Tom Cotton, Top Senate Immigration Hawk, Supports Legalization in DACA Deal

Tom Cotton, top Senate immigration hawk, supports legalization in DACA deal

    Byron York
    September 4, 2017

Arkansas Republican Sen. Tom Cotton, who after the departure of Jeff Sessions has emerged as the Senate's leading immigration hawk, says he would support the legalization of all current DACA recipients -- nearly 800,000 of them -- if Congress would at the same time pass measures to protect Americans workers from the effects of that legalization.
DACA, which stands for Deferred Action for Childhood Arrivals, was created by President Obama's unilateral decision to shield from deportation and grant work permits to people who were brought illegally to the United States as children. President Trump is set to announce Tuesday whether he will end the program. Congress would then decide the next step for the nation's so-called Dreamers.

"We ought to take care of them," Cotton said in a telephone conversation Sunday, noting that DACA recipients arrived in this country illegally "through no fault of their own."

"In any legislative fix, I would like to see them receive a green card," Cotton said. At the same time, he continued, "We ought to recognize that giving them legal status has two problems. First, it creates a whole new class of people who will then be eligible for a green card and citizenship -- namely, the extended family members of those who will receive legal status who can, through chain migration, get legal status themselves."

"Second," Cotton said, "it will encourage more illegal immigration.

The first problem can be fixed by passing the RAISE Act, Cotton said -- the bill Cotton has sponsored with fellow GOP Sen. David Perdue that would strictly limit chain migration as well as re-balance current immigration policy in favor of skilled immigrants.

The second problem could be addressed by extending E-verify across the country, which Cotton called "the best way to reduce more illegal immigration."

Cotton has conferred with President Trump and with White House staff on the upcoming decision on the fate of DACA. Cotton said the president's instincts are that DACA, imposed by Obama with no action from Congress in what many Republicans felt was an unconstitutional overreach, is simply not defensible in court.

That is important because several state attorneys general have threatened to sue the Trump administration on Tuesday if the president does not end DACA. The lawsuit threat has added time pressure to what was already a Trump campaign pledge to dismantle the program.

Republican insiders expect the president to do something that would satisfy the attorneys general enough so that they would postpone the lawsuit. Trump could end DACA, but do so on a delayed basis, as Politico reported Sunday, or he could take a lesser step, like halting any new work permits under the program.

Convincing the attorneys general to hold off would have the effect of creating time for Congress to come up with a fix for the DACA problem. And that is where the question of legalization comes in.

Would Senate Democrats, not to mention Republicans who supported the Gang of Eight comprehensive immigration reform bill, actually vote for the RAISE Act -- which some have already said they oppose -- in exchange for legal status for Dreamers? It's not at all clear. But there's no doubt that if the president puts DACA on a timetable to extinction, Congress will be on a deadline to do something. And that is when negotiating begins.

So far, most of the Republican lawmakers who have spoken out about DACA are supporters of comprehensive immigration reform -- Sens. Lindsey Graham, Thom Tillis, and Jeff Flake, as well as Reps. Mike Coffman and Carlos Curbello. And, of course, House Speaker Paul Ryan, who has called on the president not to end DACA, even though Ryan once described the program as "blatantly unconstitutional."

But the vast majority of Republican lawmakers have not been heard from. Most are united in their belief that President Obama overstepped his authority by instituting DACA. They believe the action would likely not survive court scrutiny. They believe they have to do something to accommodate current DACA recipients while not making the overall immigration problem worse. If the president ends DACA, it seems unlikely they would revive and codify the program without also enacting some significant reform of the immigration system.

DACA, Cotton said Sunday, is "a mess of President Obama's making." But now it's up to Republicans to clean up that mess. "We should find a way to give [DACA recipients] legal status," Cotton concluded, "but we also have to mitigate the inevitable consequences of that action."

No, no deal. If you can't push your own bill with the strong support of this President who has been actively involved in the Raise Act and even improved it a lot, without a leverage exploiting DACA, then you Senator Cotton are part of the Swamp Creatures we want to drain out of DC. What is wrong with you? There is no merit for these people to have "legal status". Their situation is no different than what American children whose parents work overseas in government, business and military deal with every single day. They grow up in foreign countries, when their time is up, they come home. My husband along with his older brother and younger sister grew up in the Middle East while his parents worked for an oil company. When their parents retired, they moved home to the United States. Sure, it was very different for them but they acclimated. They didn't whine to stay in the foreign country they knew. They were 14, 16 and 18 when they moved home to the United States.

