    CA Court Strikes Down In-State Tuition for Illegals

    A three judge panel of the California Court of Appeals unanimously ruled that a California law intended to permit illegal aliens to attend public colleges and universities at in-state tuition rates is unconstitutional.

    Boy! Who would have thought the courts would protect Americans?

    Now if they would do something about the Department of Labor and the I-9s violations of fraud against the America Workers.

    A three judge panel of the California Court of Appeals unanimously ruled that a California law intended to permit illegal aliens to attend public colleges and universities at in-state tuition rates is unconstitutional.

    The panel ruled that the law conflicts with federal law, and violates both the equal protection clause and privileges and immunity clause of the constitution. Ruling in the case of Martinez et al. v. Regents of the University of California, brought by the Immigration Reform Law Institute (IRLI) on behalf of some 80,000 nonresident American students who were denied in-state tuition benefits, the Appeals Court agreed that California policy violates expressed provisions of both the Immigration Act and the Welfare Reform Act of 1996.
    The 1996 Immigration Act states that “an alien who is not lawfully present in the United States shall not be eligible on the basis of residence within a State…for any postsecondary education benefit unless a citizen or national of the United States is eligible for such a benefit…â€

    What great news this is!!!

    Hmmm.....ICE raids, deportation warrant sweeps, no in state tuition for IAs.....what in the world is beginning to happen out there?

    Thanks for posting the whole article Jean

    In reading it, it becomes apparent that this is truly a HUGE victory for all Americans concerning numerous privileges and benefits that are granted IAs....privileges and benefits to which they are NOT entitled to receive in the first place but have been above even those granted American citizens.

    This ruling IS a big one!!!

    I love this quote at the end:

    ALERT: Victory! CA Appellate Court Denies In-State Tuition for Illegal Alien Students!

    In a major victory for opponents of illegal immigration, a state appellate court held that California is violating federal law by giving in-state tuition rates to illegal alien students at state colleges and universities.

    The 3rd District Court of Appeal unanimously reversed the Superior Court's dismissal of a suit brought by students who paid far more to attend college because they were out-of-state residents. The appellate court ruled that California's law conflicts with federal law and gave the plaintiffs permission to challenge the constitutionality of the state law.

    California's AB 540, passed in 2001, makes the state one of only nine with laws allowing illegal aliens to qualify for subsidized, in-state tuition rates.

    This is not the end of the case. It was remanded to Superior Court for trial, and the appellate ruling could be appealed to the state Supreme Court, but it is sweet to savor this victory for now.
