    City Releases Video of Officer Killing a Handcuffed Prisoner

    Being a police officer is no easy task. At any moment you could be called upon to make decisions that could change lives forever, and you must make the right one or live with the consequences. Which is why anyone seeking to become a police officer should think long and hard about the job they are committing to.
    Last year an El Paso police officer shot and killed a prisoner who was handcuffed and sitting on the floor outside the local jail. A Grand Jury hearing and a police inquiry both cleared the officer, but many others believe that the video of the incident should have been proof positive that the officer acted wrongly.
    However, the Grand Jury (who also saw the video) believed that the circumstances of the entire day led up to the shooting and that the officer acted in the only way he felt he could.
    Still, the video is hard to stomach.

    Saenz, 37, had been arrested that day on assault charges after allegedly attacking an off-duty police officer and staff at Del Sol Medical Center, where he had been taken after he was found exhibiting bizarre behavior at an Alberstons supermarket on Yarbrough Drive.
    The jail video released Monday starts with Saenz shirtless, handcuffed behind his back and sliding sitting on the floor as he is dragged by Flores and an unnamed prisoner transport guard.

    Police officials had said that Saenz was being taken from the jail to a hospital. Jail staff had refused to accept Saenz because when he was being walked into the jail he "struck his own head into the doorway causing himself injury," according to a previously released Custodial Death Report. In the video, there appears to be blood on Saenz's face.

    Once Saenz is dragged outside, the officer and guard appear to talk to him as he sits on the sidewalk outside the jail's back entrance.
    The scene was filmed by cameras at different angles. There is no one else seen outside.
    In the video, Saenz begins to struggle with the officers after they stand him up. Saenz falls to the ground but keeps trying to get up with the two men on top of him.

    Saenz kicks, tries turning around and twists, grabbing at Flores who is behind him.

    Saenz, according to CLEAT, was also trying to slam his head on the ground and the guard was trying to stop him.

    In the video, the guard is attempting to hold Saenz by the shoulders when Flores gets up. At first, Flores appears to reach for the Taser in his left holster.

    When Saenz pushes off the guard, Flores draws his Glock semi-automatic handgun from his right holster. The guard moves away and Flores fires a single gunshot.

    Flores then holsters his gun, pulls his yellow Taser and gets atop of Saenz, who is face down, bleeding from a shoulder and continues to kick for a few seconds until he stops moving as blood spreads on the ground.
    Saenz is eventually turned over. Flores begins CPR before the arrival of paramedics and an ambulance that takes Saenz to a hospital.

    Saenz died at the hospital. An autopsy found that the bullet traveled from Saenz's shoulder and into his chest.
    Again, while the video seems damning in and of itself, Mr. Saenz had earlier in the day brushed off five other attempts to stun him with a stun gun and had also shown that he could “front” his handcuffs quickly. The officer feared that with Mr. Saenz’s strength he wouldn’t stand a chance in a hand to hand confrontation.

    Whether or not the officer acted properly – this is simply more evidence that becoming a police officer should not be a decision entered into lightly.

    In early 2014, a grand jury elected not to charge an El Paso, TX police officer in the shooting death of a prisoner, but newly released video is causing some to question if that is a good idea.


    After the Texas AG instructed the city of El Paso to fulfill the El Paso Times’ request for the video it has become apparent that this is not a “typical” accidental shooting.


    Mediaite reports that,
    On March 8, 2013, Officer Jose Flores shot and killed Daniel Rodrigo Saenz, who was in police custody after erratic behavior at a supermarket led him to be taken to a nearby medical center, where he is alleged to have assaulted an off-duty police officer and the facility’s staff. Upon being arrested, Saenz continued to lash out physically against officers, and, according to reports, struck his own head against a door with the apparent intent to injure himself.


    In the video, we can see that Saenz is obviously disturbed and is certainly struggling, but officer Flores’ solution is barbaric, at minimum. At one point during the struggle, Flores is thrown off of Saenz. Instead of simply tacking the handcuffed man, the officer reached for his gun, drew it, and fired a bullet into his prisoner’s shoulder, killing him in what can not be better described than as an execution.

    Federal Marshals Seize Florida Police Cellphone Tracking Records


    Federal marshals recently seized a local police agency’s records on cell phone surveillance to keep it from public disclosure, demonstrating the importance of prohibiting dragnet surveillance at the state level.

    Sarasota, Fla. police were apparently secretly tracking individuals’ cell phones without a warrant using a device called a Stingray, according to the ACLU.

    “Stingrays track phones by mimicking service providers’ cell towers and sending out powerful signals that trick nearby phones — including phones of countless bystanders — into sending their locations and identifying information.”