Tom Cotton is a former military person, he should know this as well or better than most. When children follow their parents to a foreign country whether legally or illegally, they don't get special treatment because they're there "through no fault of their own". This is stupid talk by Cotton, I've lost all confidence in him.

    PUKE!! GRRRRR!!!!!!!

Our Congress is proving itself to not only be a swamp, but a monkey zoo. Hire some chimps to run the Congress, they couldn't possibly do any worse than what we've got and they'd cost a lot less.

Profoundly disappointed but no longer surprised. Senator Tom Cotton's cohort on the Raise Act, David Perdue, has already revealed a willingness to compromise, to work with democrats. If nothing else this whole immigration debacle has brought out of the shadows more than illegal aliens. Sad.

Very sad. President Trump must end DACA in full without delay declaring all work permits null and void tomorrow, as an expired program he will not renew because it's not in the best interest of the American People or the sovereignty of our nation. President Trump is the only one who truly gets it with any power to end this DACA Charade and Dreamer Farce.

Yes, he'll have back-lash, yes, he'll be called a racist and a xenophobe, yes, Congress will try to punish him and refuse funding for the wall and increases in budget for ICE agents to carry out more rapid deportations. But that's just how sick and ill our country is at this point. We need the cure and Trump is it.

There is no choice, he must do it and take the heat. It will pass, just do it and move the Trump Train on to tax cuts at 15% for business and corporations, demand a repeal of the Obamacare mandates and passage of the repeal of McCarran-Ferguson, and when you have the time go knock the hell out of North Korea's nuclear program. Get it done.

You can't rely on Congress, you can't even rely on advisers, you know what to do, trust yourself when all others doubt you, you will be hailed as one of the greatest Presidents in US history if you make these tough decisions which you are fully capable of doing.

Thank you for all that you are doing to fix our country, Mr. President. There is so much to do, we know that, the problems are politically complicated which is why no one else has ever fixed them, but once they are fixed, everyone will be happy and know that you are the one who did it, against all odds and with little support.

Just do it. Don't worry about the optics, tell Jared and Ivanka "don't worry about it, you've got this". Just do it. Don't delay the end of the program, don't delay ending the work permits, nullify them with the expiration of the program tomorrow. Throw Congress a bone that you won't deport "good ones" between now and the end of February.

Good luck and look forward to the announcement tomorrow!

Waiting till now has certainly brought the amnesty traitors by increasing numbers to the surface. It is best that we know them.

The President has a swarm of opposition with friends in the media, Congress, and elsewhere to try and push him toward continuing amnesty and to forget his promises to the American people. Strength is necessary to act in the best interests of the citizenry. Drowning out the voices, even those close to him, will be a test. I hope he ends DACA to succeed further and to "Make America Great Again."

They were always there, it's why Congress never passed a law to prevent Presidents from these illegal and unconstitutional acts with illegal immigration. Congress is rotten to its core. The SWAMP from HELL, two chambers full of monkeys. Upgrade and hire some chimps to run Congress, they couldn't do any worse and they would cost a lot less. They would also be cuter and more fun to watch. They know all about defending territory too and running invaders out of their space.

    Replying to @TomCottonAR

Labor Day is also a good day to remember there is NO job an American won't do ... for a decent wage. 2/?

Labor Dept data shows virtually every job is majority natural-born American, not guest worker or even naturalized American. 3/?

Ever noticed how "jobs Americans won't take" are physically demanding, even dangerous? Maybe they SHOULD pay more as fair compensation! 4/?

And "jobs Americans won't do" is kind of insulting to millions of Americans who do them. Thank & respect them, don't condescend to them. 5/?

Yes, welfare waste & imbalanced trade deals are partly to blame. Let's fix those too! But don't condescend to American workers. 6/?

In any case, happy Labor Day to the American worker! You are what makes America work. 9/9
