If they sneak in, why wait until they sneak in again to charge them with a felony? Charge them with a felony the first time, then boot them out.
As you well know, that would require a change in law. Moreover, if they are charged with a felony, they need to do some prison time. There has to be consequences for their felony crime! Getting deported is not a punishment. Kicking those out that illegally return repeatedly without punishment does nothing to deter them from continuing to return. They must be made to suffer the consequences of their actions. Not charging and failure to imprison those guilty of illegal reentry is exactly why they keep returning over and over again!
