New immigration rules are going into effect

With a new year comes new immigration programs for immigrants known as dreamers and parents of United States citizens and legal permanent residents.
Modifications to the Deferred Action for Childhood Arrivals program, known as DACA, remove the age cap, change the start date for continuous presence and extends work authorization from two years to three years.
According to the Administrative Relief Resource Center, up to five million undocumented immigrants will qualify for benefits under the expanded deferred action programs announced by President Barack Obama Nov. 20, 2014.
DACA provides deferred action to immigrants, meaning immigration services will defer deportation and permit noncitizens to remain in the U.S. for a period of time and authorize work permits. It is not a pathway to citizenship or legal residency.
Under the new rules, the time from which applicants for DACA need to show continuous residence in the U.S. has been moved up to Jan. 1, 2010 a change from the previous date of June 15, 2007. Applicants also must have a clean criminal record and show proof of obtaining a high school or GED diploma, among other requirements.
A completely new program that stemmed from Obama’s executive action announced last year is the creation of the Deferred Action for Parental Accountability, known as DAPA.
This program allows parents of U.S. citizens or permanent residents to remain in the United States with work authorization for up to three years. To qualify, parents must show a continuous residence in the country since Jan. 1, 2010 and no conviction of certain criminal offenses, among other requirements.
Both programs provide work authorization but do not guarantee any type of legal status in the United States nor is it a pathway to a green card or citizenship.
Kellie Draper, a Board of Immigration Appeals (BIA) accredited representative with St. Mary’s Immigration Program in Lexington, helps those applying for DACA. said the new rules don’t go into effect for DACA applicants until Feb. 18, the first day United States Citizenship and Immigration Services will accept applications under the new expanded criteria.
DAPA will not go into effect until May 19, the first day USCIS will begin accepting applications.
Some commonly held myths about applying for deferred action, courtesy of the Administrative Relief Resource Center:
• There is not a limited number of applications that will be accepted. There is no maximum for either program, all applications received while the program is active will be considered and reviewed.
• There is no requirement to reserve a place in the program before applying. Any person may apply as soon as USCIS begins accepting applications; -You don’t need a lawyer to file an application. Although potential applicants may apply without legal representation, St. Mary’s Immigration Program recommends working with a qualified non-profit organization with a Board of Immigration Appeals (BIA) accredited representative or an immigration attorney. • Deferred action will not allow an immigrant or their family to stay in the country forever or become U.S. citizens - DACA and DAPA only allow work authorization and protection from deportation for three year increments which can be renewed every three years if an individual remains eligible.
