Two Border Patrol agents involved in El Paso shooting
EL PASO, Texas An unidentified man was injured today in a shooting incident involving a pair of Border Patrol agents in south El Paso.
Agency spokesman Martin Hernandez says agents were conducting surveillance when they followed a pair of vehicles to an auto parts shop parking lot.
Authorities say two unidentified men were witnessed exchanging a roll of money.
Hernandez says when the agents approached the pair, one man surrendered -- but the other drove toward the agents, hitting their unmarked vehicle and then taking aim at the agents.
At least one agent shot at the driver of the charging vehicle.
Both suspects then fled.
One suspect was located at an El Paso hospital, being treated for what Hernandez believes is a non life-threatening gunshot wound.
The other suspect got away.

Wonder how long it will be before they try to prosecute the Border patrol agents for doing their job ? How can we continue to allow mexico to break our laws with no fear of prosecution ? It just sickens me that these illegals are allowed to get away with murder while we as Americans are held to another standard. Rant over, I feel better now.

A man drove himself to Thomason Hospital after being shot by a Border Patrol agent he allegedly tried to run over with a pickup Tuesday afternoon in the parking lot of a busy El Paso auto supply store, authorities said.
The shooting occurred after two agents in street clothes spotted a cash transaction between the driver and another man who got into the truck in the parking lot of Alamo Auto Supply, 5923 Gateway West at Trowbridge Drive, Border Patrol spokesmen said.
The wounded man was hospitalized with wounds -- possibly to the hand and shoulder -- that were not considered life-threatening, Agent Patrick Berry said. The second man was taken into custody.
Names were not immediately released as an investigation continued by the Border Patrol, Immigration and Customs Enforcement, the FBI and El Paso police.
The two agents involved in the shooting are part of the Border Enforcement Security Task Force, known as BEST, which has been involved in recent busts of truck drivers caught smuggling immigrants, officials said.
Border Patrol officials said the incident began when agents saw the Dodge truck and a Dodge Stratus, driven by a man with his wife and children, meet in the parking lot of Alamo Auto Supply. The agents saw the man in the Stratus go into the store, exit and get into the passenger side of the pickup.
"There, the agents observed the transfer of a roll of cash between the subjects" in the vehicles, Border Patrol spokesman Doug Mosier said.
The agents went up to the truck, identified themselves and were wearing badges around their necks, officials said. The passenger raised his hands in surrender as he got out of the truck, but the driver rolled up his window and allegedly tried to run over one of the agents, who fired multiple shots. The truck and wounded driver were later found at Thomason Hospital.
Federal agents and police filled up a section of the Alamo parking lot, which was sealed off with red crime-scene tape while many witnesses sat in another area waiting to be interviewed.

Border Patrol Says Texas Agent Shot Man to Protect Self
Posted: April 18th, 2007 10:39 AM EDT
Story by kfoxtv.com
At around 12:10 Tuesday afternoon, Border Patrol agents working as part of a special task force said they were following a gray, Dodge Ram pickup truck.
Agents said the driver pulled into the parking lot at Alamo Auto Supply on Trowbridge and Gateway West and another man in a green sedan got into the pickup truck and the agents saw the two men transfer a large amount of cash.
"They didn't know at that point what they were observing, but they were following their instinct at that point," said Doug Mosier, public affairs officer for border patrol.
The agents then decided to approach the truck, when they said the passenger in the pickup truck put his hands up as if to surrender to agents. And at the same time he exited the vehicle.
Border Patrol officials said the driver proceeded toward the agents and that's when one of the agents became fearful for his life and pulled out his weapon and started shooting, hitting the truck and the driver in the arm.
Border Patrol said the agent, shooting his weapon is within protocol because he was defending himself.
El Paso police found the truck around 1:30 p.m. at Thomason Hospital.
A witness believes he saw the driver running into the hospital.
"The guy came in holding his arm, his shirt was all bloody, we thought he cut his arm. He went into the information desk and the information lady took him back," said the witness, who didn't want to be identified.
By 2 p.m., law enforcement including Immigration Customs and Enforcement agents and police officers had surrounded the truck at Thomason, while Border Patrol agents put the man being treated into custody.
It is still not known if these men are illegal. It is also not known what exactly the two men were doing exchanging a roll of cash at an Alamo Auto Supply parking lot.
Border Patrol is still investigating the situation and the two men remained in Border Patrol custody Tuesday night.

Man will be charged with assaulting border agent

A 28-year-old man will face a charge of attempted assault on a U.S. Border Patrol agent in connection with a shooting Tuesday at an East-Central auto supply business.
Gerardo Felipe Ortiz of El Paso is being investigated by the FBI on allegations of trying to run over a Border Patrol agent in the Alamo Auto Supply parking lot at 5923 Gateway West, FBI spokeswoman Andrea Simmons said Wednesday.
Simmons said the incident happened after the agent and his partner followed a gray Dodge truck and a white Dodge car to the parking lot of the auto supply business.
The agents approached the truck and car after observing suspicious behavior between the vehicles' drivers.
As the agents identified themselves, Ortiz, who was driving the truck, allegedly attempted to run over one of the agents. In response, the agent fired his gun.
Ortiz fled the scene. He was later found at Thomason Hospital, where he was treated for wounds to a hand and shoulder.
"He is expected to be released from the hospital (Wednesday) afternoon, at which time he will be taken into FBI custody and charged with assault on a federal officer," Simmons said in a statement to the news media.
As of Wednesday evening, Ortiz's name was not on the list of inmates in public jail records.
The names of the Border Patrol agents involved in the incident have not been released.
Police spokesman Officer Chris Mears identified the driver of the white Dodge as Karlo Nava, 27, of El Paso. Nava was taken into custody at the auto supply store parking lot by agents of the U.S. Immigration and Customs Enforcement.
Simmons said Nava was taken to an ICE office, where he was questioned by ICE and FBI agents.
Simmons said ICE and the FBI released Nava from custody because he was not a suspect but was considered a "witness."
But Nava was immediately taken into custody by El Paso police on outstanding traffic warrants -- one for speeding and one for a red-light violation.
Border Patrol spokesman Doug Mosier has said the shooting, as in all shootings involving Border Patrol agents, will be reviewed internally by the agency.
Mosier said that according to findings from the preliminary investigation conducted by federal authorities on Tuesday, "there is no reason to think this was not a justifiable action."

Man shot by Border Patrol convicting to assault on agent
© 2007 The Associated Press
EL PASO, Texas — A man shot and wounded by a U.S. Border Patrol agent earlier this year has been convicted of assaulting the agent.
Gerardo Felipe Ortiz, 28, was shot in April after trying to run over Agent Federico Figueroa during a confrontation in an El Paso parking lot, according to federal prosecutors.
Figueroa and Agent Jose O. Garcia were working undercover the day of the incident when they spotted Ortiz and another man exchange a large amount of cash. After the agents identified themselves, prosecutors said, Ortiz drove at Figueroa and was shot in the hand and right shoulder.
Ortiz was arrested at a local hospital after driving himself to get medical help.
Ortiz, who remains jailed at the El Paso County jail, faces up to 20 years in prison when he is sentenced in January.
