Padilla Requests Change Of Venue
POSTED: 1:26 pm EST March 10, 2006
The Blair County public defender has requested that Miguel Padilla's homicide case be moved out the county.
Padilla is accused of killing three people outside of an Altoona nightclub.
Public Defender Donald Speice said the case has had more media attention than any other he has seen in the county in 30 years. Because of this, he said he does not believe Padilla will get a fair trial there.
Speice cited three billboards placed around Altoona shortly after the murders showing the victims' pictures.
Judge Hiram Carpenter is expected to make a decision next week.

Lawyers spar over trial jury
By Phil Ray
HOLLIDAYSBURG - Both sides in the homicide case of Miguel Padilla argued Friday over a request to select a jury from outside Blair County.
Public Defender Donald E. Speice said in 30 years of defense work in Blair County, he never saw a case that aroused such public furor.
Padilla's status as an illegal alien is mentioned repeatedly in the news media, he said, and billboards have been placed on county highways in memory of the three shooting victims.
For details, please see Page A1 in the March 11 edition of the Altoona Mirror.

Years ago, you could tell who the Mexican migrant workers were because they made it a point to stay out of trouble to keep from getting deported. How times have changed.

New Details In Padilla Murder Case
POSTED: 1:33 pm EST March 23, 2006
UPDATED: 1:35 pm EST March 23, 2006
HOLLIDAYSBURG -- There is a new development in the triple murder case against illegal immigrant Miguel Padilla in Blair County.
Thursday’s Altoona Mirror reports, police now have a search warrant to collect blood samples from Padilla's friend, Travis Shumaker. Shumaker was with Padilla the night three men were shot to death outside a veteran's club in Altoona last summer. Police want to know whose DNA is on the murder weapon.
Shumaker has not been charged in the case. Padilla is awaiting trial.Support our FIGHT AGAINST illegal immigration & Amnesty by joining our E-mail Alerts at http://eepurl.com/cktGTn

Mopohead, I guess they stayed quiet and orderly all those years so that they wouldn't be noticed until their were literally millions of them. I think that the Aztlan theory has basis because of that very fact. Now that they feel there are enough of them, they can rear that ugly head.

Out-of-county jury to hear Padilla case
By Phil Ray, pray@altoonamirror.com
HOLLIDAYSBURG — A jury from outside Blair County will hear the case against the man accused of killing three Altoona residents.
Miguel Padilla, 26, of Gallitzin will be tried in Blair by a jury from a county selected by the Pennsylvania Supreme Court.
Judge Hiram A. Carpenter’s decision represents a compromise after Public Defender Donald E. Speice requested a new trial location because of pretrial publicity and strong feelings surrounding the case.
Padilla, an illegal alien, is charged with the Aug. 28 killing of the owner of the United Veterans Association building on Union Avenue, Alfred J. Mignogna Jr.; club employee Fredrick Rickabaugh Sr.; and patron Stephen M. Heiss. Police say the shootings followed an argument where URA officials refused to admit Padilla and two friends.
District Attorney Richard Consiglio adamantly opposed moving the trial. He called it “unconscionable” to force victims’ family to travel to another part of the state.
“It’s better than losing the whole argument,” Speice said. “I think they better be prepared with very, very good security, and they better be prepared to go to great extent to sequester the jurors.”
Carpenter is not a stranger to out-of-county juries.
He presided over a major drug trial several years ago in which the jurors were selected from another county, and he was the judge in the William Wright death-penalty case in 2000 with an outside jury.
Carpenter also picked a jury for the William D. Thompson death-penalty case last year in Cumberland County, but circumstances arose that led to
a continuance of the trial. Thompson has yet to be tried.
Jurors brought to Blair from another county normally are housed in a local motel and kept together for the duration of the trial.
The Padilla case is expected to take about two weeks, not including jury selection, which is expected to begin Aug. 21.
On June 12, Carpenter will hear a challenge to the death penalty filed by defense attorney Ed Blanarik of State College.Support our FIGHT AGAINST illegal immigration & Amnesty by joining our E-mail Alerts at http://eepurl.com/cktGTn
