    Big news for California and all Americans. Hooray!!!!!!!! This will help restore our faith in judges to do the right thing. It will also be a big disappointment to pro illegals and the politicians who support them who felt confident that they could have their way in court at the expense of American citizens. And even bigger news is that it opens the way to stopping many more of the illegal benefits that illegals are receiving.

    Excellent news....this is very, very big as the other 8 states still granting in-state tuition benefits to illegal aliens will most likely quietly repeal their laws before they too are faced with legal challenges .....I hope that out-of-state public college/university students in all those 8 states start filing lawsuits like this so they can get their tuition refunds for all the years they had to pay higher rates than the illegals that were registered. How many American families sacrificed to put their children through school and had to pay higher tuition rates than the illegal alien students sitting next to their kids?

    IMMIGRANT TUITION: A leading opponent of a Kansas law giving some immigrants a break on tuition at state universities and colleges law is encouraged by a ruling by a California appellate court on a similar law there.

    Kris Kobach, a law professor at the University of Missouri-Kansas City, said the California ruling casts doubts on the validity of the 2004 Kansas law.

    That law allows some illegal immigrants who have graduated from Kansas high schools to qualify for the lower tuition rates normally reserved for Kansas residents. The law requires those immigrants to seek legal status.

    "The implications for Kansas are pretty huge," said Kobach, who's also the Kansas Republican Party's chairman and a former adviser to the U.S. attorney general on immigration law.

    National groups say Kansas, California and eight other states have such laws, and their supporters argue that they help young people who most likely were brought to the United States by their parents and aren't likely to leave. Critics say such laws endorse illegal immigration and conflict with federal immigration laws.

    Kobach represents 42 students in the University of California system who were paying higher tuition rates. A circuit court dismissed the lawsuit there.

    On Monday, a three-judge appeals panel based in Sacramento overturned that decision. Kobach noted that the panel said in its opinion that the California law conflicts with federal law.

    But the case still could go to the California Supreme Court.

    Josh Bernstein, director of federal policy for the National Immigration Law Center, said: "This is just one stage in the process."

    Heard somewhere this is the most litigious country in the world, and voters in California (and Mexifornia) should keep their eye on the Calif. supreme court if they overturn the appellate court decision and go the other way. Keep us posted and if it doesn't go right, recall the folks on the Supreme Court, impeach them or deport them.
