    From the article the child is in the care of state of Alaska authorities, because the mother was returned to Taiwan. Why wasn't the child returned to Taiwan with his/her mother? The US government is committing kidnapping and then sending state and US taxpayers the bill for it. Everyone participating in this is a moron and a felony criminal. Now get that kid out of here and back to Taiwan.

    A child has a natural inalienable right to be with its mother, wherever she is. A "legal" right is of course something altogether different than that. There was no legal custody case involved here, only kidnapping by the US government and state of Alaska authorities of a newborn, an act that any medical health professional will testify is not in the child's best interest, an act that doesn't comply with US or international law on any level, is probably propagating serial killers, and sticking US taxpayers with the tsb for it.

    Every person involved in this grand insanity needs to be locked up for the maximum term of kidnapping.

    Now get these kids out of here and back to their home countries where they belong, and that country is where their mothers are from.

    As to what "parent" has "legal custody" is not an issue for the United States, it's an issue of the parents in their home countries.

    Baby Born on L.A. Bound China Airlines Flight Eligible For US Citizenship – Mother Deported!

    A woman who gave birth to a baby girl on a China Airlines flight bound for Los Angeles from Taiwan’s capital Taipei has been deported back to Taiwan while the child remains with family friends in the U.S. for the time being.



    The woman allegedly flouted regulations by not making her pregnancy known to the airline including not obtaining a ‘Fit to Fly’ certificate. The flight was diverted to Anchorage, Alaska where the lady and her daughter were given medical assistance.Children born on board aircraft are a rare event though it happens from time to time. The circumstances of this extraordinary delivery however lead one to assume that the women deliberately planned to carry her unborn child to the U.S. for delivery for citizenship purposes. Apart from the legalities of such action it is also highly risky as this case outlines.


    Thankfully both mother and child are doing well health wise, even though the woman has in the meanwhile been deported back to Taiwan after receiving medical assistance. The child, who will be eligible for a Alaska birth certificate and U.S. citizenship in the meanwhile remains in the U.S. with family friends.

    A baby, delivered mid-flight from Taiwan to Los Angeles, has been confirmed by the state government in Alaska to be eligible for a state birth certificate, Taiwan’s Civil Aeronautics Administration (CAA, 民航局) said yesterday.

    In the U.S., citizenship is automatically granted to those born within or subject to its jurisdiction.


    The mother, however, was denied access to the United States. The CAA said that after an investigation, the mother did not breach Taiwan’s immigration and deportation regulations or criminal law and that they have yet to receive an explanation from the U.S. for barring the mother from entering the country, the CAA stated.


    The newborn is currently under the care of family friends in the U.S. The mother returned to Taiwan on late Saturday, accompanied by airport police and officials from the National Immigration Agency.

    Either there is some translation error or I fail to see why Taiwan Immigration regulations and criminal laws would prevent their citizens from being deported from another country if they are found in violation there.

    According to Alaska Dispatch News, Sarana Schell, spokesperson for the state’s Department of Health and Social Services (DHSS), said in an email Thursday afternoon that under state statutes on birth registration, the child is eligible for an Alaska birth certificate, regardless of the state’s 12-mile territorial limit.

    “(A) child born in international airspace and then brought into (Alaska) will have her or his birth registered here,” Schell said. “It doesn’t hinge on how far out the child was born, it hinges on him or her getting out of a moving conveyance here.”


    Schell stated that the only remaining procedure for the child to become an American citizen is for the parents to file an application, which costs US$30 (NT$960).

    This story has been all over the internet and people began discussing if or if not the child would be eligible for U.S. citizenship. Turns out all the smart people who said ‘No’ weren’t so smart after all as above quoted statement shows.

    Receiving the citizenship is now simply a formality.


    A video on YouTube shows the crew holding the little girl after the delivery on the floor of the main cabin. The crew first moved the woman into Business Class but it was impossible for the doctor on board, a UCLA physician, to perform any treatment let alone a child delivery there.


    After the dust settled, the joy quickly gave way to accusations the mother inquired during the delivery if they were ‘in U.S. airspace yet’.

    A former China Airlines Flight Attendant who witnessed the scene vented on her Facebook page as Shanghaiist reported (see here).

    A former flight attendant with China Airlines said she was coming forth with the information because she was infuriated with how her former employer had exploited the incident to create a heartwarming story for the media.

