In Texas a Justice of the Peace doesn't have to be a lawyer. They are elected and their guidlines are common sense and fairness. Pity we can't have something like this on the federal level where all of the damage is done and the ballot propositions are thrown out before the ink dries.

True and true. What needs to happen is that the states need to reassert their rights and refuse to follow the dictates of federal courts that overstep their intended bounds. Where, for example, does a federal court gain the power to determine whether a state court displays the Ten Commandments? Seriously, by what possible grant of authority both created and limited by Art. III, Sec. 2 does the federal judiciary gain such power? The truth is that like some great devouring beast the federal bench claims for itself ever more power until it now claims authority over pretty much everything and everyone. This must not stand. It's one of the principal reasons that we need to regain control of the White House and the Congress, so that a faithful President can nominate honest and independent jurists and so that Congress will confirm them without imposing the absurd demand that they first be cleared by the Bar, which is a private organization of foreign derivation.
