    The Kenosha County Sheriff’s Department has received confirmation from U.S. Immigration Customs and Immigration Enforcement that a man charged in a local homicide by drunken driving crash is in the country illegally.

    Sheriff’s Department spokesman Gil Benn said Jorge Dominguez, 38, of Burlington, entered the country illegally many years ago and legally obtained a Wisconsin driver’s license.

    A Burlington man called for a ride after fleeing the scene of a Memorial Day crash that killed a Brighton woman and injured her family, a criminal complaint says.

    Investigators tracked Jorge Dominguez through the registration of the borrowed silver Mitsubishi Eclipse he left wrecked at highways 45 and N in Paris. They also found his Wisconsin driver’s license on the front seat of the car, which smelled of alcohol, the complaint says.


    Dominguez, 38, was charged Wednesday with homicide by intoxicated use of a vehicle and drunken driving as a second offense, among other crimes for the May 31 crash that killed Dawn Glogovsky, 45, and seriously injured her husband, Frank J. Glogovsky, who suffered damage to his spleen. Their 13-year-old son, Frank R. “Remiâ€

    It’s an all-too-familiar story: a previously arrested drunk-driving illegal alien has killed another innocent American.

    Frank and Dawn Glogovsky (pictured), along with their 13-year-old son, were driving home from a family gathering when their car was struck by Jorge Dominguez after he ran a stop sign. (The obituary noted that Frank and Dawn were childhood sweethearts and married in 1988.)

    All three members of the family were taken by emergency medical personnel to a hospital, but Dawn died there.

    A Burlington man who allegedly caused a fatal car crash Monday while intoxicated is an illegal immigrant who was driving with a suspended license and has served jail time in Racine County for several prior offenses, officials said Thursday.

    Because the man is an illegal immigrant, he likely should not have had a drivers license at all and should have previously been turned over to U.S. Immigration Customs Enforcement officials for possible deportation after completing his sentences in Racine County, officials said.

    ICE officials Thursday confirmed that the man, Jorge Dominguez, 38, is an illegal immigrant. Dominguez, of 544 Chestnut Drive in Burlington, was charged Wednesday with seven criminal offenses including homicide by intoxicated use of a vehicle for a crash Monday around 11 p.m. when he allegedly ran a stop sign at the intersection of highways 45 and N in the Town of Paris, killing 45-year-old Dawn Glogovsky and injuring her husband and son, all of the Paris area.     Dominguez has been in and out of the Racine County Jail since 2008, serving sentences for past criminal offenses including battery, cocaine possession and obstructing an officer. When local police or sheriffs’ departments arrest an illegal immigrant like Dominguez for such criminal charges, they are supposed to inform ICE, which will place a detainer hold on that individual so that when they are released they go to ICE for possible deportation, said Carl Rusnok, ICE spokesman.

    So Dominguez was clearly a dangerous criminal illegal alien, and was jailed in Racine County with an immigration hold put on him, yet he was released into America rather than deported after time served.

    The Fox News report (Illegal Immigrant Charged in Fatal Crash) also questioned why he was free, instead of being repatriated.

    Yet there is no explanation of why he wasn't. Could it be that Racine County practices Sanctuary Policies?

    Ryan says immigration reform should be incremental

    Ryan spoke to about 50 people at St. Patrick’s Church, 1111 Douglas Ave., at a bilingual listening session geared toward the Hispanic community.

    Sanctuary Policy Leads To Woman's Murder

    In the latest casualty resulting from a law enforcement agency’s don’t-ask-don’t-tell immigration policy, an illegal alien with an extensive criminal record killed a woman after being arrested and released by several different police departments.

    Not surprisingly, the tragic and avoidable crime occurred in a state—Wisconsin—that has long provided illegal immigrants with sanctuary. At least four local law enforcement agencies had contact with the illegal immigrant (Jorge Dominguez) before he murdered a young mother in Kenosha County while driving drunk on Memorial Day.

    Dominguez had been arrested for serious crimes such as battery, possession of drugs and obstructing an officer and he served time in the Racine County jail. When he completed his sentence last summer he was extradited to Cook County where he had a felony warrant for possession of a controlled substance. Federal authorities claim that they issued an immigration hold on Dominguez nearly a year ago so that he could be deported after serving his sentence.

    Instead, the illegal alien was released by the various law enforcement agencies he encountered throughout his crime spree. An official with Immigration and Customs Enforcement (ICE) assures that the federal immigration hold had been issued when Dominguez was in custody in both Racine and Cook counties. Both agencies claim they had no record of an immigration detainer when Dominguez was released from jail.

    Police in two other jurisdictions—Burlington and Rock County—also had contact with Dominguez before the deadly crash but none evidently bothered to check his immigration status. This allowed the illegal immigrant to continue victimizing innocent Americans. Legally drunk, he crashed into a family’s car on a local highway around 10:30 p.m. on Memorial Day. In the passenger’s seat, the mother was killed and the father, who was driving, was injured as well as the couple’s teenage son.

    The local law enforcement agencies involved in the case all conveniently claim that they had no record of the immigration detainer. Not that most of them bother asking about a suspect’s immigration status anyways. Municipalities throughout Wisconsin have long protected illegal aliens and most police departments forbid officers from touching the immigration issue.

