    Employers rarely penalized
    Employers who hire undocumented workers such as Reyes to do a host of jobs — from construction and meat packing to agricultural work and painting — rarely face penalties, even though a federal law passed in 1986 criminalized the hiring of illegal immigrants.
    In fiscal year 1999, the government issued 417 notices of "intent to fine" employers for knowingly making such illegal hires. But by 2004, that number had dropped to three, according to a June 21, 2005, Government Accountability Office report. Worksite enforcement amounted to less than 5% of all of the federal government's ICE investigation activities. Since 9/11, the government has "almost exclusively focused worksite enforcement resources" of illegal immigration on sites such as airports and nuclear power plants, according to the report.
    But federal officials say they've been strategically shifting away from administrative fines to criminal charges — last fiscal year, that approach resulted in 127 criminal convictions, up from 46 the previous year.

    Illegal Immigrants Account For 44 Percent Of Worst Drug Cases

    ROGERS -- Of the 57 arrests for delivery or intent to deliver drugs in Rogers since the first of 2005, 43 were Hispanic and 25 were illegal immigrants, according to statistics gathered by Mayor Steve Womack on Wednesday.

    "Forty-four percent of the worst-of-the-worst drug arrests were illegals," Womack said. "Forty-four percent of the big stuff should be a major concern to the citizens of this community."

    Womack's plan now for dealing with the illegal immigration issue is to enlist six Rogers police officers in the Immigration and Customs Enforcement 287(g) program. The program provides law enforcement with training and authorization to identify, process and, if needed, detain illegal immigrants.

    Since first announcing plans to come up with some kind of local process for dealing with illegal immigrants, Womack has maintained many of the drug cases city officers handle

    The memo says one Texas district prosecutes migrants if the Border Patrol catches them at least six to eight times. The other district prosecutes after someone is caught at least seven times.


    In late 2005, the government created a 200-mile zone near Del Rio, Texas, in which every adult arrested for illegal immigration would be prosecuted and jailed before being deported.

    The San Diego office, which covers an area stretching from the Pacific Ocean to the Arizona state line, does not prosecute "purely economic migrants" as a ……..

    At $6.5 million per year, a Medicaid program that pays for prenatal care for immigrant women is costing the state more than five times what officials predicted two years ago.

    The unexpected higher cost stems from Medicaid officials underestimating the number of women who would qualify and failing to factor in the cost of prescription drugs and hospital stays after deliveries. "I can't imagine the department missing the target so far on cost," said state Rep. Jay Bradford, D-White Hall.     ....Reports on file with state agencies and a Rocky Mountain News survey of police agencies show more than 15,000 people arrested or cited in Colorado between June and December 2006 were referred to ICE for investigation. The federal agency is responsible for determining the legal status of those arrested and whether to try to remove or deport them from the United States.

    "Wow, that's a significant number," said state Sen. Tom Wiens, R-Castle Rock, author of the law.

    Numbers unknown

    The actual numbers of those reported are probably higher. Confusion over where to file the reports meant that filings for some cities and counties were not readily available.

    Arapahoe County, which also tracked reports for the city of Centennial, had the most referrals, 2,167.

    Undersheriff Mark Campbell said the county informs ICE about anyone in the jail who is foreign born or they suspect is foreign born.

    "For example, a guy who comes in and speaks only Russian, but says he was born in Denver," Campbell said.

    Boulder County Sheriff Joe Pelle said most counties gave ICE the names of anyone booked into the county jail born outside the U.S. The county submitted 1,548 names to ICE, the third highest in Colorado. …….

    The best measure of this new strategy lies in the number of arrests ICE has made for criminal violations in worksite enforcement investigations. Those arrested include a variety of persons–corporate officers, employers, managers, contractors and facilitators. These arrests also include illegal aliens charged with criminal violations. Aliens have been charged with possession and/or distribution of fraudulent documents, re-entry after deportation or entry without inspection.
    Another measure of ICE’s new strategy lies in the number of illegal aliens arrested on administrative immigration violations during worksite enforcement investigations.
