    Feds Sue to Stop In-State Tuition for Illegals in OK

    Americans For Legal Immigration PAC (ALIPAC.us) is encouraged that the Trump administration's Justice Department is challenging an Oklahoma law providing in-state tuition for illegal aliens, claiming "This law unconstitutionally discriminates against U.S. citizens, who are not afforded the same privileges, in direct conflict with federal law."     On August 5, 2025, the Department of Justice filed a complaint in the Eastern District of Oklahoma against the State of Oklahoma seeking to enjoin the State from enforcing the Oklahoma law and bring them into compliance with federal requirements that prohibit taxpayer institutions of higher education from providing benefits to aliens that are not offered to U.S. citizens.

    "Federal law prohibits aliens not lawfully present in the United States from getting in-state
    tuition benefits that are denied to out-of-state U.S. citizens. See 8 U.S.C. § 1623(a). There are no
    exceptions. Yet Oklahoma Statutes, Title (“Okla. Stat., tit.”) 70, § 3242 extends eligibility for in-
    state tuition benefits at state postsecondary educational institutions to individuals who are not
    lawfully present in the United States, while requiring U.S. citizens from other states to pay higher
    tuition rates. This unequal treatment of Americans is squarely prohibited and preempted by federal law.law, which expressly provides that “an alien who is not lawfully present in the United States shall
    not be eligible on the basis of residence within a State . . . for any postsecondary education benefit
    unless a citizen or national of the United States is eligible for such a benefit . . . without regard to
    whether the citizen or national is such a resident.” 8 U.S.C. § 1623(a) "

    ALIPAC has successfully fought and stopped similar in-state tuition for illegals bills in over 25 states since originally defeating Rep. Paul Luebke's HB 1183 in North Carolina in 2005 by pointing out that "Taxpayers should not be forced to pay to replace their own children in the limited seats in our publicly funded colleges with illegal aliens."

    Last month, the Trump administration announced that there are 5 Universities Under Investigation Over DACA Scholarships (View) for offering illegal aliens incentives and benefits that discriminate against Americans in America for our national origins.

    While encouraged by this lawsuit against Oklahoma's support for illegal aliens over Americans in universities, ALIPAC points out the measure does not go far enough because there are currently 408,000 "undocumented students" enrolled in postsecondary education and Twenty-Four states offering in-state tuition subsidies to illegals including Arizona, California, Colorado, Connecticut, D.C., Florida, Hawaii, Kansas, Kentucky, Illinois, Maryland, Massachusetts, Minnesota, Nebraska, Nevada, New Jersey, New Mexico, New York, Oklahoma, Oregon, Rhode Island, Texas, Utah, Virginia, and Washington!     "This effort does not go far enough! It is against federal law to give in-state tuition to illegals, yet 24 states are doing it! Most of the twenty-four states that give illegals in-state tuition snuck this into law without public knowledge or consent beforehand because super majorities of American voters oppose in-state tuition for illegals," said William Gheen, founder of ALIPAC. "We would like to see President Trump end Obama's unconstitutional DACA/Dreamer Amnesty fully canceled as Trump promised to do but failed to do in his first term, and DOJ sue all twenty-four states that are forcing their taxpayers to displace and replace our own American students in the limited seats in our colleges with illegals.
