    Talking now.

    Talked about last year's amnesty disaster,

    Previous amnesty (1986) failures,

    Mentioning positioning legislation into War funding bill,

    Estimates this AgJobs - would legalize up to 3 million IAs,

    "This legislation is a bad bill, and should not become law".

    Mentions H2b visa, 65k / yr; etc. mentions current problems with employment and trends in higher unemployment in US. Why now?

    Would increase employment-based green cards 218k; 'green card recapture'. It is a PR status, a guaranteed path the citizenship.

    Would re-authorize foreign investor visa program. (probably ok).

    Hasn't been discussed in Judiciary Committee Hearing. It was just stuck in bill w/o any real debate.


    These are worthy of discussion.

    We can talk about a real guest-worker program.

    This represents a major shift in immigration policy and done without light of debate or public review.

    Last year's - entire senate switchboard shutdown. And that's when senate votes started chaning from yea to nea.

    The public is cynical because they see us saying one thing, and doing another.

    We can talk about having a legal guest-worker program, and I thought we agreed about this. I thought this was the right answer.

    The American people that was fundamentally correct on this all along.

    I thought, we had gotten the message, but oh no, here we come again.

    We already issue over 1 million GC's every year. (Green Cards)

    Recipients have to meet some basic requirements.

    Why do we seem to be incapable of enclosing the loop in creating a legal system that works.

    This is not acceptable way to do business. We don't need to have the war supplemental tied up in a controversial debate.

    AgJobs bill is fundamentally unacceptable.

    Bill -

    Bill is 100+ pages. Legalization for 3 million IAs.
    5 yr legalization to live and work in US.
    Reqs legalized treated as PRs (Perm Residents).
    Performed Ag employment 863 hrs or 150 days have earned 7k from Ag job -... over 4 yr period.
    (etc)

    It is particularly galling to me - we say we are serious about all this, "I am for a legal system"... but we propose a piece of legistlation that rewards people that have arrived here illegally up to last year. (!)

    Consistently and morality are not consistent with creating a legal system.

    IA cannot prove they paid taxes while here,

    Who would qualify?

    Any IA that arrived up to 2007 earning 7k that year.
    IAs arrived up to 7/2007, etc.
    Earlier ones that earned 1750$,
    IAs 37.5 days per day for 4 years, (what about 300+ days not working here?)

    This was a deliberate attempt to squeeze in a bunch of barely related groups into a legalization program.

    IAs spouses not already illegally present, then they would be encouraged to come here. Application period does not start until 7 mos. after enactment.

    If spouse or child is caught crossing border, this bill allows them de facto sanctuary so long as they make a claim they were coming to join existing family.

    5 yr visa sunset. "Don't worry, it's only 5 yr amnesty".
    He asks - what will Congress do 5 years from now?
    These people become more rooted in communities. Harder to encourage them to go home.

    A real guest-worker program is needed - a legal, temporary program - is doable. This is NOT that.

    Congress should not be considering this bill.

    Sen Byrd said "This amounts to Amnesty".

    It specifically, get this, creates a pathway to c-ship to sheep herders, goat herders, and dairy workers.

    "We need to find out who lobbied for this"
