NJ Passes Bill Letting Those Without Documents Get Licenses

13 states, including Delaware and New York, and the District of Columbia already permit immigrants without legal status to obtain drivers licenses

New Jersey lawmakers passed legislation Monday to allow immigrants who cannot prove they're in the country legally get driver's licenses.

the measure after lawmakers delayed considering the bill until after last month's election. Democratic Gov. Phil Murphy has said he supports.

Thirteen states, including Delaware and New York, and the District of Columbia permit immigrants without legal status to obtain drivers licenses, according to the National Conference of State Legislatures.

A 2018 study from New Jersey Policy Perspective, a progressive think tank, estimated about nearly 500,000 residents without documentation are of driving age in New Jersey.

The bill has gotten vocal support from immigrants rights groups, who lined the corridors of the statehouse and cheered loudly when the measure passed.

Panel after panel of witnesses supported the bill when it was in committee this year.
They say the measure could increase safety because many immigrants without legal documentation already drive without licenses and insurance. They also argue that obtaining a license would help people work and provide for their loved ones.

Among the supporters is Motor Vehicles Commissioner Sue Fulton, who cited a study by AAA that indicated unlicensed drivers were more likely to flee the scene of an accident than those with licenses.

"In my view our roads are safer when our drivers are trained, tested licensed and insured," Fulton said this month.

Opponents worry the measure rewards people for breaking the law and could lead to voter fraud because voter registration occurs when obtaining a license.

"So you're accommodating people who broke the law," Republican Assemblyman Erik Peterson, who voted against the legislation, said in an opening round of questions to Fulton.

Fulton responded that the bill was about increasing safety.

New Jersey bill to let illegal immigrants get drivers' licenses advances to governor's desk

New Jersey Gov. Phil Murphy, a Democrat, is expected to sign a bill into law that would allow illegal immigrants to obtain drivers’ licenses, according to reports.

The bill headed to the governor’s desk Monday after it was approved in separate votes in the New Jersey Assembly and Senate during the final legislative session of the year. Murphy has not said when he plans to sign the bill, but he had repeatedly asked the Democrat-led legislature to push it forward.

Immigrants who gathered in Trenton, the state capital, to support passage of the bill celebrated Monday at a local church, as seen in a video posted on Twitter by Cosecha Movement, an immigrant advocacy group.

Supporters argue the measure could increase safety because many immigrants without legal documentation already drive without licenses and insurance.

“The legislation advanced on the Assembly floor and by the Senate today is fair and responsible,” Assembly Speaker Craig Coughlin, a Democrat, told The Wall Street Journal. “It brings us one step closer to ensuring all motor vehicles and drivers are insured, thereby creating safer roadways for all New Jersey residents.”

The legislation would give illegal immigrants over age 16 the "Green Light" to obtain driver's licenses and learners’ permits. Under the terms, foreign documents such as passports or a driver's license can be submitted and used in the application process. A Social Security number is not required.

Safety and security risks?

The New Jersey bill also includes safeguards to protect the identities of illegal immigrants from federal agencies – something critics say will contribute to voter fraud and pose both a public safety and national security risk.

Speaking on "Fox & Friends" Tuesday, Acting Department of Homeland Security (DHS) Secretary Chad Wolf said the legislation would restrict the agency’s access to Department of Motor Vehicles (DMV) data in federal investigations.

"It's very similar to what we see with sanctuary policies around the country that, again, are not protecting the communities and the law enforcement officers trying to do their job[s]," Wolf said. “And, that's really concerning from a 'protecting the homeland' perspective."

Cosecha Movement celebrated the legislation’s passage in New Jersey following a two-year campaign to obtain the "right to drive without fear of ICE detention."

“This legislation means that I can take my kids to school, go to work and go to hospitals with peace of mind,” Caritina Hernandez, a Cosecha leader, told Insider NJ. “For many years, parents like me had to live our daily lives with fears that we would be unjustly pulled over, fined, given court dates or even worse, be separated from our families all because we are not allowed to drive legally in NJ – this ends today.”

The New Jersey bill was passed by the state legislature the same day New York's law permitting illegal immigrants to obtain drivers’ licenses took effect Monday. An inlfux of applicants flooded DMV offices across the state as immigrants -- with documents in hand -- suddenly became eligible to apply for licenses regardless of their U.S. citizenship status.

Democratic New Jersey Gov. Phil Murphy signed legislation that allows illegal aliens in the state to obtain valid driver licenses, marking the 14th state in the U.S. to give licenses to undocumented immigrants.

Murphy signed a bill into law Thursday that establishes two categories of driver licenses in New Jersey. One is the federally-compliant Real ID, which can only be obtained by individuals who are able to provide proof of legal residency. The other is the Standard Basic driver license and ID, which can be obtained by anyone in the state — even if they are living in the country illegally.

The first-term Democratic governor celebrated the bill’s passage, saying it will increase safety on the state’s roads.

“Expanding access to driver’s licenses is critical for the safety of New Jerseyans and a step toward building a stronger and fairer New Jersey for all,” Murphy said in a prepared statement. “Allowing residents the opportunity to obtain driver’s licenses regardless of their immigration status will decrease the number of uninsured drivers and increase safety on our roads. I thank my partners in the Legislature for sending this important bill to my desk.”

The law also requires the Chief Administrator of Motor Vehicle Commission to spend taxpayer funds on a two-year public awareness campaign, informing the state’s illegal alien community of their ability to obtain driver’s licenses.

It’s not immediately clear how big of an impact the new law will have on state roads once it’s implemented. However, a study released in 2018 from the New Jersey Policy Perspective, a liberal think tank, estimated there were roughly 466,000 illegal aliens of driving age in the state.

New Jersey is far from the first to implement such a policy. Thirteen other states in the U.S. allow illegal aliens to obtain driver licenses. New York’s own law, which was passed such earlier in 2019, just went into effect. Lines outside New York DMVs were inordinately long as many apparent first-time applicants arrived to obtain driver’s licenses.

New Jersey’s progressive government has become increasingly antagonistic toward immigration enforcement in general. Gurbir Grewal, the state’s Democratic attorney general, issued a directive in 2018 that largely prohibits local and state law enforcement from cooperating with ICE agents who are attempting to apprehend illegal aliens.