    In a post on her Facebook page which has been shared more than 20,000 times since Saturday, Lucienne Chen says the woman in question failed to inform the airline upon purchase of the ticket, as well as ground staff upon check-in at the airport, that she was pregnant.

    Before take-off, flight attendants had already noticed that there was a pregnant woman on board, Chen wrote, but she wrote off their concerns by saying that she was “just feeling a little bloated”.


    When the woman’s water bag broke mid-flight and she started going into labor, she was advised by flight attendants to lie down and prepare for delivery. The woman, however, insisted she would deliver later, and kept asking, “Are we in US air space yet?”

    While the actions of the passenger (especially if they have been deliberate) were irresponsible this whole vent comes across as a bigmouth ex-flight attendant claiming to be some sort of an expert. Where would she get verified information such as this what happened prior to the flight etc. For what it’s worth she is nothing but a regular passenger who maybe knew some crew members. Anyway…

    The woman, surnamed Jian, has since been deported by US immigration authorities. Upon her arrival back in Taiwan, she was ambushed by the media. Covering her face with a jacket, she refused to answer their questions.

    She has been separated from her newborn child, now under the care of state authorities in Alaska.

    It would be interesting to receive an official statement from U.S. authorities regarding the basis of this deportation and the withholding of the child. I’m not familiar with Taiwanese law regarding citizenship but common practice is that the child is also eligible for citizenship of the parents. Maybe it’s just an administrative matter until a Taiwanese passport is applied for and produced.


    Conclusion

    Separating mother and child even under these circumstances appears to be a knee jerk reaction by U.S. authorities and is totally uncalled for. As long as the mother can pay for her medical expenses and remainder of her stay they should sort out this matter and then return to Taiwan. There is no Taiwanese ‘Consulate’ (or ‘Taipei Economic and Cultural Representative Office’ as its called since the U.S. has limited recognition of Taiwan) in Anchorage. The closest one is in San Francisco or Vancouver, Canada.

    I guess the bottom line is that it would be best to avoid situations like this as a parent, considering the well being of yourself and the child. Though when people are desperate somethings desperate measures are taken. On a side note:

    Flight attendant helps deliver a baby when a woman goes into labour mid flight.


    A Taiwanese woman who gave birth during a recent flight has been separated from her newborn child after she was deported from the United States.

    The mother in question went into labour during a China Airlines flight bound for Los Angeles, with the plane forced to make an emergency landing in Alaska when her water broke six hours into the long-haul flight.


    Cabin crew and a doctor, who happened to be on on board, delivered the baby girl who at the time was thought to have been around eight weeks premature, but officials are now questioning the facts of the real due-date of the child.


    According to reports in The StraitsTimes, the woman, referred to as Jian, was actually 36 weeks pregnant.


    She is also reported to have refused to deliver the baby until the plane entered US airspace.


    The story had originally been reported as a feel-good tale, but it has since taken a sinister twist.


    Lucienne Chen, a former flight attendant with the carrier, took to social media to provide her account of the incident, with information provided from cabin crew who were on board.


    In a lengthy Facebook post, Chen claimed the woman had failed to inform staff that she was 36 weeks pregnant - 4 weeks over the 32 weeks that Taiwan aviation regulations deem as safe to fly. Those who are over 32 weeks are required to issue a doctors note.


    Chen also claims that when the woman was told to prepare for delivery of the baby, she tried to hold off giving birth while repeatedly asking "are we in US Airspace yet?"


    When the diverted plane landed in Alaska, both mother and child were taken to a local hospital.

    The baby is now under the care of state authorities in Alaska while the mother was deported back to Taiwan.


    Amira Rajput, a passenger on the flight told ABC News that US Customs and Border Protection agents boarded the plane after it landed in and requested to see Jian's passport.


    "He told me that this is something foreign women do, to try and deliver overseas for citizenship," Rajput said. "This is a political issue. People die to come to this country."


    If this is found to be the case, Jian could also be liable to foot the bill for the diversion of the flight.


    According to reports the diversion cost millions of New Taiwan dollars, and affected 200 passengers.


    Questions have also been raised as to how China Airways allowed the pregnant woman to board the plane in the first place.

    TAIPEI, Taiwan - The mother of a child delivered last week on a US-bound China Airlines (CAL) flight will likely be liable for the costs of diverting the flight, Transportation Minister Chen Jian-yu said yesterday

    At an interpellation session at the Legislative Yuan, Chen said that the mother, surnamed Jian, would likely have to pay for the costs of disrupting the flight schedule caused by her going into labour.


