SAN FRANCISCO (KRON) — San Francisco police on Wednesday announced an arrest in a string of anti-Chinese taggings that sparked outraged among residents and on social media, and prompted a hate crime investigation.

Police arrested John Schenone on Tuesday.

Schenone has been charged with five counts of felony hate crime and five counts of felony vandalism.

The graffiti turned up over the weekend, according to police, with vandals spray painting the words “No more Chinese.” The graffiti was been reported in at least five locations, including in the Bayview District and in the Portola neighborhood.

Vickie Chau first posted a photo of a vandalized fence near McLaren Park on Sunday after she said her dad spotted the graffiti.

Supervisor Julie Christensen issued a statement saying the suspect was arrested on Tuesday night. She credited “the diligent and swift actions of our city staff.” Christensen said, “Disrespect for our fellow residents and visitors, especially based on ethnicity, is not and will not be tolerated in San Francisco.”

Like in Germany, and Sweden and Poland common citizens are forbidden to protest government forced remaking of the population into something alien to its native people.

How can "no more Chinese" be a hate crime? Did anyone say "kill Chinese?" or Chinese are animals or sub human or anything like that? No--nothing like that. No it was a simple protest to stop the invasion of Chinese, how many are illegal aliens? HOW IN THE NAME OF GOD IS THAT HATE? What the government is really saying is sit back passively while the very composition of the American people is artificially changed by government force and shut the hell up or we will hurt you. This is despotism obvious and nasty. This man is to be made an example of to silence other would be protesters. This is the warning of a despotic government to citizens to not fight back. Where are the protest defending the suppression of this man's right to freedom of speech. At the most he would be guilty of simple vandalism, a crime not worthy of more punishment that to clean off the paint.

Everybody reading this article should be scared as hell. San Francisco has just shown itself to be a despotic state that will not tolerate freedom of speech and hides its despotism under a camouflage of phony hate crime racism. Some Chinese (I better check the spelling because if I miss spell it who knows I could be arrested on some kind of let's pretend it is hate FELLONY) decided that somehow it was offensive and that makes it a ELLONY to complain.

Patrioriots if we do not rise up in mass and denounce this despotic abuse of power, it is only a matter of time before they start coming after everyone in ALIPAC because we have the impudence to protest the illegal alien invasion. Have we not already been accused of "racism?"

Patriots do not be silent or you will be the next political prisoner.

The graffiti on people's homes and businesses causes damage and cost money to fix. That makes it a criminal offense.

California Penal Code § 594

(a) Every person who maliciously commits any of the following acts with respect to any real or personal property not his or her own, in cases other than those specified by state law, is guilty of vandalism:
(1) Defaces with graffiti or other inscribed material.

(2) Damages.

(3) Destroys.

Whenever a person violates this subdivision with respect to real property, vehicles, signs, fixtures, furnishings, or property belonging to any public entity, as defined by Section 811.2 of the Government Code, or the federal government, it shall be a permissive inference that the person neither owned the property nor had the permission of the owner to deface, damage, or destroy the property.


(b)(1) If the amount of defacement, damage, or destruction is four hundred dollars ($400) or more, vandalism is punishable by imprisonment pursuant to subdivision (h) of Section 1170 or in acounty jail not exceeding one year, or by a fine of not more than ten thousand dollars ($10,000), or if the amount of defacement, damage, or destruction is ten thousand dollars ($10,000) or more, by a fine of not more than fifty thousand dollars ($50,000), or by both that fine and imprisonment.

(2)(A) If the amount of defacement, damage, or destruction is less than four hundred dollars ($400), vandalism is punishable by imprisonment in a county jail not exceeding one year, or by a fine of not more than one thousand dollars ($1,000), or by both that fine and imprisonment.

(B) If the amount of defacement, damage, or destruction is less than four hundred dollars ($400), and the defendant has been previously convicted of vandalism or affixing graffiti or other inscribed material under Section 594, 594.3, 594.4, 640.5, 640.6, or640.7, vandalism is punishable by imprisonment in a county jail for not more than one year, or by a fine of not more than five thousand dollars ($5,000), or by both that fine and imprisonment.

(c) Upon conviction of any person under this section for acts of vandalism consisting of defacing property with graffiti or other inscribed materials, the court shall, when appropriate and feasible, in addition to any punishment imposed under subdivision (b), order the defendant to clean up, repair, or replace the damaged property himself or herself, or order the defendant, and his or her parents or guardians if the defendant is a minor, to keep the damaged property or another specified property in the community free of graffiti for up to one year.  Participation of a parent or guardian is not required under this subdivision if the court deems this participation to be detrimental to the defendant, or if the parent or guardian is a single parent who must care for young children.  If the court finds that graffiti cleanup is inappropriate, the court shall consider other types of community service, where feasible.

(d) If a minor is personally unable to pay a fine levied for acts prohibited by this section, the parent of that minor shall be liable for payment of the fine.  A court may waive payment of the fine, or any part thereof, by the parent upon a finding of good cause.

(e) As used in this section, the term “graffiti or other inscribed material” includes any unauthorized inscription, word, figure, mark, or design, that is written, marked, etched, scratched, drawn, or painted on real or personal property.

(f) The court may order any person ordered to perform community service or graffiti removal pursuant to paragraph (1) of subdivision (c) to undergo counseling.

(g) This section shall become operative on January 1, 2002.

So how many years are they going to throw him in jail for because he painted "No More Chinese" ??

This guy over here got 1 year in jail and 5 years probation for writing on some houses in permanent magic marker...

Good question, W. While I understand an arrest for the graffiti, I don't understand the "hate crime" of the words "NO MORE CHINESE". The man in New Hampshire said derogatory things in his graffiti against black people, called them "subhumans", but "NO MORE CHINESE" is like any of us saying "NO MORE SYRIANS". China is one of the largest sources now of illegal immigration, surpassing most other countries, so why is saying you want that to stop a "hate crime"? And with all the news stories about the Chinese Birth Tourism in California, I just don't see this as a "hate crime". It's a protest against government policy that ignores illegal immigration and promotes excessive legal immigration. It's free speech and should be protected by the first Amendment, not the graffiti act itself, but the words.

Defendant accused of causing more than $2,000 in damage

A 27-year-old man has pleaded no contest to felony vandalism in a case that included painting graffiti on a building in Old Sacramento.

Sacramento Superior Court Judge Ben Davidian sentenced Brian Quillin to 210 days in Sacramento County jail and five years of searchable probation.

Quillin also is prohibited from possessing graffiti tools or paraphernalia and associating with known graffiti taggers.

He was ordered to stay at least 100 yards away from the locations where the offenses were committed and to pay restitution to the victims, according to a Sacramento County District Attorney’s Office news release.

On Feb. 6, Quillin, tagged his graffiti moniker “PHERM” on the Pioneer Square building in Old Sacramento. On Feb. 9, he tagged the same moniker on a sound wall near Winter Garden Avenue and Northgate Boulevard. He left his moniker on a billboard along Highway 160 on March 29. The graffiti caused an estimated $2,200 to $2,700 in damage, authorities said.

A Sacramento code enforcement officer recognized the PHERM moniker from a 2008 graffiti case, initiating an investigation by the Sacramento Police Department, Code Enforcement and the District Attorney’s Office. Social media accounts belonging to Quillin contained images of the current graffiti and posts regarding the 2008 graffiti prosecution, all of which were used to tie him to the crimes in this case, authorities said.
