Pertinent particulars peculiar to this suit include:

1. This suit was filed against Mark Kennedy, Chairman of the Alabama Democratic Party, rather than against Mr. Obama or an agency or official of the federal government.
   
   
2. This suit was filed in Jefferson County (Birmingham), Alabama, Circuit Court, rather than in a federal court, where all challenges have been summarily dismissed, possibly because of threats, intimidation, and coercion by the U.S. Dept. of Justice and Attorney General Eric Holder's U.S. Attorneys.
   
   
3. This suit was filed in a court with jurisdiction only in Jefferson Co., Alabama, without federal jurisdiction to order discovery, subpoena evidence, and summon witnesses outside Jefferson Co., except where reciprocal courtesy is given.
   
   
4. This suit was filed by an individual with only a general interest as a voter and a citizen, NOT by a personally injured party, such as competing Democratic Presidential Candidate Cody Robert Judy.

Although 1 and 2 strengthen the case and make it more tenable,
3 makes it vulnerable to dismissal for lack of jurisdiction,
and 4 makes it vulnerable to dismissal for lack of standing.

Three attorneys have filed challenges in the Georgia Office of State Administrative Hearings, challenging Barack Obama’s eligibility to be placed on the State of Georgia Democratic Party Primary ballot:

Attorney Van Irion of the Liberty Legal Foundation on behalf of Plaintiff David Welden;

Attorney J. Mark Hatfield, on behalf of Kevin Richard Powell and Carl Swensson, Republican Party Chairman of Clayton Co., Georgia;

and Attorney Orly Taitz, on behalf of plaintiffs David Farrar, Leah Lax, Cody Judy, Thomas MacLaren, and Laurie Roth.

Judge Michael M. Malihi has consolidated these three challenges into one case.

UPDATE: At the request of attorneys Van Irion and Mark Hatfield to sever their cases from Dr. Taitz's case, Judge Malihi has separated the three challenges into three cases. To be charitable, that is probably in the best interests of their clients, in order to win judgments on their narrow complaints without the risk of being sanctioned because of association with Dr. Taitz, who was already sanctioned $20,000 by U.S. District Judge Clay Land in Columbus, Georgia, two years ago.

The three cases are scheduled consecutively on Jan. 26th, beginning with Van Irion's quick case at 9 am, followed by Mark Hatfield's case, and Dr. Orly Taitz's case last.

In addition to the Liberty Legal Foundation suit in Georgia on behalf of David Welden, LLF has filed two lawsuits against the DNC, in a State of Tennessee court and in the U.S. District Court for the State of Arizona, on behalf of Presidential candidate John A. Dummett, Jr., Leonard Volodarsky, and Creg Maroney.

On 10/25/11 Liberty Legal Foundation joined with Presidential candidate John Albert Dummett Jr. to file two simultaneous lawsuits against the Democratic Party. Both lawsuits request injunctions prohibiting the Party from certifying that Obama is Constitutionally qualified to run for the office of President in the 2012 election. Without such a certification from the Party, Obama will not appear on any ballot in the 2012 general election.

Exhibit 3 is a letter to the editor from Juliana Smoot, containing a picture of the "Obama Made in the U.S.A." coffee mug, which bears pictures of Barack Obama II and the forgery of his alleged State of Hawaii Certificate of Live Birth (long form).

Judge Lee dismissed Albert Hendershot, Jr.’s suit on Monday, Jan. 9, 2012.

On the same day, two nearly identical lawsuits were filed, one in Jefferson County by Harold Sorensen of Luverne, and the other in St. Clair County by Tommy Thompson of Pell City.

Sorensen's suit was assigned at random to Judge Lee, and Sorensen requested that she be recused because she had just dismissed Hendershot's nearly identical suit, and "due to racial bias, lack of judicial discretion as well as lack of knowledge of the U.S. Constitution, Article II, Section 1, Clause 5."

Orly Taitz has an expedited hearing before State of Hawaii Circuit Judge Rhonda Nishimura, seeking the Judge's confirmation and execution of the Reciprocal Subpoena issued by State of Georgia Administrative Court Judge Michael Malihi to State of Hawaii Dept. of Health Director Loretta Fuddy. The hearing will take place at 9:30 AM HST on Friday, Jan. 13, 2012, and it will be televised.

What has changed since July 16, 2009, in U.S. District Judge Clay Land’s courtroom in Columbus, Georgia? He would not allow us to bring so much as a camera-less cellphone into the courtroom, lest we record something, such as the gasp in the courtroom when he announced his verdict – or was it AG Eric Holder’s verdict?

Judge Nishimura allowing a TV camera doesn’t smell right to me. Why would she do that?

As a PSA in the public interest? She is a hostile judge, and I don’t think she would allow the public to watch the trial if there were any possibility of the Reciprocal Subpoena being carried out on the Hawaii DOH.

As a record of an historic event? Maybe, if she makes it an event.

