    There is no Catch and Release except that which is required by ... law and court ruling .... those are the "catch and release" issues Trump wants to resolve with legislation if he can't figure out a way to rewrite the regulations that can somehow bypass the need for legislation. It would result in more lawsuits if he does it, and it may not stick, so Congress needs to take action and clean up these loopholes for UACs and these Phony Asylum Seekers.

    Should have been done day one and there IS catch & release. He made no changes. This has been in the news, from border agents reports to stats like the graphic below, to stories of 88k can stay of this thread.

    13 months more of this very expensive program that has been ongoing for 9yrs now. He is so worried about paying for programs that are beneficial to Americans yet this atrocity is the real money grabber along with every illegal working here anchor babying on our dollar. trump is not stopping that either. These people will be around for years if not permanently too. It is appalling.

    How many times had Trump told us catch & release had ended? I've personally heard it several times myself. Well, as we can clearly see, it has not ended.

    Regardless of who is to blame, President Trump has lied to us about catch & release. We heard for over year that catch & release had ended when it actually hadn't!

    There are two separate issues. One is the Border Patrol Catch and Release at the border. Trump stopped that early last year with his Executive Order. The other one is called catch and release, but it's not Border Patrol releases, these are releases ordered by the courts in accordance with the language of the statutes that Trump wants to change. It's two of his 71 point DACA DEAL conditions, it's in the Goodlatte bill, it was in the Grassley bill, it's in Cotton's Raise Act bill and probably in some other bills as well. None of them have passed, so this type of release continues and will until Congress changes the law.

    Catch & release is catch & release, regardless of the how and why. Trump and the Secretary of DHS (then Gen. John Kelly) told us several times last year that catch & release had ended. Of course when the border patrol and especially AG Jeff Sessions (https://www.washingtonexaminer.com/j...l-unacceptable) started coming out with the truth, the talk ended.

    Lesson hopefully learned: Don't purposely lie to the American people to make political hay when you know the truth! The Trump administration knew very well that this was something that couldn't stay hush-hush for long. Trump also should have known he couldn't actually end catch & release since there wasn't enough detention space available.

    Regardless of what some may want to think, there was some deceit on the catch & release issue.

    Yes, those are the DOJ Releases through the immigration courts based on the statutes. Here's your own article where Sessions explains that legislation is needed to fix that, because he has a big backlog in DOJ. This is the legislation that Trump is clamoring for so these people can be bounced out by Border Patrol at the border instead of taken into custody and processed for hearings through DOJ.

    Attorney General Jeff Sessions admitted Wednesday that the Justice Department and federal immigration officials are facing significant hurdles in trying to end the immigration practice known as "catch and release."

    Republicans have long complained about the federal policy that involves detaining illegal immigrants and then releasing them in the hope that they would turn up for their immigration court hearing. Thousands never showed up, which led the Trump administration in February to say they would move to immediately return those illegal immigrants to their home countries.

    Despite that change, however, Sessions said the reality is that the government is being overwhelmed with the number of illegal immigrants still coming in, which is why catch and release is still effectively happening.

    "It's not the policy, it's just the reality that there is so many people claiming and being entitled to hearings that we don't have the ability to provide those hearings, and they're being released into the community and they're not coming back for their hearings," Sessions told the Senate Judiciary Committee.

    "It's still unacceptable," he said.

    Sessions said there was a backlog of 300,000 immigration cases in 2011, and now that number is "over 600,000."

    Sessions said his department was examining what solutions his department might have "short of [requiring] legislation," but went on to add that filling all of the administrative gaps for robust deportation, "legislation is critical."

    "We are adding judges," Sessions added later. "We've added 50 already. We'll have another 40 by January. And the backlog, instead of going up, will be going down, and we'll continue to work at that."

    The attorney general was responding to questions from Texas Senator Ted Cruz, who said he was being informed by conversations with Customs and Border Protection officers that "catch and release" wasn't being slowed or shut off, an issue that Trump campaigned on.

    A June report by Reuters suggested that there had been no significant change to catch and release despite the change in administration's policy.

    Cruz further noted that illegal border crossings appeared to have dramatically dropped in the early months of the administration, but that a recent surge was beginning to concern residents who live along the border.

    Federal immigration officials also deal with other legal and logistical constraints that can significantly slow deportations, like a shortage of beds in detention facilities and a previous court ruling that limited the stay of women and children to only 21 days.

The story was circulated by Ted Cruz, who should as a lawyer and a member of the US Senate know better than anyone that this is a matter of legislation and funding, a responsibility of the US Congress. I sure hope Ted has introduced some legislation to solve the problem Congress caused and so far refuses to fix and whose responsibility for enforcement in this arena is 100% with Jeff Sessions, Attorney General and head of the US Justice Department responsible for all, 100% of immigration court hearings.

    But it doesn't bother me at all if you want to blame Trump for it. He's working every possible way to build enough pressure on Congress to pass the needed legislation using the big "SURGE" at the border that's so huge troops are needed at the border to contain it, to get the legislation passed.

    Border Patrol releases in DHS did end early last year. What didn't end are the legally required releases by DOJ which can't end until the law is changed.

