Former Alabama Supreme Court Judge Roy Moore of Alabama said in the state’s Thursday evening senatorial debate that Dreamers are not a protected class under the law because Congress never passed the DREAM Act in 2010.

“There’s no such thing as a Dreamer. You know why? It was never passed by Congress,” Moore said Thursday night in a debate with incumbent Sen. Luther Strange, who filled the vacancy left behind after Attorney General Jeff Sessions forfeited his seat to serve in the Trump administration.

The Obama administration failed to push the Dream Act through Congress. The bill would have provided a path to citizenship for illegal immigrants brought to the U.S. as children if they attended college or completed a two-year stint in the military.

The administration then started the Deferred Action for Childhood Arrivals (DACA) program in 2012. The program provides protection for roughly 800,000 young men and women who are unauthorized immigrants, and allows them to work in the country legally.

Attorney General Jeff Sessions announced in early September that the Trump administration would formally rescind DACA. “I am here today to announce that the program known as DACA that was effectuated under the Obama administration is being rescinded,” Sessions told reporters at the Department of Justice.

President Donald Trump and Vice President Mike Pence have put their full endorsement behind Strange. Moore notably edged out Strange in the first round of voting for the Republican candidate, notching 39 percent of the vote compared to 33 percent.
