Immigration and Customs Enforcement is detaining a York Springs man after state police arrested him for a DUI, according to court documents.

Carlos Hernandez, 30, was arrested on April 2 after crashing his vehicle in the 160 block of Center Mills Road in Butler Township, according to an affidavit filed with District Judge Mark Beauchat.

Police responded to the scene around 4:15 p.m. and found Hernandez walking north on Center Mills Road, the affidavit stated. Police identified him through a Mexican ID card.

A witness' description of the driver matched Hernandez, according to the affidavit. Hernandez initially denied he was the driver and then admitted he was behind the wheel of the 2004 Honda Odyssey with Pennsylvania registration.

Police smelled "a strong odor of alcoholic beverage" when speaking with Hernandez, the affidavit stated. He showed signs of impairment during sobriety tests. Police also noted he was slurring his words and admitted to drinking beer prior to the crash.

Hernandez said he never owned a valid state driver's license, according to the affidavit. A PennDOT vehicle record showed the registration was suspended because of insurance cancellation.

Hernandez's bail was denied because he was detained by ICE, according to court documents. He has no family or job in the U.S., and all of his ties are to Mexico. He is currently confined at Adams County Prison.

A preliminary hearing is scheduled for Wednesday, April 12. Hernandez has no attorney listed on court documents.

Attempts to reach ICE officials were unsuccessful.
