Funding, Court Process Could Slow President-Elect's Plan to Deport 3 Million Illegal Immigrants, Experts Say
President-elect Donald Trump has said he plans to deport up to three million people with criminal backgrounds, including rapists, drug traffickers and gang members.

President-elect Donald Trump's immigration plan is not unlike President Barack Obama's initial immigration plan, according to some experts.
Trump has said he plans to deport up to three million people with criminal backgrounds, including rapists, drug traffickers and gang members.
Immigration attorney Ginger Jacobs says the idea is not unlike President Obama's from several years ago.
“These are the people Obama has gone after to be the number one priority for deportation,” said Jacobs.
Former U.S. Attorney Peter Nunez says that deportation can increase because there "is no longer a political animal in the White House telling [ICE and DHS] 'Don't do your job.'" Jacobs said in 2015, under Obama, 56 percent of the estimated 250,000 deported undocumented immigrants had some type of criminal record.
The maximum number that can be deported with existing resources is 400,000, experts say. However, everyone has the right to fight the immigration case in court, Jacobs says, which can take years.
“If you do the math, on 400,000 people per year, and even if you were going for two to three million, that still gets you to seven and a half years to get to those three million.”
Former U.S. attorney Pete Nunez says deportations can happen more quickly.
He says more money for judges, detention centers and federal agents is not the only answer. Nunez says Congress can make the system more efficient and effective.
“It is conceivable Congress could change the process to make it more efficient, more effective and work faster, so just that change could make the system better," he said.
Even that isn’t necessary to speed up the process, Nunez said.
“Just adding an Administration to do what the law says and turning loose DHS (Department of Homeland Security) and ICE to do their jobs, you might see an increase," Nunez said. "There's no longer a political animal in the White House telling them, don't do your job.”
Jacob says it’s unrealistic to think two to three million people could be removed.
“It's very possible that people who are fighting their immigration cases that their case might outlast any given administration their case may take longer than four years," Jacobs said. "So this idea that all of a sudden two to three million people, poof, are going to be gone is a fantasy.”
The millions of people represent non-citizens with criminal backgrounds, says Jacobs. According to records from 2012, 800,000 who are in this country illegally have criminal records. The others have green cards or visas or are refugees.

Incredible. The liberals and the media are trying desperately to tell the people of this country that Trump can't live up to his promise.
There are soooo many things he can do.
Build the wall: Congress has already appropriated funds that are just sitting there. It's a good way to get started. We can worry about Mexico's reimbursement later.
Have the Trump team come out and hold a press conference to remind ALL that the Constitution protects the rights of Citizens. NOT non-citizens.
Trump can cut Federal spending swiftly with executive action and then continue to work with congress on more permanent solutions for the future.
Invoke US Code 1324 that prohibits aiding and abetting or harboring illegals. Start threatening imprisonment to those helping or hiding illegals. And if they continue to violate the Code, prosecute to the fullest extent.
Take away their ability to find housing, drive and obtain work. I don't know about ALIPAC's other readers, but I had to show my driver's license and SS # in order to get a job, rent an apartment, buy a house, get a loan for vehicle purchases, etc..
The Trump administration should remind people that those stealing SS#s will be jailed or deported immediately!
Remind the public that ALL illegal aliens are criminal! One doesn't have to steal, batter, rape or kill to be a "criminal alien". The initial crossing of the boarder and staying here without permission is in itself criminal.
Redirect Homeland Security with a priority of deportation efforts. The agency is at his disposal. I for one am routing for Sheriff Clarke to be made Secretary/Director of Homeland Security. Talk about your 'bad hombres". This dude is a bada$$, in such a good way!. It'll take a bad hombre to deal with a bad hombre!

Don't want to here the excuses, enough is enough.
First off, revoke any right for them to have their immigration case heard in court!
You come illegally, you should be automatically scheduled for deportation.
Cut the $260k salaries on government workers, stop the welfare payments to illegals, sieze reimittances going to Mexico and designate more immigration courts, realign judges, increase immigration staff and utilize the many empty private prisons built and operations blocked by Obama and start housing all illegal immigrants until deportation has been completed.
If the illegals are forced to remain in custody for extended periods due to courts being backed up and over-loaded...,,, then, oh well, that's your problem and suffer the consequences for your actions.
i'm sure once the word gets out if caught in U.S. Illegally that you could possibly be sitting in a jail for an unlimited amount of time, they may have second thoughts on coming to US illegally.
I suggest border agents be placed at the border to stop illegal crossings, not 90 miles inland from the border.
No more catch and release.

So every person that makes it into the country and remains here illegally could require a hearing before being deported, if requested? Easy to get in, but hard to get out?

I have no problem with the deportation hearing, this is the process whereby a Judge listens to the pertinent facts to determine status and if illegal issues a Deportation Order. It should take 3 minutes. The person either is a citizen and that can be verified or they're an immigrant with papers and that can be verified or they are neither citizen nor legal immigrant which means they're an illegal alien. 3 minutes. 1 minute for the government to present, 1 minute for the person being deported to present, and 1 minute for the Judge to review and render decision.
There's no problem with the deportation hearing. There is a problem with the process that drags this 3 minute necessary process into months and years of nonsense. That is absurd and that will change.A Nation Without Borders Is Not A Nation - Ronald Reagan

And with a 3-5 year backlog in the immigration court most of them can get released on bail and move about the country.

The back log is fabricated. It takes 3 minutes to conduct a Deportation Hearing. Trump will fix this.
