against U.S. Border Patrol agents Ignacio Ramos and Jose Alonso Compean was railroaded, Mr. Gilchrist said. Ramos and Compean are serving lengthy prison sentences for shooting a fleeing drug-smuggling suspect in the buttocks.

    "I would make it my first act as president to pardon agents Ramos and Compean," Mr. Gilchrist said Mr. Huckabee told him. "I regret that they have spent yet another Christmas locked up in a windowless cell like animals and unable to be free and with their families."

    Mr. Gilchrist, who campaigned with Mr. Huckabee in Iowa last week, said Mr. Huckabee explained his positions in a half-hour conversation on the campaign trail.

    "I read back my notes to him twice and I told him I did not want to put words in his mouth," said Mr. Gilchrist, who also issued a press release from the Minuteman Project detailing Mr. Huckabee's positions. "The guy looked me right in the eye."

    Campaign spokeswoman Kirsten Fedewa said Mr. Huckabee intends to review the case against Ramos and Compean as one of his first acts as president, but she didn't otherwise dispute Mr. Gilchrist's quotes as provided by The Washington Times.

    Miss Fedewa said Mr. Huckabee and Mr. Gilchrest are "united by a mutual desire to end illegal immigration and are political allies toward that end."

    Mr. Huckabee has defended his policies on illegal aliens while he was
    Arkansas governor. He pressed for illegal aliens to gain college tuition benefits, complained about federal immigration raids in his state and declined to have state police enforce immigration laws, although the state legislature gave him the authority to do so.

    Mr. Huckabee now has adopted one of the strictest immigration platforms of any campaign. He has proposed a policy requiring all illegal aliens to return home and apply for immigration through legal channels.

    His new position on birthright citizenship also puts him alone among the candidates. Many legal scholars say the 14th Amendment, which says "all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States," grants automatic citizenship to any baby born in the U.S., except in diplomatic cases.

    Members of Congress have never tried to change birthright citizenship by law.

    Mr. Huckabee told Mr. Gilchrist that he supports a Supreme Court test case but also would encourage Congress to introduce a constitutional amendment to exclude from automatic citizenship any children born to illegal aliens.

    Mr. Gilchrist endorsed Mr. Huckabee last month and has campaigned with him ever since. Mr. Gilchrist said Mr. Huckabee is the best candidate on the immigration issue still in the race and who has a chance of being the presidential nominee.

    Others calling for stricter immigration policy have accused Mr. Gilchrist of opportunism and backing a bad candidate.

    Brook Young, who runs ImmigrationWatchdog.com, produced a Web video criticizing Mr. Gilchrist's endorsement. Mr. Gilchrist fired back last week with an e-mail that appeared to threaten to publicly accuse the man of being a pedophile.

    "I have been hearing on the blogs, over the telephone and through e-mails that you are a pedophile, Brook. Will that accusation also reach the news media soon?" Mr. Gilchrist wrote. "If the blogs and e-mails say so, then aren't you guilty beyond a shadow of a doubt?"

    Mr. Young posted the e-mail on his Web site and said he had to go public because Mr. Gilchrist has exceeded the bounds of the immigration debate, "to promote and actually lie about Mike Huckabee and his immigration plan and his past record. Now we feel like we have to say something."

    "It's crazy," he said. "You get e-mails from this guy and it's like this guy is truly out of his mind."

    Mr. Huckabee has promised to run a clean campaign. William Gheen, president of Americans for Legal Immigration Political Action Committee, said Mr. Gilchrist's campaigning reflects badly on Mr. Huckabee.

    "He's an intrinsic front-row part of the campaign who's sending out e-mails to people who oppose Huckabee to try to lie about them," said Mr. Gheen, who has tangled with Mr. Gilchrist and is trying to block Mr. Huckabee from winning the Republican nomination.

    Mr. Huckabee's campaign said the governor was not available to comment on the e-mail exchange.

    Mr. Gilchrist said he was not accusing Mr. Young of pedophilia, but making a point about making up charges.

    He also said he was not speaking on behalf of Mr. Huckabee when he sent the e-mail, and that the criticism pushed him to the limit.

    "That was a private e-mail and what I was doing was setting up an example: 'This is what you've done to me, I'm not going to do this to you, but how would you like it if I did this to you?' " Mr. Gilchrist said.

    Yesterday, I signed the following pledge:

    "I pledge to oppose amnesty or any other special path to citizenship for the millions of foreign nationals unlawfully present in the United States. As President, I will fully implement enforcement measures that, over time, will lead to the attrition of our illegal immigrant population. I also pledge to make security of our borders a top priority of my administration."

    Important points:

    1. The 12 to 20 million illegal immigrants now here will have to go home.

    2. They will not get any legal status while here that allows them to remain long-term.

    3. Once in their home countries, they may apply for re-admittance to the U.S. as immigrants, visitors or temporary workers through normal channels.

    4. Once in their home countries, they will not receive any special privileges on the basis of their having been in the U.S. illegally, such as being put to the front of a visa line.

    5. There will be no new categories or programs through which they may re-enter the U.S.

    6. There will not be an expansion of green cards in any existing categories that will speed up their movement to the front of the line.

    (The Governor agreed to this pledge made to the American people with his public signing before the national media on Jan. 16, 2008 at North Greenville University, South Carolina.)
