The Natural Born Citizen clause in the Constitution. If the Tea Party is the party of the Constitution, can someone in the Tea Party tell me what is going on here. I'm in a discussion with a Republican in Florida and he tells me,

    "
The Republican Party only holds a primary contest. It is not the arbiter or enforcer of who is or isn’t eligible to run for President or who is or isn’t a citizen. The party has no power, whatsoever, to deny a candidate a place on the ballot, based on their citizenship eligibility, until the courts rule. I’ll repeat it so that it is clear: the party has NO POWER to make such a determination."

I don't believe this whatsoever. Aren't all citizens responsible for the Constitution? Are not primaries run by the States in collusion with the political parties? I find it laughable that the Republican Party in its convention rules can not apply the Natural Born Citizen clause to its own nominating convention rules! Mitt Romney goes out and calls Trump unfit to be the Republican nominee, but the Republican Party can't make a determination, itself, about who is and who is not a Natural Born Citizen.
I find this all very unreal! Even after the Obama birther issue, the Republican Party never expended any effort in these intervening years to seek an answer to this question but seems to bury it! And then the Republican Party, along with the Tea Party, all claim to be conservative, cry about the Rule of Law--but none of them speak to the Natural Born Citizen Clause? What the Hell is going on?

And Many people tell me we have to wait for the Supreme Court to rule on what the Natural Born Citizen clause means. If that is the case then, the principle of waiting for the Supreme Court to decide on the natural born clause, THEN, We don't know what's in the Constitution and we must wait for the Supreme Court to tell us what it means and that the Supreme Court must rule on every word in the Constitution to tell us they all mean. I can't understand the what the word "militia" means in the 2nd amendment until the Supreme Court tells me.

I believe this guy is trying to pull the wool over my eyes. If Mitt Romney can tell us all that Trump is unfit, the Republican Party itself can obey the Natural Born Citizen Clause and use it as a standard. It doesn't need the Federal Government, or the Judiciary--it has the Constitution and it can use it by itself! Can it not?

    Frequently Asked Questions
    . . .
Who verifies if a candidate is qualified to run for President?

The Office of the Federal Register at the National Archives and Records Administration administers the Electoral College process, which takes place after the November general election.

The Office of the Federal Register does not have the authority to handle issues related to the general election, such as candidate qualifications. People interested in this issue may wish to contact their state election officials or their Congressional Representatives.

Because the process of qualifying for the election and having a candidate’s name put on the ballot varies from state to state, you should contact your state’s top election officer for more information. In most states, the Secretary of State is the official responsible for oversight of state elections, including the presidential election. Visit the National Secretaries of State web site to locate contact information and web addresses for the Secretary of State from each state and the District of Columbia.

Well, I thought the Tea Party would stand up for the Constitution--but I guess not. We can't depend upon no one to uphold the Constitution! I thought we live in a republic and a Rule of Law? I guess not.

Just to rehash, here is a list of links that teach the Natural Born Citizen Clause of the Constitution and a couple of sites that show that Ted Cruz was a Canadian citizen and can't possibly be a Natural Born citizen!

John Roland, Constitution Society. Neither McCain, Obama, nor Cruz are Natural Born Citizens.

This needs to be added at the Republican nominating convention. The Republicans who seek to disavow Trump, are expending no energy to obey the Constitution of the US! How sad.

Nasty cruz - a 17-year-old first time voter at a New Hampshire town hall meeting for Cruz asked a very reasonable question…

“How and why, until recently, were you unaware that you were a Canadian citizen?”

Senator Ted Cruz has repeatedly stated that he has never “naturalized” to the United States, which eliminated the possibility that Ted Cruz is a “naturalized” U.S. Citizen.
Senator Ted Cruz has also documented the fact that he was not a “native born citizen” of the United States, but rather a “native born citizen” of Canada on December 22, 1970, who maintained his legal Canadian citizenship until May 14, 2014.

The Harvard opinion letter written by two of Senator Cruz’s Harvard friends, Neal Katyal & Paul Clement, a mere “commentary” on the subject, relies upon the 14th Amendment naturalized citizen at birth concept, despite the fact that Ted Cruz was not “born in or under the jurisdiction of the United States,” was never “naturalized” to the United States, and completely ignoring the fact that Canada prohibited “dual citizenship” in 1970, as well as the fact that “dual citizenship” alone would prevent him from “natural born U.S.” status.

All of this explains why Senator Ted Cruz has no legal U.S. citizenship documentation of any kind. He is not a “natural born” – “native born” or “naturalized” citizen of the United States. Because someone must be one of the three in order to be a legal citizen of the United States, Senator Ted Cruz cannot possibly be a “legal U.S. citizen” of any form.

That is mostly correct. But the Republican Party most certainly has the authority to nominate its own candidate.

Again the pernicious grip of the Two Party System has hypnotized an observing public.

The only reason that the eligibility of a candidate is being contested at this point is because of the primaries and the role they play in a political party nominating a candidate for an elected office. Since lawful US government offices have taken the responsibility away from the political parties who must register with US government to take part, then the eligibility of the candidate is confused away from the authority of the political parties.

But really, it is the political parties who should be the sole arbiters of who is eligible to be nominated by the political party. Strictly speaking, a political party can choose their candidate any way they want to. They don't even have to have an election to choose a nominee at all. If the Republicans want to decide that anybody up for nomination for the presidency is not eligible, then that is strictly the affair of Republicans.

If the candidate they then choose is ineligible as a matter US law, then that is another concern altogether.

These are not subtle distinctions in the current dilemma of the Republican Party.

Well, I was in a discussion with a Floridian republican on the Natural Born citizen clause. He told me we couldn't do nothing about it. That got me ticked off. It's the Constitution, the highest law of the land, and every citizen is bound to obey it. How can we not obey a single clause in the Constitution? It got me mad so I wrote a small article on it. The Abstract:

A philosopher's critique of the Republican Party's response to the Natural Born citizen clause in the US constitution. The Republican Party has many excuses such as (1) No court has ruled, (2) they can't do nothing about it, (3) the term is not defined, (4) and that they have no control over elections. The inability to challenge Obama shows the Cowardice of Republicans and that the Republican's own candidates of Cruz and Rubio who are not NBC shows its perfidy. All citizens in a Republic are called to Obey the Constitution. That Ignorance of the Law is no Excuse. That the Republicans can use their own nominating convention. And in the end of all this, shows that the Constitution is dead and America is a Failed State.