    Earlier this year, the police signed a non-disclosure agreement with the company that makes the Stingrays. In an effort to reveal secret tracking of individuals the American Civil Liberties Union (ACLU) filed motion after motion to obtain records.

    “But regardless, once the Sarasota Police Department received our records request, state law required them to hold onto the records for at least 30 days, to give us an opportunity to go to court and seek an order for release of the documents.”

    That never happened. Instead, US Marshals stepped in, raided the police department, and seized all the records pertaining to the cellphone tracking technology. The US Marshals didn’t seize the documents to expose corruption. Instead, the US Marshals seized the documents so these records never see the light of day.

    Dragnet surveillance does not happen just at the federal level. Local and state resources are being used to track lawful individuals without a search warrant on a mass scale. This intelligence is then being shared between multiple government agencies and jurisdictions.

    To stop dragnet surveillance, stop it at the local level first. Simply put, if the state is prohibited from collecting the data, there’s nothing for the feds to seize.

    There are 3 solutions to stop surveillance locally.

    1. Introduce the following:
    2. 4th Amendment Protection Act.
      • Bans state from taking actions which provide “material support” or assistance to warrantless federal spying programs.

    3. Electronic Data Privacy Act.
      • Bans the use of warrantless data in court.

    4. Freedom From Location Surveillance Act.

      • Bans state and local law enforcement from obtaining the location information of a person’s electronic device without a warrant.

    Two Massachusetts cops forcibly entered a home, slapping a woman and trying to swipe a camera out of a man’s hands in a chaotic incident in which the man ended up dialing 911.

    A risky move that could have easily escalated the armed home invasion.

    It is not clear at this moment why the cops were at the home, but they can be heard later in the video saying they were not planning on arresting anybody. But one cop still remained standing in the doorway, his foot planted in the doorway, preventing the woman from closing the door.

    The Free State Project, which came across the video on Facebook today, said they have reached
    out to the Wareham Police Department for answers, only to receive no comment. In the opening of the video, the man, identified by the Free State Project as Richard Phillips, announces to the cops that he is recording to comply with state law, which prompted officer George Chandler to smile and wave.

    But then officer Jon Verhaegen entered and tried to snatch the camera.

    However, as stringent as the Massachusetts wiretapping law is in not allowing citizens to secretly
    records cops, even if they have no expectation of privacy, the Glik vs Boston decision stated that one only has to make the camera visible.

    Never would anyone think they would have to call the police on the police, but that’s exactly what happened to one family when they found themselves being terrorized by local authorities.
    A shocking video has surfaced, showing two Massachusetts officers, George Chandler and Jon Verhaegen, forcing their way into a home and assaulting a woman.

    The woman seems to be pointing something out to the officers, when one reached out towards her, allegedly slapping her in the face. Chaos immediately ensues, with the man holding the camera, Richard Phillips, threatening to call 911.

    As the woman tries to close the door, one of the officers remains standing in the doorway with his foot preventing her from closing the door.
    It’s still unclear why the officers arrived at the residence but they can be heard later in the recording saying that they were not planning on arresting anyone.

    Officer Varhaegen is seen entering the home in an attempt to snatch the camera.

    A representative with the Jefferson County Sheriff’s Department boldly confirmed that every vehicle would be searched, regardless of probable cause, before being allowed to vacate the area.

    “You forgot (conveniently) to include the word ‘illegally’ between ‘being’ & ‘searched,’” one Twitter user said in response.

    Such scenes, where law enforcement disregard constitutional rights through mandatory dragnets, have begun appearing across the country at an alarming rate.

    Following a bank robbery in Maryland last March, police shut down an entire Interstate in both directions to search countless vehicles at gunpoint.

    Last year after several officers were injured in a gang-related shooting in California, a police checkpoint resulted in numerous innocent drivers having a rifle put to their head.

    During the Boston bombings manhunt, the entire town of Watertown was literally placed under martial law as militarized police forced residents out of their homes at gunpoint without warrants.

    Police Humiliate Woman After Misdemeanor Arrest: Pepper Sprayed, Stripped Naked Overnight and Stranded

    Stripped naked, pepper sprayed, and left in a holding cell alone for hours – that’s what an Indiana woman was subjected to after an arrest for misdemeanor offenses.

    Tabitha Gentry was arrested by Indiana State Police on March 30 for disorderly conduct and resisting arrest (two misdemeanors), following an alleged domestic dispute with her estranged husband.

    Gentry was taken to the Floyd County Jail, which is operated by the Floyd County Sheriff’s Department.

    Her attorney, Laura Landenwich, reviewed the jail surveillance video with Gretchen Carlson of FoxNews.



