    AUSTIN
Man charged in sexual assault of 82-year-old
Forensic lab helped in arrest, police say.
    By Patrick George
    AMERICAN-STATESMAN STAFF
    Saturday, September 30, 2006
Using forensic technology, Austin police arrested a man who officials said confessed to sexually assaulting an 82-year-old woman early Thursday.
Angel Roel Martinez, 20, was arrested Thursday night and charged with aggravated sexual assault, a first-degree felony, and burglary to commit sexual assault.
According to his arrest affidavit, Martinez broke into the Northeast Austin house on Cottle Drive through a dining room window about 12:30 a.m. Thursday. Martinez confronted and assaulted the 82-year-old resident, the affidavit said. The woman fought off Martinez, and he left the home after stealing some of her property, the affidavit said.
Jerry Pena, assistant crime lab manager for the Austin Police Department, said forensic investigators found several fingerprints on a piece of broken window. About 9:30 a.m. Thursday, the prints were identified as belonging to Martinez after they were run through a crime database, police said. Martinez was arrested that evening.
The woman was taken to St. David's Hospital, where she was examined and released, police said.
Martinez is in the Travis County Jail with bail set at $75,000.
Detective Andrew Romero of the Police Department's sex crimes unit said although Martinez described himself as a thief, his motive for the sexual assault remains unclear.
"This is a very unspeakable crime," Romero said. "All sexual assaults are bad, but this one was particularly disturbing because of the victim's age."
Romero said the woman remained strong through the ordeal and that she felt empowered by being able to identify Martinez as her attacker.
A search of public records did not reveal a criminal record for Martinez, and police officials declined to comment about his arrest history.
Pena said solving cases such as these are exactly what the department's $19 million crime lab is designed to do.
"It's not typical for a case to be solved this quickly," Pena said. "This was a result of a great combined effort between forensics and detectives, and we're lucky to have the level of technology that can have this kind of turnaround."

This crime was very violent ..usually they have a history....but note this comment:
A search of public records did not reveal a criminal record for Martinez, and police officials declined to comment about his arrest history.

Still no mention of his legal status today that I can find. I've emailed a couple of reporters.

    HICKORY
Woman, 55, killed in DWI wreck
Husband seriously hurt; driver, 20, charged for 2nd time in 14 months

HICKORY - A 20-year-old drunken driver ran a red light and crashed into a pickup truck Friday night, killing a woman and critically injuring her husband, police said.

Police charged Enrique Cardenas Zavala of Hickory with driving while impaired, driving after consuming alcohol while under 21, failing to stop at a red light and involuntary manslaughter.

It was Cardenas Zavala's second DWI charge in less than 14 months. He was charged with DWI in Catawba County in August 2005 and pleaded guilty to a lesser charge of reckless driving to endanger. He was sentenced to 30 days in jail and fined.

The wreck Friday happened just before 10 p.m. in downtown Hickory. Jerry and Rena Moore were driving north on Fourth Street Northwest when Cardenas Zavala's 1997 Pontiac Grand Prix, traveling west on Third Avenue Northwest, struck the Moores' truck, police said.

The couple were ejected from the truck. It's unclear whether the Moores were wearing seat belts or whether their truck, a 1951 Chevrolet, was equipped with them, Lt. Gary Lee said.

Paramedics rushed the couple to Frye Regional Medical Center, where Rena Moore, 55, was taken into surgery and died. Jerry Moore, 58, remained in critical condition Saturday with a fractured neck, the hospital said.

Cardenas Zavala, who was not seriously injured, failed field sobriety tests Friday night, but the arrest report didn't indicate his blood-alcohol level, Lee said.

He has a number of past driving violations, including speeding, driving without a license and DWI.

Cardenas Zavala was being held in the Catawba County Jail Saturday under a $50,000 secured bond and is scheduled to appear in the county District Court on Monday. He could face additional charges, police said.

The Moores were Hickory natives who recently retired. Jerry Moore had been a teacher; his wife worked for the state or county, said Katherine Clark, who lived next door to the couple in the 1980s.

Alice Blackburn, 81, who has lived across the street from the couple for 20 years, said the Moores were good neighbors and good friends. Blackburn's son went to Hickory High School with Rena Moore, and Blackburn watched the couple's son, Garrett, now 29, grow up, she said.

"They were wonderful neighbors," she said. "He had a beautiful yard, and she was a treasure to me. I just can't believe it."

There was an article in today's Austin American about a border patrolman who was taking bribes. The incredible thing about this case is that he was an ILLEGAL with a forged birth certificate. Does the government even do a background check if you speak Spanish?

I hate to disappoint you but criminal groups have people infliltrate anywhere they need them. Not only do they get a pay check from their employer but also get bribes or paid by criminal groups. One of the mafias actually has people in immigration or people who have access to that information. A lawyers who has knows some of them warned me about that. Even though checks are made if someone has a legitamite looking identification and no past criminal record, pass the psych test, credit check, entry exam and lie detector test they get hired. Maybe when they do the lie detector test they should ask the are you legally here and/or is your identification legitimate and really yours.

Heard on a talk radio program last week that the illegal that was driving the bus that incinerated 20+ people and was initially charged with negligent homicide is legally driving a bus in the Rio Grande Valley. He was allowed to take the drivers test in Spanish. All I can think of is that he has permission to stay if he testifies against the bus company. This was on the Rusty Humphries show I'm pretty sure.
    I think it is unbelievable.
