In addition, employers enrolling in E-Verify must complete an attestation form (available here) to indicate that the employer (a) has received E-Verify training materials and that all employees who will administer the program have completed the tutorial; and (b) has posted the required participation and anti-discrimination notices. The new law also creates a cause of action for employees and prospective employees in the event the employer fails to abide by the various E-Verify provisions. The entire law can be viewed here.
This seems rather anti-employer. It does not require participation, but rather sets up requirements for the employer if the employer chooses to participate in E-Verify. In effect, it makes the process of using E-Verify more burdensome, thereby encouraging employers to not participate. Not surprising from a sanctuary state.

Agreed ReggieMay! It's amazing that simply entering a social security number into an on-line data base would require so much oversight and proceedure! Sounds as if they are trying to make it more difficult than it has to be, perhaps to discourage those who elect to participate.

    For Federal Contract Employers
Federal contractors and subcontractors are required to use E-Verify as of September 8, 2009. Executive Order 12989 mandates the electronic verification of all employees working on any federal contract. The amended Executive Order reinforces the policy that the federal government supports a legal workforce.