    WDRB covered the story as well, and outlined the details surrounding Gentry’s treatment:

    Almost immediately upon entering the jail, she’s assaulted by four officers. They grab her around the neck, they grab her body,” Landenwich said. The video shows officers then taking Gentry to what’s called the padded room.

    “They hold her down,” Landenwich said. “There are two male officers and two female officers and they forceably remove her pants, her shoes, her underwear and her shirt and bra.

    “Terrified and humiliated, she’s banging on the door asking someone to give her her clothing and someone comes to the door and says, ‘If you don’t shut up, I’m going to pepper spray you,’ and sure enough, they open the door, spray pepper spray into the room and they leave — and they leave her in there for 40 minutes, naked, in a cell filled with pepper spray.”

    Landenwich says Gentry was then handcuffed and taken to wash out her eyes.

    “She has a blanket draped over her shoulders, she’s paraded through the booking area in full view of anyone who happened to be there,” Landenwich said.

    Landenwich said Gentry was put back in the cell and left there for five more hours before she was given a jump suit to wear.

    “Now this is a woman, who under our system of law, is innocent until proven guilty. She’s charged and she’s charged with a misdemeanor crime that’s not a violent crime,” said Landenwich.

    According to a written jail report obtained by the Louisville Courier-Journal, jail officials claim that Gentry was drunk and belligerent, and that she kicked and cursed officers as they questioned her.

    The report also says that Gentry “was being placed in a smock and the females [officers] were going to remove her clothes.”

    But according to Landenwich, the video surveillance that captured the altercation clearly shows “two male deputies and two female deputies” removing her client’s clothing.

    In that report, Sgt. Ryan Rainey wrote that the pepper spray was used to stop Gentry from yelling and agitating other inmates:

    “I made the decision that I had to gain her compliance for the safety of this facility,” wrote in the report, according to the newspaper. He also reportedly described the amount of pepper spray released as a “short burst.”
    Landenwich pointed out that Gentry was not a threat to anyone at the time she was pepper sprayed:

    “Standard protocol in every police case I have ever dealt [with] is that you’re allowed to use [the] force necessary to maintain [an] officer’s safety or
    [the] safety of other people,” she said. “Well, here we have a woman, who is naked, locked in a cell, who cannot possibly pose a threat to anybody.”


    The sheriff’s department does not have a strip search policy, but will remove clothing to check inmates for drugs and other items. Landenwich said that there are rules in place that were ignored, and that Gentry’s constitutional rights were violated.


    “There are lots of rules about how a strip search is conducted, but this was not a strip search,” the attorney said. “They weren’t searching her for anything. This was sexual humiliation.”
    This isn’t the first time a woman has been subjected to such treatment at this particular jail – the allegations are similar to those in the case of Ashley Storms (who happens to be a cousin of Gentry), who was jailed after a misdemeanor arrest last year. Landenwich represented Storms, and her lawsuit was settled for an undisclosed sum.

    Landenwich told The Courier-Journal that the law protects detainees against excessive force, unjustified stripping of one’s clothing and cruel and unusual punishment, such as the pepper spraying and the humiliation of being walked through parts of the jail, partially covered.

    “There is no justifiable law enforcement purpose for treating someone this way,” Landenwich told Wave3. “There is no officer safety issue implicated by her having clothing what this is, is humiliation.”

    The death of 19-year-old, Denzel Curnell, “Jaba,” has captured the attention of the community.


    Over the weekend handmade paper signs were put up and dozens of folks gathered, demanding “Justice for Jaba.


    A note from a girl named Sunshine summed up the general consensus of the community.
    “JaBa was always a good person. He never bothered anyone. One day he was walking in the back of Bayside (Bridgeview’s former name) and he heard a voice that said put your hands behind your back, and he did that, and then the police shot him in the back, and we want justice for JaBa.”
    This would be the 23rd officer involved shooting in the area, this year alone.


    What separates this incident from others is that witnesses all describe the same horrible scene.
    They all claim that Curnell was shot, unarmed, while kneeling down.


    The only comment that the police have issued regarding the case is that the officer involved has been put on administrative leave; standard procedure for such instances.


    WCSC reported Sunday that an email sent to Charleston City Council and other officials nearly two hours after a deadly shooting Friday referred to the incident as a “possible suicide.”


    The manner of death, according to the coroner’s office, was still under investigation. The coroner has not released any details about the location of the gunshot wound.


    Curnell, who graduated high school in 2013 has no criminal history. He was living with his sister because his mother recently died, and he was planning to enlist in the military.


    A twitter storm has emerged demanding #JusticeForJaba as well as an online petition for the same.
