One step Obama has taken is to threaten to use Recess Appointments if Congress delays his appointments to key positions in the executive branch. This is constitutional.
As far as I can tell, Executive Orders are constitutional as well, as long as they do not violate any specific provision of the constitution. For example, if Obama issued an executive order banning private ownership of guns, that would be unconstitutional. Executive orders that infringe upon, or appear to infringe upon, the prerogatives of Congress probably would not stand a constitutional test, but that would probably require Congress to take the adiministration to court to challenge the orders. For example, the 40+ czars that Obama has appointed without Senate approval. However, a Democrat controlled Congress, with the majorities currently held by the Democrats, is unlikely to challenge most orders issued by a Democrat president (Same would apply I think to a Republican president with a Republican controlled Congress).
