    Ramon Felix Pineda, the illegal immigrant accused of running over and killing an offduty Flint police officer in Independence Township, is due back in court this afternoon for what is expected to be the conclusion of his preliminary exam.
    Pineda, of Clarkston, is charged with second-degree murder and other charges relating to the Aug. 26 crash that killed Flint police Officer Vincent Owen D'Anna, who was riding a motorcycle.

    Pineda, 25, will appear before 52nd-2nd District Judge Kelley Kostin.

    He had been driving a 1992 Chevrolet Camaro that allegedly struck D'Anna's 2007 Suzuki motorcycle on Sashabaw Road, dragging it a short distance before they stopped.

    The fact that this writer wrote an article stating that Officer Vince D'Anna was dragged a short distance is maddening to me. Vince was dragged for 70 feet that is in no way a short distance. Testimony given in court stated that Pineda accelerated the entire time. He stopped only because Vince's motorcycle got caught in the wheels and he could no longer move forward. Pineda then got out and ran. He left Vince to die in the street. Ramon Pineda had enough wits about him to run. He knew what he was doing and he knew how bad it was. Ramon Pineda just didnt care. An American, an upstanding American was killed for no reason. Absolutely the people who gave Ramon Pineda the car should be charged as well. They knowingly handed the keys of a potential weapon to a person who had no business having it. Ramon Pineda had never been through Drivers Education. He had never taken a road test. He did not have a license, but someone gave him a car and let him leave with it.

    Its completely unbelieveable. . .

    Okay, NOW will more police forces speak out about illegals and the destruction they cause? We can scream all we want to, but if the men and women of law enforcement stand up and make the gov't have to deal with the mayhem we're in and headed for. How much confidence does an officer have that an illegal is using his/her real name -if there is such a thing in Mexico. Things like what happened to this fine officer and his family just make me sick, even more so because our gov't is complicit in the invasion, colonization and destruction we are seeing with illegals. Damn! Damn! Damn!..this hurts.

    Going to Trial....

    Today the Arraingment was sent to the County Court. He will be standing Trail for what he did. Listening to the witness statements was heartbreaking. One witness stated that he thought the man was African American, (keep in mind it was daylight out), when asked why, he said he found out after the fact that the man was white, but the blacktop/concrete had charred his skin (from being drug so far), he appeared to be dark skinned.


    To answer some questions:

    His licence was "suspended" because he was living under false I.D.s- He had never even applied for a legal status.

    He will not get away with this, we have been writing to the papers/News to get this on everyones mind, these elected officalls will have no choice but to make an example out of this creep.

    "Why me?"
    Those are the words witnesses say Ramon Felix Pineda repeated twice in the parking lot of a convenience store where he is accused of fleeing to shortly after a traffic accident last summer that resulted in the death of an off-duty Flint police officer.

    Pineda, dressed in a white-collared shirt and light-colored slacks, appeared Monday for the first day of testimony in his trial before Chief Judge Wendy Potts in Oakland County Circuit Court.

    The Mexican native, who had allegedly been living in Ortonville, is facing second-degree murder charges in the death of 26-year-old Vincent D'Anna.

    Pineda is accused of being drunk behind the wheel of a white Camaro that was heading south on Sashabaw Road the night of Aug. 26, 2007.

    It was near the Clarkston Road intersection that the car rear-ended a southbound Suzuki motorcycle that had either stopped or slowed because of traffic associated with a concert at nearby DTE Energy Music Theatre.

    On that motorcycle was D'Anna, who witnesses say was run over before being dragged several feet by the Camaro.

    Pineda is also being charged with operating a vehicle while intoxicated causing death, failure to stop at the scene of an accident, operating a vehicle with a suspended license and false certification of personal information Ñ he is accused of assuming a cousin's name to get a driver's license.

    According to toxicology reports, Pineda's blood alcohol level was .16, twice the legal limit.

    Witnesses, many of whom lifted the car off D'Anna that night, told the court it appeared as if the driver of the Camaro was attempting to leave the accident after initially hitting the motorcycle. Their testimony was relayed to Pineda with the help of an interpreter who speaks Spanish. Investigators, however, say it does appear he understands English and witnesses testified he was speaking English at the time of the accident. Brandon Wakeman told the court he was picking up his girlfriend from the concert when he witnessed the accident happen right in front of him.

    Motorists were driving at slower speeds because of the concert, Wakeman said.

    "You could tell he was speeding because no other car was making a ruckus like that car was," he told the court.

    The Camaro, Wakeman said, stopped too late, and hit the rear end of the motorcycle, which caused damage but didn't appear to hurt D'Anna.

    It was when the Camaro appeared to hit the rear of the motorcycle again that he fell off the bike, rolled under the car and was dragged, Wakeman said. Another witness, who was driving a pickup truck behind the Camaro, testified he saw smoke coming from the tires of the car's wheels before the accident and presumed it was from braking.

    The witness told the court he stopped his vehicle and began searching for his cell phone before going to the scene of the accident. That's when the witness says he saw Pineda run toward him. "I yelled 'Stop, stop, you're the driver' and he yelled 'No,'" the witness said.

    His response, the witness said, was in English. Pineda, according to court testimony, was tackled in the parking lot of the nearby convenience store where he was held until Oakland County Sheriff 's deputies arrived. During cross-examination by defense attorney Elias Escobedo Jr., the witness admitted to being angry at what he had seen.

    "To see him flee ... I ride a bike, my son rides a bike," Wakeman told the court. "To see the actions ... I was mad. "I haven't ridden my bike since." Wakeman, along with others, had surrounded Pineda and was yelling at him in that parking lot, according to court testimony. The witness told the court, had he been in Pineda's situation, he would have been "scared."