As an announcement to the world that the State of Hawaii refuses to release a record of consuming public interest, even in response to a subpoena? Probably.

As a public telecast of the bout for the ages, Taitz v. Nishimura, where she expects to do a smackdown body slam to end Taitz’s runup to challenge Mr. Obama? Yeah, that sounds about right. Ego only trumps cash if there is no money to be made, and all the spotlights on this event mean that Nishimura can’t possibly take any money for it.

But IMO, she wouldn’t allow it to be televised unless she planned to benefit somehow from the publicity (or the notoriety, like Judge Lance Ito).

After all the crimes Mr. Obama has committed,
from identity theft to perjury to election fraud,
from violating the Logan Act by supporting
Raila Odinga for President of Kenya in 2006,
to false swearing and sedition for his overthrow

not to mention treason for giving aid and comfort
to enemies which are at war with the United States,
he could be sent to prison for such a long time that
this may be his only job!

Atty. Orly Taitz (orly.taitz at gmail dot com) needs an Indonesian-English interpreter for the Jan. 26th hearing before State of Georgia Judge Michael Malihi in Atlanta, Georgia.

She must provide a report to Judge Malihi on the findings and conclusions, based on witness testimony and law, by February 5th.

On Jan. 13, 2012, State of Hawaii Judge Rhonda Nishimura denied State of Georgia Judge Malihi's Reciprocal Subpoena for Barack Obama II's original long form birth certificate, passport records, college registration records and more.

Hawaii Deputy A.G. Jill Nagamine requested (or demanded) sanctions against Atty. Orly Taitz as a vexatious requester. Dr. Taitz has not been sanctioned; Judge Nishimura has not responded to Nagamine's request for sanctions.

§624-27 Subpoena to witness.

Where a commission to take testimony within the State has been issued FROM A COURT WITHOUT THE STATE, or WHERE A NOTICE HAS BEEN GIVEN OR ANY OTHER PROCEEDING HAS BEEN TAKEN FOR THE PURPOSE OF TAKING TESTIMONY WITHIN THE STATE, PURSUANT TO THE LAWS OR PRACTICE OF THE STATE OR JURISDICTION WHEREIN THE DEPOSITION IS TO BE USED for purposes of discovery or as evidence, including the United States if it is a federal proceeding, THE CIRCUIT COURT, in a proper case, on the presentation of a verified petition SHALL ORDER THE ISSUANCE OF A SUBPOENA to any witness, commanding the witness to appear before the commissioner, officer or person named or designated in the commission, notice or other paper, at a time and place specified in the subpoena, to testify in the same manner as is provided by the rules of court relating to depositions for use in [the] State.

If any witness fails to obey the subpoena, or refuses to testify, or to produce a book or paper pursuant to a subpoena or to subscribe the witness’ deposition, the court issuing the subpoena, if it is determined that a contempt has been committed, may prescribe the punishment as in the case of a recalcitrant witness in a circuit court in the State, and may make such additional or other orders as would be proper if the deposition were for use in the State. That should take care of the subpoena, but you still have the problem with HRS 338-18(b)

I say subpoena the “Registrant” also, under HRS 338-18(b)1., as they have a “direct and tangible interest”.

Additionally, under 338-18 (b)
(9) “A person whose right to inspect or obtain a certified copy of the record is established by an order of a court of competent jurisdiction;”

has a direct and tangible interest, due to the subpoena that the Hawaiian court judge “SHALL” have issued.

Not only demand the subpoena “SHALL” be issued, but seek a court ORDER from the judge as well.

§338-18 Disclosure of records.
(a) To protect the integrity of vital statistics records, to ensure their proper use, and to ensure the efficient and proper administration of the vital statistics system, it shall be unlawful for any person to permit inspection of, or to disclose information contained in vital statistics records, or to copy or issue a copy of all or part of any such record, except as authorized by this part or by rules adopted by the department of health.

(b) The department shall not permit inspection of public health statistics records, or issue a certified copy of any such record or part thereof, unless it is satisfied that the applicant has a direct and tangible interest in the record. The following persons shall be considered to have a direct and tangible interest in a public health statistics record:

(1) The REGISTRANT;

(2) The spouse of the registrant;

(3) A parent of the registrant;

(4) A descendant of the registrant;

(5) A person having a common ancestor with the registrant;

(6) A legal guardian of the registrant;

(7) A person or agency acting on behalf of the registrant;

( A personal representative of the registrant’s estate;

(9) A person whose right to inspect or obtain a certified copy of the record is established by an order of a court of competent jurisdiction;

(10) Adoptive parents who have filed a petition for adoption and who need to determine the death of one or more of the prospective adopted child’s natural or legal parents;

(11) A person who needs to determine the marital status of a former spouse in order to determine the payment of alimony;

(12) A person who needs to determine the death of a nonrelated co-owner of property purchased under a joint tenancy agreement; and

(13) A person who needs a death certificate for the determination of payments under a credit insurance policy.
