Jan 26, 2018 - President Donald Trump is proposing giving 1.8 million young undocumented immigrants a pathway to citizenship in exchange for $25 billion for his ... But the proposal would also cover those undocumented immigrants who meet the DACA criteria but did not sign up and even more who would be newly eligible under the proposal's timeframe requirements -- giving legal status and a pathway to citizenship to about 1.8 million people. . .NO AMNESTY

A federal judge in California ordered the Department of Homeland Security to resume DACA, the program at the core of the ongoing battle.
The department is now operating DACA, waiting for the Supreme Court to issue the final verdict on its legality. That means the program may survive until sometime this summer, the earliest the court could rule, even without Congressional action.

If the U.S. Congress writes a law that protects them for another year and Trump signs it, there is nothing to be ruled on by the U.S. Supreme Court. The lawsuit you're talking about will become moot because they will be legally protected by lawfully designed program approved by the Congress and signed into law by Trump.
We all understand the current DACA program is unconstitutional and was created as policy, not actual law. A bill created by the U.S. Congress will be actual law and not something the Supreme Court can overrule. The court's ability to rule on a law passed by Congress and signed by the President is unconstitutional.

Any law passed by Congress that violates the US Constitution is unconstitutional and can be overturned by the US Supreme Court. Any law passed by Congress that grants amnesty of any kind to illegal aliens for violations of existing continuing law is unconstitutional because it violates the ex post facto clause as well as the equal protection clause of the 14th Amendment and if it grants pathway to citizenship violates the uniform naturalization clause of the US Constitution.

It won't be unconstitutional if passed by the U.S. Congress and signed by President Trump. Obama didn't have that power when his administration issued a policy protecting illegals, however, Congress and Trump do have the power to pass law. If that happens there will be nothing for the U.S. Supreme Court to rule on. This is all so basic.

No that is wrong, MW. Congress is NOT above the Constitution, it is subject to it. Congress can not pass an unconstitutional law even when signed by a President and have it stand. The US Supreme Court can overturn it any law in the US whether passed by Congress or a state legislature if the court determines the law is unconstitutional. Where did you get the idea that the Congress is above the Constitution??!!!

Trump should have ended DACA on Day One...January 20, 2017
Here we are OVER a year later...and they are considering ANOTHER year extension!
NO WAY! LET WORK PERMITS EXPIRE AND THEY MUST LEAVE OUR COUNTRY!
SAME WITH TPS...THEY GAVE 18 MONTH EXTENSION...WHY!!! THEY HAVE BEEN HERE FOR YEARS! WE WANT A QUOTA 5,000 A WEEK DEPORTED.
NO MORE EXTENSION FOR ANYBODY!ILLEGAL ALIENS HAVE "BROKEN" OUR IMMIGRATION SYSTEM
DO NOT REWARD THEM - DEPORT THEM ALL

If the extra 1.2 million did not sign up yet, HOW DO THEY NOW HOW MANY THERE ARE! It is a figure to make the deal more appealing and totally unnecessary, against the will of the people too.
Thought trump called obama's decree unlawful? trump is following it to a tee. Waiting for the DAPAs, anchor baby parents, to be brought into the mix too.Last edited by artist; 02-06-2018 at 11:28 AM.

That's what you're not understanding. It is completely within the constitutional powers of the U.S. Congress to write law on immigration matters and that would include a temporary amnesty to protect the illegals currently enrolled in DACA if they so choose. Geez, all one has to do is research history and they'll see that there have been plenty of amnesties passed into law.
The U.S. Constitution does not prohibit the U.S. Congress from creating laws concerning immigration nor does the Constitution provide for the U.S. Supreme Court to overrule a law passed by the Congress that is constitutional.
So, in summary, you're fooling yourself if you think the U.S. Congress doesn't have the authority under the Constitution to provide protective status to a set group of individuals. If what you're saying was true the Congress wouldn't have the authority to pass the DREAM Act, RAC Act, Bridge Act, Hope Act or any other bill currently being considered. So yes, the Congress can pass any plan they want to protect the DACA folks. However, what can't happen, no matter how bad Trump wants it, the President can't continue to extend the unconstitutional DACA program on his own without challenge. He, just like Obama, doesn't have the authority to do so.
