But on CBS's "Face the Nation" Sunday, Holder said if the federal government's initial challenge fails and the Arizona law takes effect, the Justice Department may have grounds for a later, second challenge. (that it might lead to racial profiling).
For the past 1-3 years, we-ve been trying to get our Congress critters to make E-Verify mandatory for all US employers. Do you remember the arguments that some Congressmen gave in saying that we shouldn't make E-Verify mandatory? They claimed that it was only 94% accurate, instead of 99.5%. Then they said that "some workers who are legally allowed to work might not be listed in the E-Verify system". They said that these workers would get unneccessarily harassed, and might even sue the Government.
But this is similar to Holder's "wait and see" approach. Congress should have passed mandatory E-Verify into law by now. Then the Obama Administration and AG Holder could have employed their brilliant strategy, and see if any civil-rights abuses would develop with legal workers, who weren't listed in E-Verify, and could not verify their true identity with the Social Security Administration within 90 days.

Sometimes I wonder if our Commander In Chief is listed in E-Verify. If he's not, then he's not eligible to work in the US.

The DOJ could not sue over a racial profiling case , Not the state anyway
They could bring charges against the officer accused of said profiling
