Illegal immigrants granted executive amnesty can claim back tax credits for work they performed illegally, even if they never filed a tax return during those years, IRS Commissioner John Koskinen has confirmed to Sen. Chuck Grassley (R-IA).
In a written response to questions Grassley, chairman of the Senate Judiciary Committee, asked Koskinen following a February hearing on the IRS budget, the IRS commissioner clarified his earlier assertions that illegal immigrants granted executive amnesty — and Social Security numbers — can access Earned Income Tax Credits (EITC) for years they were working in the country illegally.
Back in February, Koskinen said that in order to claim the tax credits the amnestied illegal immigrant would have had to have filed returns in the past.
In his written statement to Grassley, released Wednesday, Koskinen went another step, saying an illegal immigrant granted amnesty could claim back tax credits regardless if they had filed returns in the past.
“To clarify my earlier comments on EITC, not only can an individual amend a prior year return to claim EITC, but an individual who did not file a prior year return may file a return and claim EITC (subject to refund limitations under section 6511 of the Internal Revenue Code). I would note that filing new returns for prior years would likely be difficult, since filers would have to reconstruct earnings and other records for years when they were not able to work on the books,” Koskinen said in his written response.
According to the IRS, illegal immigrants granted amnesty, and with it Social Security numbers, can claim up to three years prior in back tax credits.
“Section 32 of the Internal Revenue Code requires an SSN on the return, but a taxpayer claiming the EITC is not required to have an SSN before the close of the year for which the EITC is claimed. At your request, the IRS has reviewed the relevant statutes and legislative history, and we believe that the 2000 Chief Counsel Advice (CCA) on this issue is correct,” Koskinen added.
With this benefit Illegal immigrants granted amnesty could receive tens of thousands of dollars in back tax refunds.

During the hearing, I asked you about the ability of individuals receiving deferredaction to amend tax returns and claim the earned income tax credit (EITC) as a resultof the President’s executive action. Your answer essentially confirmed that this is thecase, but in doing so you also suggested that those receiving deferred action wouldhave had to of already filed tax return for the year in question. However, a page onIRS’ website titled “Claiming EITC for Prior TaxYears” would appear to suggest even if one failed to file a tax return in a previousyear, they may now file a return for that year and claim the EITC.4 Could you pleaseclarify your remarks and address whether someone receiving deferred actually musthave previously filed a tax return during the year in question to claim the EITCretroactively? Also, please verify, whether or if,

Under US law, illegal aliens are not entitled to SSN numbers, they are not entitled to work, so therefore, they are not entitled to EITC.

That’s essentially what Democrats and establishment Republicans have ensured as illegal immigrants granted executive amnesty can claim back tax credits for work performed illegally, even if they never filed a tax return during those years.
This was confirmed recently in a letter by IRS Commissioner John Koskinen in response to a query sent by Sen. Chuck Grassley (R-IA), chairman of the Senate Judiciary Committee.
The new information clarifies an earlier assertion in which Koskinen stated that in order to claim the tax credits the amnestied illegal immigrant would have had to have filed returns in the past. In his written response to Grassley, he says:

How is it that lawful, tax-paying citizens are beholden to pay millions of dollars in tax refunds for people who arrived to this country illegally, and who never filed tax returns? Makes one wonder who our government thinks are the real criminals.

It's a national disgrace, a total and complete sell-out by our own government especially the IRS, and anyone who is not yet on board with the FairTax, really really really needs to read this legislation and learn about this wonderful fantastic as perfect as I can find tax reform bill for the United States. The FairTax Act of 2015, HR 25 in the US House of Representatives and S 155 in the US Senate.

I SAW ON TV HELP FEED THE OTHER COUNTRY WELL THAT BS MY FRIENDS LIVE IN PA . & LAID OFF & THE APARTMENT THAT HE LIVE IN THEY ALL HAVE TO GET OUT .
THEY HAVE TO GO TO A CHURCH FOR HELP & YES THANK GOD THEY CHURCH IS HELPING .
IN WILKES BARREA THEY HAVE THIS FOOD KITCHEN EVERYONE IN ON LINE FOR A MEAL
KIDS WITH FAMILY ABOUT 100 WAITING FOR FOOD IT SO SAD THEY HAVE NO JOB WHY THE ILLEGAL IMMIGRANTS THAT WHY (FROM WHAT I WAS TOLD )

Oh Southbronx, it's just so sad and tragic. So many of our fellow Americans are losing everything when often times they had so little to begin with. A tragedy of monumental proportions. All caused by this stupid treasonous government and a handful of bad policies that must be reversed to fix including chief among them, stopping illegal immigration and dramatically reducing legal immigration.

Networks Ignore IRS Admitting Illegals Could Receive Back Taxes & EPA Study on Fracking

In Thursday’s edition of stories ignored by the top English and Spanish networks, the six of them declined to report that the Internal Revenue Service (IRS) has admitted that illegal immigrants could apply for back taxes under President Obama’s amnesty plan as well as a report by the Environmental Protection Agency (EPA) that fracking does not harm drinking water.
While English-language networks ABC, CBS, and NBC plus Spanish-language networks MundoFox, Telemundo, and Univision skipped these reports, the Fox News Channel (FNC) program Special Report with Bret Baier offered news briefs on both subjects during Thursday’s show.
Concerning the IRS’s admission regarding illegal immigrants, host Bret Baier stated the following in the first brief:
The IRS confirms illegal immigrants can collect back taxes under president Obama's amnesty plan. In written responses to Senator Chuck Grassley, IRS Commissioner John Koskinen admitted that illegals granted amnesty will be claim refunds on returns they never filed because of the earned income tax credit.
A Washington Times article added how, under normal circumstances, “[t]axpayers must have Social Security numbers in order to claim the EITC, and illegal immigrants aren't supposed to have numbers.” Under the President’s amnesty, illegal immigrants would be given work permits and then allows them to receive Social Security numbers.
Once that’s done, the Times piece went on to explain that: “IRS lawyers have ruled that once illegal immigrants get numbers, they can go back and refile for up to three previous years' taxes and claim refunds even for time they were working illegally.”
Turning to the other story that failed to receive the light of the day on the networks, the findings of the EPA report struck a blow to the Obama administration and environmental groups when it was released after being requested by Congress. On Special Report, Baier summarized the findings in a 22-second brief:
The Environmental Protection Agency, EPA, says fracking does not harm your drinking water. In a draft report released today, the EPA says drilling for oil and natural gas is safe. However, in some cases poorly constructed drilling wells and improper waste management affected drinking water, but the number of those cases, according to the EPA, was small.

The report said the agency "did not find evidence" that any process has "led to widespread, systemic impacts on drinking water resources in the United States."
The agency did say the controversial drilling technique could affect drinking water if safeguards aren't maintained. It found specific instances where poorly constructed drilling wells and improper wastewater management affected drinking water resources.
But the EPA also reported the number of cases was small compared with the large number of wells that use hydraulic fracturing, better known as fracking.
