    We need to tell the mexicans to shove it where the sun don't shine. The kid was stupid, he was wrong and he got burned. You don't climb a power pole and not expect to get shocked. Well he climbed the fence tossed rocks at an armed border patrol agent. He got what he deserved. End of story. Just shows all they want is to get a quick buck out of the USA. We need to hand a sigh on the wall where the shooting took place. "Climb the wall and next time it could be you".

    EL PASO, Texas -- The family of 15-year-old Sergio Adrian Hernandez Guereca is letting their lawyer do all the talking in their lawsuit accusing the unidentified border patrol agent who killed Guereca of wrongful death and civil rights violations.

    "There's no way they can ask for retribution," said Bob Hilliard, the family’s attorney.

    The family is asking for $25 million and a conviction of the agent.

    "They're hopeful an objective investigation will conclude criminal charges should be brought against the man who murdered their son," said Hilliard.

    As KFOX 14 has reported, on the evening of June 7, FBI officials said the agent was trying to arrest illegal immigrants when he came under a rock attack.

    "Initially, the FBI issued a statement saying the border patrol agent was surrounded and was being pelted with rocks and was in fear of his life and he shot in self-defense," said Hilliard.

    One of the bullets hit Guereca right between the eyes.

    "The only redress the parents have is to ask for monetary compensation from the U.S. government for the wrongful death of their son," said Hilliard.

    Hilliard said the teen was no threat to officers, but in several interviews conducted by KFOX 14, officials said a rock can be a deadly weapon. Hilliard said video taken by an eyewitness will prove the agent was in the wrong.

    "An American citizen who was on top of the bridge came forward and said she'd videotaped the whole thing. The videotape completely and 100 percent contradicts the statement by the FBI," said Hilliard.

    The video shows the U.S. border patrol agent arriving on his bicycle near the Paso Del Norte port of entry. The agent is seen holding a person in custody while surrounded by rock-throwing suspected illegal immigrants then firing his gun and hitting Guereca.

    The family said their son was just watching from underneath the bridge. The lawsuit goes on to say after the shooting the agent and other agents that arrived were negligent and didn't attempt to render aid to the teen and left him for dead.

    Federal records show the teen had an extensive criminal history with four arrests on suspicion of smuggling illegal immigrants.

    As for the agent, he went back to work just days after the shooting, and has not been found of any wrong-doing.

    KFOX 14 is waiting to hear back from FBI officials on the latest in their now more than six month investigation.

    Here is the whole story in a nutshell.

    Federal records show the teen had an extensive criminal history with four arrests on suspicion of smuggling illegal immigrants.

    As for the agent, he went back to work just days after the shooting, and has not been found of any wrong-doing.
    NO AMNESTY

    Don't reward the criminal actions of millions of illegal aliens by giving them citizenship.

    Lawyers for the family of a Juárez teenager shot and killed by a U.S. Border Patrol agent in June have announced plans to file a lawsuit in federal court on Monday.

    Sergio AdrÃ*an Hernández Güereca, 15, was shot and killed on June 7 by the agent, whose name has not be released by the agency.

    Border Patrol officials said the agent fired after coming under attack by people throwing rocks near the Paso del Norte Bridge in Downtown El Paso.

    Hernández died on the Mexican side of the river of a bullet wound to the head.

    The agent was placed on regular duty a few days after the shooting. He has not been charged with wrongdoing, but the U.S. Justice Department launched a civil-rights investigation soon after the shooting.

    "Even now, it feels like it was yesterday," the teen's father, Jesus Hernández, said Friday.

    "There should be justice within the law," Jesus Hernández said. "We've done everything (authorities asked). We want my son's record cleared of all the lies. We want the American authorities to truly work and do their job."

    The teen's family described him as a student who stayed out of trouble. But U.S. law enforcement officials said AdrÃ*an Hernández had a criminal record for guiding undocumented immigrants across the border.

    The lawsuit against the U.S. government and other federal agencies, including the U.S. Border Patrol and the U.S. Bureau of Customs and Border Protection, will be filed by attorneys Bob Hilliard of Corpus Christi and Cristóbal Galindo of Houston on behalf of Sergio Hernández's parents, Maria Guadalupe Güereca and Jesus Hernández.
    "When did we start allowing Border Patrol agents to shoot across the border and kill an unarmed teenager?" Galindo asked in a news release. "Sergio was like many young teens in Mexico. He loved to play soccer and wanted to one day become a soldier or police officer. The family deserves answers as to why the boy had his life cut short by a U.S. law enforcement official."

    On a cell-phone video of the incident, a Border Patrol agent is seen arriving on a bicycle. As the agent attempts to detain a man on the U.S. side of the river, someone on the Mexican side of the river begins throwing rocks at him. On the video, the agent is seen pointing his handgun, and then three gunshots are heard. Sergio Hernández can then be seen lying on the ground on the Mexican side. The video doesn't show who was throwing rocks.

    "The agent raised his firearm, intentionally and methodically took aim at an unarmed 15-year-old boy standing on Mexican soil and then pulled the trigger. Twice," Hilliard said in the news release. "The second bullet hit Sergio between the eyes, killing him."

    Doug Mosier, spokesman for the Border Patrol's El Paso sector, declined to comment on the expected suit.

    Hilliard and Galindo will have a news conference in Corpus Christi on Monday afternoon to talk about details of the lawsuit, a spokeswoman for Hiliard said Friday.

    Need to sue Mexico for allowing illegal criminal invasions of the U.S., murdering and raping innocent citizens every day and night, unlawfully employing jobs throughtout the Country, that will cease the problem.

    Agreed. But we all know some liberal judge will award them hundreds of thousands of tax payers dollars.

    Meanwhile back at the ranch Americans are being killed, maimed and raped by illegal alien alcoholics and sexual deviants. If any member of my family is ever harmed by an illegal alien, I will file a class action lawsuit against the US and Mexican governments on behalf of everyone who has had a loved one killed raped or maimed by an illegal alien,.
