The DOJ is not authorized to give illegal immigrant amnesty. Only the President of the United States has final authority to do that.

It's delusional to think the system would be any different if DHS was responsible for deportation in the sense you're advocating for. DHS is responsible for the actual retention and physical deportations of all illegal aliens.

If the responsibilities of DOJ were switched to DHS they would still be required to act in accordance with our immigration laws and U.S. Constitution. There would still be immigration courts and immigration judges whether you cut DOJ completely out or not. Your argument on whether DHS or DOJ should be responsible for immigration courts and judges is meaningless because both would have to observe the same laws. Personally, I'd much rather have Jeff Sessions in charge of this over Secretary Kirstjen Nielson (sp?).

The only real way to enact the change in law you want is for our legislative branch to rewrite our immigration laws. Switching DOJ responsibilities to DHS would do absolutely nothing to change law.

I understand where you're going. You just want DHS to catch 'em and deport 'em ... don't we all, but unfortunately our immigration laws are much more complex than that. If you want to assign blame for the sorry state of affairs we're in, I'd start with the special interest group lawyers, immigration lawyers, leftist district court judge, U.S. Congress, and our President.

No similarity at all. Furthermore, the DHS does actually release illegals and asylum claimants. The DOJ does not detain illegals or asylum claimants. It is the responsibility of DHS to deport them or refer them to the DOJ (immigration courts). The DOJ only issues orders of release for those winning their claim or case in immigration court. The DHS would have to do the same thing if they controlled the courts.

It is the responsibility of DHS to decide on catch & release (releasing for future court date) or detention. The DOJ doesn't deal with that aspect.