    "Compensation (to CAL) will likely be inevitable," said Chen.


    The mother's insurance company is currently calculating the costs of her childbirth, said the airline.


    CAL stated that if pregnant passengers fail to provide proper medical clearance, deceive the company's staff and thereby cause the flight to be diverted, insurance companies are required to pay compensation for passengers found liable.


    According to global airline flight insurance rules, coverage includes the additional cost of emergency landings due to passengers' health issues, said CAL.


    Mother Must Pay the Price: Lawmakers


    Diverting to an airport in Anchorage, Alaska cost the airline millions of (New Taiwan) dollars and affected 200 passengers, Kuomintang Legislator Lo Shu-lei claimed.


    Lo raised questions over CAL's responsibility, questioning why it even allowed her to board the plane in the first place.


    According to Lo, the government is CAL's largest shareholder and the Ministry of Transportation and Communication (MOTC) should demand that the airline collect compensation from the woman.


    Both the MOTC and the airline need to ensure nothing like this happens again, said Lo.


    Democratic Progressive Party Legislator Yeh Yi-jin warned of wider repercussions, such as problems that might arise if more pregnant women follow suit. Yeh criticised CAL for earlier framing the event as a heart-warming story.


    Chen said in response that security measures need to be stepped up and he would not encourage such behaviour.


    At present, there are no restrictions in place to prevent similar scenarios, but if similar cases appear in the future, passengers should be liable for the additional costs, Chen said.


    Chen stated that according to international regulations, up until the 33rd week of pregnancy, pregnant passengers do not need airline approval before boarding flights. If flying between the 32nd and 36th week of pregnancy, special medical clearance is required, as well as permission from the airline. For those over 36 weeks pregnant, airlines have the right to refuse travel.


    Before boarding an overseas flight on Oct. 7, Jian lied about how long she had been pregnant to airline staff, according to CAL's statement yesterday. Jian delivered her baby on the flight, and the plane diverted to Anchorage to bring the mother and child to a hospital, before the plane continued its journey to Los Angeles.


    Controversy heated up after a former flight attendant, surnamed Chen, reportedly claimed Jian repeatedly asked, "Have we reached American airspace yet?" while in labour.

    The behavior of our immigration officials becomes more stunningly stupid with every article that's posted about them. This child was not born in the United States, this child was born on a China Airline while in flight, which is under the jurisdiction of China, not the United States.

    Schell can give them a birth certificate but that doesn't make them a US citizen unless they forge the certificate. The child was not born either in the United States nor under US jurisdiction. Alaska only has the authority to issue a falsified birth certificate. Alaska does not grant US citizenship. Therefore because the child is not a US citizen, except under the imagination of liars and incompetents, this whole story is nothing but a sensationalized ruse.

    The heartwarming story of a woman who gave birth on a flight has since soured after she was deported back to Taiwan without her child and warned she could face a fine of more than £20,000.

    Earlier this month amazing footage emerged of the mother, known only by her surname Jian, giving birth to a 'premature' child at 30,000ft, six hours into a 19 hour journey from Bali to Los Angeles on a China Airline flight.


    Jian claimed upon boarding to be 32 weeks pregnant, the latest date expectant mothers are still free to fly without a fit-to-travel certificate from a doctor under Taiwanese aviation regulations. But she reportedly gave birth at 36 weeks.

    A doctor who was on the flight assisted the mother and delivered the child thirty minutes before landing

    According to China.com.cn, the mother refused to lay flat to give birth and kept asking 'are we in America yet?'
    Eventually she gave birth above Alaska 30 minutes before the airplane conducted an emergency landing into the state's Anchorage Airport.

    The mother was separated from her newborn daughter on Saturday - after the 13-day old child was awarded U.S. citizenship, the news site claims.

    The child remains in Alaska with a family friend as she is too young to fly.


    According to Zoftr, Taiwan’s Transportation Minister Chen Jian-yu has said that the mother will likely be liable for the costs of diverting that flight to Alaska for her medical treatment if she is found to have purposely attempted to give birth to the child in the U.S.


    The diversion cost the airline millions of Taiwanese dollars (more than £20,000) and affected the other 200 passengers on board.