    Just last week Madison, Wisconsin’s capital city, passed an ordinance guaranteeing that it won’t enact laws to help curb immigration. Lawmakers said they unanimously approved the resolution because minorities in the area feel that Arizona’s new law will cause backlash all the way in the Badger State. That measure makes it a state crime to be in the U.S. without proper documentation, bans “sanctuary cityâ€

    When a Kenosha County woman was killed on Memorial Day one thing was clear, it was completely preventable. AS FOX6 began investigating to find out who could have prevented it, we faced a flurry of finger pointing. No one wanted to take responsibility, and no one close to the case would talk on camera.

    If you could sketch a love story and put a face on it, a portrait of teenage sweethearts would appear. It was a love so deep, fulfilling, and complete that losing it would be like losing the air from young lungs.

    One man who never should have been where he was could destroy the soul of a family. Jorge Dominguez is an illegal immigrant with an arrest record, and no license to drive. Police caught him two hours after the crash that killed Dawn Glogovsky. Dominguez fled from the scene of the accident.

    If you think this is about the injustice of an illegal immigrant killing an innocent woman, it's worse than that. In 2008 Dominguez' wife called Burlington Police afraid he was going to kill her. FOX6 Anchor Brad Hicks asked her what she told police that night she said, "He was illegal that he was illegally in the United States."

    The Burlington Police Department notified Immigration and Customs Enforcement(ICE), but Dominguez didn't show up in the federal database. So a few days after the incident Dominguez was back on the streets.

    It didn't take long for him to be back in a cell at the Burlington Police Station. Over the next six months he was cited, arrested, questioned, fingerprinted. He became a familiar face to law enforcement, but ICE and police never put two and two together.

    Kim Gebauer, sister of Dawn Glogovsky, said, "There were so many opportunities to remove this person from the county, to make sure he didn't continue to create havoc wherever he went."

    Jorge Dominguez was arrested again in Racine County in May of 2009, and that time ICE slapped an immigration detainer on him. He was finally caught and his days in the US were numbered, but something that ultimately led to the death of Dawn Glogovsky happened.

    Cook County in Illinois staked a claim on Dominguez. They wanted to see him extradited for an old drug charge before he was deported. On July 4th the Racine County Jail sent a communication to Cook County advising them Jorge Dominguez was illegal, and had an immigration hold from ICE.

    Former Waukesha District Attorney Paul Bucher knows how the system works. He said, "They're telling them, place a hold on this subject when you pick him up from our jail. ICE wants him."

    Three days later an internal memo says Cook County called, aware Dominguez was on a detainer, and requested it. A faxed copy confirmed on July 7th the detainer was sent to the Cook County Sheriff's 24-hour lockup in Maywood. Their job was to notify ICE before he could be released.

    Two days later Jorge Dominguez walked out of the Cook County lock up a free man, ICE was never informed.

    According to ICE, and the State Attorney's Office in Illinois the Sheriff's Department in Cook County is responsible. Bucher says, "He's in the system, and they're part of the system. Therefore they're responsible to notify."

    The Cook County Sheriff's Department claims it never received a detainer for Dominguez, and never requested one either.

    The Sheriff's Spokesman says, "There was no detainer here...so there is nothing to investigate."

    What they can't or won't explain, aside form the Racine teletype notifying them Dominguez was illegal, the internal memo at ICE that says Cook County called for the detainer, and the copy of the faxed detainer itself, is that in the Cook County court file for Jorge Dominguez is the immigration detain the Sheriff's Department swears never existed.

    The day after it was sent to the Sheriff's 24 hour lockup in Maywood where Dominguez was being held, the detainer was still in Cook County. It was faxed again by the courthouse warrant clerk. Dawn's Husband Frank Glogovsky says, "They knew he was an illegal alien, and they didn't do anything. And I know if they would have, she would still be here."

    Glogovsky's Attorney Jim Gatske believes it was no mistake, and that reckless indifference was to blame. He says, "They had made a decision at some point that immigration issues were not something they were going to be worried about enforcing."

    Cook was the first county in the country to declare itself an official sanctuary, a place where police are not allowed to ask about a person's immigration status.

    In 2008 the Cook County Sheriff's Spokesman, the same spokesman who insists there is nothing to investigate, was quoted in a Chicago news website saying "We do not work with immigration."

    He also claims the Sheriff's Department has "not had any issues with any prior detainer cases."

    An internal ICE e-mail disputes that. It says, "This is not the first time this has happened at Cook...We have subjects that get transferred to Cook County and the detainers get lost."

    When pressed for answers about this the spokesman tried to deflect my questions with a personal attack. He said, "I thought you'd said you were a reporter, but I see you say you find some things hard to believe."

    FOX6 tried to catch up with the spokesman in person, but his office said he was going to be unavailable.

    On July 9, 2009 while Dawn and Frank Glogovsky were getting ready for their son's weekend swim meet, Jorge Dominguez was set free from the Cook County lockup.

    At that moment the clock began counting down the final days of Dawn Glogovsky's life to the moment when two paths crossed in a split second.

    Dominguez is now in the Kenosha County jail, and once again ICE has an immigration detainer on him. His trial is set for March of next year. He faces nine felonies, homicide by intoxicated use of a vehicle, and fatal hit and run.
