DEVELOPING: Jon Hammar, the U.S. Marine imprisoned in Mexico on a gun charge, will be released today, his mother told Fox News Radio.
Olivia Hammar said the judge hearing Hammar's case issued a ruling in his favor and that her son is to be released at a time on Friday yet to be announced. No more details were available. Hammar, 27, who served in Iraq and Afghanistan, has been stuck in a notorious, drug cartel-controlled prison just 15 miles south of the U.S. border since Aug. 13, after he crossed into Mexico and declared an antique shotgun to Mexican customs officials.
News of his pending release came just a day after a letter surfaced from Mexico's ambassador to the U.S. that insisted Hammar's case would go to trial.
"This circumstance requires that he remain under detention during the duration of his trial," Arturo Sarukhan said in the letter.
Hammar, who was charged with a federal level weapon felony and faces up to 15 years in a Mexican prison for what his travel companion said was a breakdown in communication at the U.S.-Mexico border. He has been held in the notorious CEDES prison in Matamoros, Mexico, ever since. The prison is just 15 miles south of the border.
But there were questions about the case from the beginning. Ian McDonough, 27, a friend and fellow Marine who was with Hammar when he was nabbed, told FoxNews.com that four U.S. Customs and Border Protection agents told Hammar before he crossed into Mexico that as long as the required permit, which he completed, was submitted and he declared the gun to Mexican authorities, there would be no problem in bringing the vintage shotgun across the border.
The gun was a family heirloom that Hammar planned to use on a hunting and surfing trip in Costa Rica. Hammar, who suffered from Post Traumatic Stress Disorder, and McDonough hoped to forget about the horrors of war with some relaxation in the Central American nation after driving south through Mexico in their Winnebago.
On Thursday, two Republican congressmen called for a national travel boycott of Mexico until the country releases Hammar, urging "all Americans" to campaign for the war veteran's freedom by turning off the tap on America's tourism dollars. His case was also embraced by supporters through an extensive social media effort anchored by www.facebook.com/FreeJonHammar.
"We never leave a brother behind. We never leave a Marine behind. We have to do something," screams the title of the page.

Thank God that this American Citizen, held unlawfully, against his will, while those imprisoning him tried to blackmail his parents or they would murder him, has been released.
A 'Jon Hammer' Movement should be immediately formed to initiate a massive boycott not only against Americans vacationing in the wholesale corrupt and murderous Mexico, but to DEPORT AS MANY MEXICANS back to Mexico as is humanly possible.
They come here by the hundreds of thousands to pillage, murder, and rape us.
We simply try traveling through corrupt Mexico and they throw us in a drug cartel prison and try extorting us for murder ransom.
I want to especially thank Duncan Hunter and our other congressmen and senators who were working feverishly behind the scenes to get Jon Hammer released before the Mexican thugs murdered him. And they would have done it, had Jon's kidnapping and extortion plight not been exposed through American Patriot web sites such as ALIPAC.

Ex-Marine To Be Released From Mexican Jail Friday

MIAMI (CBSMiami) – Twenty-seven-year-old former Marine Jon Hammar of Palmetto Bay will be released Friday from a Mexican prison, according to U.S. Representative Ileana Ros-Lehtinen.
Hammar was arrested over the summer in Mexico because he carried an antique shotgun over the border. He and his family and said it was an honest mistake.
“No American should be in a Mexican jail for five months without being able to have his case in front of a judge,” said Senator Bill Nelson (D-FL). Nelson made a direct appeal to the Mexican ambassador to the U.S. “We’re grateful; this is a good Christmas present.”
In a recent photo, Hammar was shown in prison chained to a bed causing concern amongst his family.
Hammar’s troubles began in August when he took off with a buddy to Costa Rica to surf and deal with post traumatic stress from the war.
Once across the border, though, he was immediately arrested, placed in a notoriously dangerous prison some say is run by a drug cartel and charged with bringing a firearm into the country – a federal crime.
The rifle, a family heirloom, was actually cleared by U.S. Customs.
“Customs weighed the gun, measured the gun, I think took pictures of the gun and gave him paperwork to fill out and then he took that paperwork across to the Mexican side, declared the gun and was immediately arrested,” said Olivia Hammar.
In a prior statement, a spokesman for the Mexican Embassy stressed that possession of any weapon restricted for the use of the army in Mexico is a federal crime and must automatically be prosecuted.
“All it is, is that the barrel of the rifle was this length or the other length. It was not like he was trying to start a militia,” said Ros-Lehtinen.
