    LAS VEGAS -- Two sons of Nevada cattleman Cliven Bundy refused to attend, and several co-defendants shouted an oath of defiance at the end of a Friday court appearance for 17 men accused of conspiring and taking up arms against federal agents near the Bundy ranch in Nevada in April 2014.

    U.S. Magistrate Judge Peggy Leen decided not to order marshals to bring Ammon and Ryan Bundy to court by force, so the two Bundy sons remained in a nearby holding cell. Marshals were instructed to provide a speaker so they could hear audio of the court proceedings.

    Another defendant, Peter Santilli, blurted out that the Bundy brothers didn’t want to be shackled. Leen admonished Santilli that he didn’t get to speak on their behalf.

    So began a contentious three-hour hearing during which the judge didn’t make immediate rulings on a range of arguments, including the government’s request to have three trials and defendants’ requests to be tried together or in groups of their choosing.

    Trial is scheduled to begin Feb. 6. Leen called it “physically and logistically impossible” to try all 17 defendants together, and suggested it would be unfair for a 17th defendant to have to wait months or years to resolve his case if they were tried individually. She said she’ll issue a written scheduling order soon.

    Leen also is considering multiple requests to dismiss charges; a plea for a change of venue to Reno or another city; a suggestion that federal officials shredded documents that would be relevant to the case as they packed up and left temporary offices near Bunkerville; and Cliven Bundy’s lawyer’s insistence that the federal government has no jurisdiction in Clark County.

    Santilli’s attorney argued that he’s a journalist, and that his calls in Internet postings for supporters to rally to the Bundy ranch to lawfully carry guns and protest federal Bureau of Land Management action were constitutionally protected free speech.

    At least two defendants, Ryan Payne and Scott Engel, stood the moment court was adjourned and loudly declared, “Resistance to tyranny is obedience to God!”

    Santilli chimed in that he expected that when Donald Trump becomes president, he’ll intervene in the case on the defendants’ behalf.

    Several people among about three dozen family members and friends responded with words of love and support as they filed out of the courtroom gallery under watchful eyes of U.S. marshals.

    The protest-by-absence of Ammon and Ryan Bundy echoed the refusal by their father last March to enter a plea to federal charges that he led the tense armed standoff that stopped a government round-up of cattle on public land about 80 miles northeast of Las Vegas. A magistrate judge entered a not-guilty plea for him.

    No shots were fired, and no one was injured in the standoff. But images of Bundy backers with assault rifles on a freeway overpass forcing federal agents to back off in a dry river bed below have become iconic in an ongoing battle about states’ rights and federal authority.

    That dispute has roots a nearly half-century fight over grazing rights in Nevada and the West, where the federal government controls vast expanses of land. Calls for action have grown louder and more frequent in the Internet age, with bloggers protesting federal agency decisions to designate protected areas for endangered species and set aside tracts for mining, wind farms and natural gas exploration.

    The Bundy case defendants face conspiracy, obstruction, weapon, threat and assault on a federal officer charges that could get them decades in prison if they’re convicted. They and two others who have pleaded guilty in the case remain in federal custody in southern Nevada.

    Federal prosecutors want three trials, with the first to start Feb. 6 for accused conspiracy leaders Cliven, Ammon and Ryan Bundy, Payne and Santilli.

    A second trial would start in May for six alleged “mid-level” standoff leaders and organizers: Bundy sons Dave and Mel Bundy, Brian Cavalier, Micah McGuire, Joseph O’Shaughnessy and Jason Woods.

    A third trial would begin in August for six accused “followers and gunmen.” They are Gregory Burleson, O. Scott Drexler, Todd Engel, Ricky Lovelien, Eric Parker and Steven Stewart.

    Woods’ lawyer, Kristine Kuzemka, protested Friday that labeling defendants as “gunmen” is unfair because it suggests guilt or culpability.

    Leen said a description used for now, during pretrial proceedings, might never be suggested to a jury.

    Burleson’s attorney, Terrence Jackson, asked again for the judge to consider releasing his client before trial for medical reasons.

    Jackson said Burleson, 53, of Arizona, is blind, diabetic and uses a wheelchair.

    Burleson told Leen he isn’t getting medical treatment in federal custody.

    “I don’t want to end up dying in here,” he said.

    Obama designates monument near Bundy ranch in Nevada

    After years of publicly opposing federal land management policy, Cliven Bundy will now be able to see a 300,000 acre national monument from his ranch in Nevada.

    On Wednesday, Obama designated two national monuments. The Bears Ears National Monument covers 1.35 million acres in Utah. The second is Gold Butte National Monument; 300,000 acres near Las Vegas, Nevada.


    The Department of the Interior said both monuments contain sacred Native American land, important cultural sites and fragile wildlife habitat. Grazing permits and leases will still be issued for the land.


    Bundy has allegedly allowed his cattle to graze on the Gold Butte land without paying grazing fees. In 2014, he led a standoff against U.S. agents. According to the Las Vegas Review Journal, Bundy has claimed ancestral rights to the Gold Butte land.


    After the Gold Butte designation, the Bundy Ranch posted a statement opposing the move on its website.


