CHARLOTTE, N.C. - A federal judge sentenced an undocumented immigrant to three years in prison for pointing a gun at a Charlotte-Mecklenburg police officer and then pretending to be shot when the officer drew her weapon and fired.

Prosecutors said Adolbo Albarran-Flores was on a plumbing job at a restaurant on Woodlawn Road when surveillance video showed him firing a gun in order to scare off someone he said was trying to break into his work van.

An officer in a marked car showed up and Albarran-Flores raised his arms and pointed the gun at the officer.

The officer fired a shot in his direction.

Prosecutors said Adolbo-Albarran pretended to be shot before throwing his gun into a bush.

By imposing the sentence, the federal judge found Albarran-Flores knew the person was an officer and assaulted her.

After Albarran-Flores serves his three year sentence and two years of supervised released, he will face deportation proceedings.