    It was while Pineda was being detained in the parking lot that a group of motorists and pedestrians picked up the Camaro and moved it off D'Anna. Family members of D'Anna openly wept as witnesses described seeing his torso twisted and his face red and purple from a lack of oxygen. "Bad, it was just terrible," described James Maurer, who had heard the crash before running to the car to help get it off of D'Anna.

    Their crying grew louder as Oakland County Assistant Prosecutor Rob Novy removed the helmet worn by D'Anna the night of the accident from a brown bag. As the helmet was shown to an Independence Township Fire Department paramedic, Pineda too began to cry. Novy says the fact Pineda was drunk behind the wheel of a vehicle and took the life of another person justifies the charges against Pineda.

    "He knowingly created a high-risk situation that resulted in great bodily harm, or in this case, death," he said. Escobedo, however, maintains his client didn't know D'Anna was under his car, and was frightened when the large group of people began to surround his car.

    "A witness tells him to get out, so he does, he panics," Escobedo said. "He doesn't know what do to do. He wasn't trying to get away from the scene. "He wishes he could talk to the family, but he can't because we are in trial." Testimony will continue at 8:30 a.m. today.

    GUILTY AS CHARGED!

    After deliberating just three hours, jurors found Ramon Felix Pineda guilty Friday of second-degree murder in the death of an off-duty police officer in an Independence Township traffic crash.

    Pineda, 26, who showed no visible emotion as he was led away in shackles, faces a sentence of up to life in prison.

    Members of victim Vincent D'Anna's family wiped away tears after the verdict was read.

    "We're definitely satisfied with the verdict,Ó said D'Anna's brother, Elliot D'Anna. "It's exactly what we wanted to hear, but it doesn't make anything any easier.Ó

    Pineda was driving a 1992 Chevrolet Camaro south on Sashabaw Road on Aug. 26, 2007, when he struck 26-yearold Vincent D'Anna, who was in the southbound lane on a motorcycle that had stopped or slowed because of traffic associated with a concert at DTE Energy Music Theatre. Pineda, of Ortonville, accelerated more than once after the initial impact and his vehicle climbed over the motorcycle. D'Anna, who was dragged about 120 feet with his motorcycle and another 60 feet alone, died of multiple blunt force injuries. Pineda's blood alcohol level was .16, double the legal limit.

    Oakland County Assistant Prosecutor Robert Novy argued that Pineda's repeated accelerations and attempt to flee the scene showed guilt of second-degree murder. Novy said during his closing argument earlier Friday that Pineda Ñ a native of Mexico who was accused of being in this country illegally and driving on a suspended license Ñ ran because he didn't want to get in trouble.

    "Because of his (Pineda's) choices, Vincent D'Anna paid the ultimate price,Ó Novy said.

    Defense attorney Elias Escobedo Jr. said that the second-degree murder charge was excessive.

    "He was trying to get off him,Ó when he accelerated, Escobedo said. "That would not be an unnatural reaction.Ó

    Escobedo said he disagreed with the charge of leaving the scene of a personal injury accident, because Pineda only fled because he was scared of being harmed by the passers-by who gathered at the scene and were yelling.

    The trial, which lasted about a week, included testimony from eyewitnesses who saw or heard Pineda accelerate. People testified to lifting the Camaro off D'Anna and seeing his mangled body.

    Pineda also took the stand.

    He said he was driving on Sashabaw reaching for his ringing cell phone and looked back up to see that traffic was slowing. He said he realized he was close to the motorcycle and braked, but wasn't able to stop properly and swerved to the right, hitting the rear of the motorcycle.

    Pineda said he felt his vehicle go over the motorcycle. He said he paused briefly and then accelerated to try to get off D'Anna and the motorcycle.

    Pineda and Escobedo said that Pineda's understanding of English is limited, and Pineda testified he was confused during the interview conducted in English with deputies. Escobedo previously tried unsuccessfully to get Pineda's statements suppressed because he said his client didn't fully understand his rights.

    Pineda used a Spanishspeaking interpreter in court, but Novy argued that Pineda understands English just fine. Novy played for jurors a recording of a recent phone call Pineda made to his wife from jail in which he speaks in English.

    On the second-degree murder charge, jurors received instructions on the lesser charges of manslaughter and negligent homicide.

    Pineda was also found guilty of operating a vehicle while intoxicated causing death, failure to stop at the scene of an injury accident, driving with a suspended license and false certification of personal information for assuming another man's name to get a driver's license. He will be sentenced at 10:15 a.m. June 4 before Oakland Circuit Chief Judge Wendy Potts.

    "We're satisfied with the verdict,Ó Novy said. "We're not satisfied that the D'Anna family lost their brother and son.Ó

    Escobedo said he's disappointed with the verdict. It's unknown whether Pineda will appeal.

    About 20 supporters of D'Anna were in the courtroom Friday. Jurors were never told that D'Anna was a Flint police officer, a career he picked because he enjoyed helping others. D'Anna, who lived in Clarkston until moving to Goodrich, had been a Flint officer for 16 months and was in the beginning stages of a serious romantic relationship.

    D'Anna's sister, Camille Leinbach, said her brother had a goofy sense of humor and was known for finding humor in everyday situations, such as the time his vehicle got stuck and blocked a fast-food drivethrough lane just a few days before he died.

    Leinbach said D'Anna was hardworking and loyal. She said he deeply cared about other people, even those he only knew for a short time.