    "We, the Bundy Family, would like to say to President Obama that we are saddened, but not surprised, by your decision to make our ranch and home a national monument. If any of this were really about protecting the land, you would come here, work with the local people who love this land, those who have a vested interest in this land, and take the time to learn what this land really needs,” the statement read.


    Two of Bundy’s sons, Ammon and Ryan, led a standoff in Oregon at the Malheur National Wildlife Refuge that lasted for more than a month in early 2016. The brothers were acquitted on federal charges in that standoff but still face charges in the Nevada case.


    Some environmental groups and businesses have advocated for a national monument in Eastern Oregon, near where the occupation took place. The proposed Owyhee Canyonlands national monument covers more than 2 million acres in Eastern Oregon and includes land ranchers currently use to graze cattle.


    Many local ranchers oppose the Owyhee Canyonlands monument.


    Proponents of the Oregon monument say ranchers would still be able to graze cattle on the land.


    Obama has now designated more than two dozen monuments since taking office, more than any president in history. He can continue to designate monuments until he leaves office on Jan. 20.

    Senator Reid’s fingers are in virtually every solar and wind project in the Nevada desert. Green energy is his obsession. Green energy is his baby. His vision is turning the Nevada desert into the “Green Energy Capital of America.”
    Who benefits from that vision? Democratic donors who run green energy companies. Who stands in the way of that vision- Nevada’s ranchers, farmers and property owners- almost all of whom are diehard Tea Party conservatives and patriots who despise Reid.
    Reid and the BLM needed a “cover story” to take the land away from the ranchers. So they claim it’s about protecting the “endangered” desert tortoise.

    Heller warns Obama against Gold Butte action


    Heller told Obama he should think twice if he was thinking of taking action on Gold Butte, where the Bureau of Land Management engaged in a testy standoff in April with Cliven Bundy and the controversial rancher’s armed supporters over cattle rights.

    Heller did not mention Bundy by name, but he told the president any move to assert more federal authority “would not serve the area well.” He said it would escalate anger and frustration “in a region of our state where tensions are already presently high.”

    There already is “significant opposition” to bills before Congress that seek to upgrade conservation in the area, Heller added.
    There has been heightened sensitivity among Western conservatives since Obama on May 21 designated 500,000 acres in the Organ Mountain-Desert Peaks region of southern New Mexico as a national monument that would allow it to be managed more like a national park. They have bristled at what they regard as federal “land grabs” exercised by the president without approval by Congress, and seek to head off further designations.

    Activist sentenced to prison time over Nevada land standoff

    LAS VEGAS (Reuters) - A conservative activist was sentenced to more than seven years in prison on Wednesday for his role in an armed standoff with federal agents in Nevada in 2014 over the use of government land by ranchers and grazing fees.

    Gerald DeLemus was sentenced in Las Vegas district court to 87 months in prison after pleading guilty last August to participating in a criminal conspiracy when he traveled from New Hampshire to join hundreds of armed protesters in Nevada supporting rancher Cliven Bundy.


    Bundy was in a dispute at the time with the federal government after federal agents seized cattle at his ranch over unpaid grazing fees. The standoff became a flashpoint for federal public lands issues in the West.


    Bundy and his supporters oppose the U.S. government's control over millions of acres of public land in the West. He and multiple co-defendants still face charges stemming from their roles in the Nevada standoff.


    DeLemus had asked in November to withdraw his guilty plea. He did so after Ammon Bundy, one of the leaders of the Nevada standoff, was acquitted along with six others for their roles in the armed takeover of the Malheur National Wildlife Refuge in Oregon earlier in 2016.


    DeLemus, 62, a former U.S. Marine from Rochester, New Hampshire, was named a co-chair of a state veterans group backing then-Republican presidential candidate Donald Trump.


    REQUEST DENIED
    Ruling that DeLemus had failed to display sufficient remorse for his actions, District Judge Gloria Navarro denied his request to withdraw his plea and increased DeLemus' culpability under federal sentencing guidelines, adding up to 16 months to his sentence.

    He has already spent 16 months in jail awaiting sentencing.


    DeLemus is being held in Southern Nevada Detention Center and he has asked that he serve his sentence in a federal facility close to his home in either Massachusetts or New Hampshire. There is no parole in the federal system for inmates sentenced after 1987. DeLemus was also sentenced to three years of supervised release.


    In court on Wednesday, DeLemus tearfully recounted his reasons for arming himself and heading to Nevada, saying that Cliven Bundy had told him that the Bureau of Land Management had snipers focused on his family ranch and he wanted to protect the Bundy children and grandchildren.


    "I just didn’t want that family hurt," he said, adding, "I love this country. I’ve done everything in my power to serve it militarily and privately."


    DeLemus helped provide security at "Camp Liberty," a space near the Bundy ranch that was set aside for members and associates of the militia groups who rallied to join the Bundy cause, according to court records.


    The court heard at the sentencing proceeding that although DeLemus contended that his intention was to provide protection for the Bundy family, he also stated in an interview with an agent for the Federal Bureau of Investigation that "We will stand and we will fight and we will die" if necessary.


    The other 17 defendants facing charges connected to the Nevada standoff were split into three groups late last year. The trial for the group including Cliven Bundy and two of his sons is expected to begin in late September. The last group of defendants will be tried subsequently.