    Yes, because Catch and Release by DHS, did end early last year. The catch and release that didn't end is the releases by DOJ that DHS has nothing to do with. Trump's EO only addressed what could legally be ended, that is the releases by Border Patrol, not DOJ. I mean if you want to keep going on about this, it just makes Sessions look bad, because it's his department that is still catching and releasing because that's the law and will be until Congress changes it.

    Absolutely not true. DHS did not end catch & release EARLY LAST YEAR!

    The Trump administration reinstated a de facto catch-and-release policy for illegal immigrants nabbed crossing the border in Texas, with Border Patrol agents being told Wednesday not to even bother turning them over for speedy deportation because there was no bed space, a top agent said.

    The problem, said Brandon Judd, an agent and president of the National Border Patrol Council, is that illegal immigration has surged once again after dipping during the early months of President Trump’s tenure.

    That has left the deportation agency, U.S. Immigration and Customs Enforcement, struggling to find beds to hold the illegal immigrants. As a result, Border Patrol agents who bring apprehended people to ICE are turned away.


    “We’re going to have to release them out our front door,” Mr. Judd said. “Even if we try to turn them over to them, they’re just not going to take them.”

    He said ICE’s San Antonio office, which handles most of the traffic from the Texas border, said it would have to refuse to take any family units the Border Patrol tries to turn over and will soon reject even non-family migrants.

    Later Wednesday, Mr. Judd said, ICE’s El Paso office told agents it also was at capacity and was refusing family units.

    “The moment we start releasing them out our front door, you’re going to see a huge increase take place in the numbers coming across,” he said.

    The NBPC endorsed Mr. Trump in last year’s election, and more than a year later the president still touts that endorsement in campaign-style speeches.

    Mr. Judd said the rhetoric from the president is good and had an immediate effect earlier this year in persuading migrants not to bother making the journey north. The Border Patrol set a modern-day record low of slightly more than 11,100 illegal immigrants nabbed in April.

    But as catch-and-release continued, word seeped back to home countries and the effects of Mr. Trump’s rhetoric waned. More than 26,000 illegal immigrants were arrested at the border last month, Mr. Judd said.

    “The word got back to all of these countries that hey, the catch-and-release hasn’t ended,” he said. “The people that are supposed to be enforcing President Trump’s policy, they’re just not. They’re not following through on the promises he made.”

    ICE didn’t deny the problem. Instead, the agency said it has to prioritize cases and is struggling with how to comply with court rulings on treatment of illegal immigrant families traveling together.

    An official at U.S. Customs and Border Protection, which oversees the Border Patrol, insisted the agency won’t end up issuing notices to appear — essentially just notifications of future immigration hearings. The official said CBP will pursue expedited removal or speedy deportation.

    “We are in the business of catch and remove, not release,” the official said.

    Tyler Houlton, acting press secretary at the Department of Homeland Security, suggested the problem was a lack of support from the courts for Mr. Trump’s mission.

    “We enforce the law but are severely constrained by litigation, court rulings and debilitating legal loopholes that limit our ability to carry out our mission,” he said. “These limitations are exactly why the president has proposed his immigration enforcement priorities and why we are working with Congress to address these problems.”

    But Mr. Judd said the department’s policies are getting in the way of the president’s agenda.

    “The people that are supposed to be enforcing President Trump’s policy, they’re just not. They’re not following through on the promises he made,” Mr. Judd said.

    His comments tracked with those of Chris Crane, the president of the National ICE Council, which represents deportation officers. In a letter to Mr. Trump this week, first reported by The Washington Times, Mr. Crane said the president’s top lieutenants were preventing him from hearing what is really going on.

    “While officers view the President’s position on enforcement as courageous, the Trump administration has left all of the Obama managers and leadership in place, a group that ICE Officers know after the last eight years to be completely incompetent, corrupt and anti-enforcement,” Mr. Crane wrote.
    He asked for better lines of communication directly with the president.

    The White House declined to comment Wednesday.

    Mr. Trump on Tuesday nominated Tom Homan, who had been serving as acting director of ICE, to hold the position permanently. Kevin McAleenan, who has been acting commissioner of CBP, was nominated months ago and is awaiting action by the Senate.

    Both men have earned praise from those who want stricter enforcement of immigration laws. But Mr. Crane and Mr. Judd said holdovers from the Obama era in the agencies and at the Homeland Security Department put up hurdles.

    “Obama holdovers are still running the program, running the show. We’re putting ourselves right back into the same situation we were under the Obama administration,” he said.

    Catch-and-release was one of those issues. Agents said they would arrest illegal immigrants at the border only to be ordered to release them immediately after giving them a notice to appear.

    While the Obama administration considered that enforcement, to illegal immigrants it was an invitation to come to the U.S. Once released, they could slip into the shadows and blend in with the 11 million other illegal immigrants, who are gaining a foothold in society.

    Central Americans even called the notices to appear “permisos,” or free passes.

    Mr. Judd said Border Patrol agents under the Obama administration last year were ordered to release newly arrested illegal immigrants with notices to appear. That ended under Mr. Trump, and agents were able to turn illegal immigrants over to ICE for holding and processing — though ICE would still issue notices to appear and release them.

    “The catch-and-release program never ended, and once that information got back to countries throughout the world, we started to see an increase,” he said.

    He said it’s not just Latin America. Agents in San Diego have apprehended dozens of people from Asian countries so far in fiscal year 2018, which began Oct. 1 — including 64 from India.
