    Irish nanny set to leave US for Ireland

    Aisling Brady McCarthy is set to leave the United States imminently as immigration officials work to fast-track her deportation.
    Her lawyers were able to strike a deal with the various law enforcement agencies here in Massachusetts to secure a break from the routine procedure.
    Ms Brady McCarthy was due to present herself at a probation office this morning to have her GPS-monitored ankle bracelet removed, however she did not attend a scheduled appointment which her lawyers said was due to concerns about media attention.

    After some negotiation at the courthouse in Woburn, it was agreed that Ms Brady McCarthy would present herself to the offices of the Immigration and Customs Enforcement agency - known as ICE.
    A deal was struck whereby the ICE officials removed her ankle bracelet and then arrested her on immigration offences. She has been residing illegally in the US for 13 years.
    Shortly after her arrest in 2013, authorities secured a deportation order for her.
    She originally arrived to the US in 2002 on a six month tourist visa and never returned home.
    Under the US-Ireland Visa Waiver programme, Ms Brady McCarthy is not entitled to appeal the deportation order before an immigration judge.
    However, through her lawyer, she has indicated that she just wants to get home to Ireland as soon as possible.
    In a break from procedure she is understood to have bought a ticket home to Ireland on a flight leaving Boston tonight.
    Immigration officials have indicated that they will try to expedite the deportation process so that she can make that flight.
    As she is not resisting deportation, they are understood not to have an interest in detaining her further, at further cost to the State of Massachusetts.
    They are currently processing her at a facility in Burlington, Massachusetts.
    It is not yet clear whether Ms Brady McCarthy will be able to make the flight back to Ireland.
    There are two Aer Lingus flights that left Boston for Dublin last night, one at 6pm arriving into Dublin at 5am and one at 9pm, arriving at 8am.
    There was also a flight that left Boston for Shannon at 7.15pm arriving into Shannon at 6.15am.
    Ms Brady McCarthy had been accused of killing one-year-old Rehma Sabir in Cambridge, Massachusetts, in January 2013.
    She spent nearly two-and-a-half years in jail, and another four months under house arrest.

    After the Office of the Medical Examiner conducted a review of the evidence in the case, the Medical Examiner said she was no longer convinced that the bleeding on the baby's brain could only have been caused by abusive head trauma, but could in fact have been an accidental injury or an undiagnosed natural disease.
    As a result the District Attorney then said she could no longer meet the burden of proof required for murder and dropped the charges.
    Marian Ryan, the district attorney for Middlesex in Massachusetts, said: "Based on an assessment of the present state of the evidence, including the amended ruling from the medical examiner who performed the autopsy, the Commonwealth cannot meet its burden of proof."
    Ms Brady McCarthy is originally from Co Cavan but has been in the US illegally since 2002 and had been Rehma's nanny for around six months when the baby died in January 2013.
    The medical examiner said the decision to change the cause and manner of death came after additional materials were reviewed.
    These included expert witness reports, additional transcripts of police interviews, transcripts of testimony heard ahead of the planned trial, additional medical records and additional medical testing related to the girl's death.
    The reports states: "These additional materials put forth several different and often conflicting opinions about the cause of Rehma's death.
    "In particular the overall state of Rehma's health and her past medical issues raise the possibility that she had some type of disorder that was not able to be completely diagnosed prior to her death."
    The report said Rehma had a history of bruising and that she might have been prone to easy bleeding with relatively minor trauma.
    "Given these uncertainties, I am no longer convinced that the subdural haemorrhage in this case could only have been caused by abusive/inflicted head trauma, and I can no longer rule the manner of death as a homicide," the medical examiner added.
    "I believe that enough evidence has been presented to raise the possibility that the bleeding could have been related to an accidental injury in a child with a bleeding risk or possibly could have even been a result of an undefined natural disease.
    "As such I am amending the cause and manner of death to reflect this uncertainty."

    This woman’s problem is that she is not Hispanic because if she were, she would have been released from jail and disappeared into the general population. According to Ted Cruze 104,000 thousand criminal aliens including 196 murders were released by Obama’s orders. to ICE.
