It turned out all of the plaintiffs were residents, none had ever been arrested or guilty of anything except looking for day labor jobs, which is not illegal.

Read the Decision!
Again, read the decision.
http://www.prldef.org/
In the decision, the judge summarized all of the evidence presented, also noting unsubstantiated allegations from both sides that apparently had no basis in fact (i.e. conjecture). There was not one shred of evidence presented that any of the plaintiffs were illegal immigrants, lived in another town, or was connected in any way with crimes in the neighborhood. Judges aren't supposed to infer evidence where none was resented.
I searched the internet for news stories on this case, and the only thing I found about the plaintiffs is that they were all Latinos, and a mixture of illegal immigrants, legal immigrants, and U.S. Citizens. If the town was harassing legal immigrants or citizens based upon a stereotype of day laborers as illegal immigrants, then the rights of the legal immigrants and citizens were violated. Seeking day labor jobs is not against the law for legal immigrants or citizens.
If the town wants to get rid of illegal immigrant day laborers, the proper way to accomplish that is to either bring Immigration and Customs Enforcement (ICE) to the site, or have their police officers trained by Immigration to check documents.
There's already provision under Federal Immigration law for delegation of immigration enforcement to state and local police, and some states and localities already participate in the program. It requires five weeks of training and $500 to train a police officer.
Given the current hysteria and backlash against immigrants - both legal and illegal - if I were a legal immigrant or Latino citizen challenging government in this type of case I'd want to keep my name out of the media as well.
I've even noticed some stereotyping on this board! The name of this organization is Americans for Legal Immigration, not Americans Against All Immigration. There are immigrants and there are illegal aliens. An immigrant comes here legally, obeys our laws, assimilates, and the only flags an immigrant waves is an American flag. There's no such thing as an illegal immigrant.

Please answer one question for me, bquasius. Did the judge actually inquire about the John Doe's legal status in the United States? Did the judge allow the towns attorney to inquire? I don't think such a question would have been out of the ordinary, especially considering the fact that the individuals bringing the lawsuit were listing their names as John Doe. How can alarms and whistles not being going off in your head over this case? IMHO, the case should have been dismissed. Shouldn't the defendents in the case, the village of Mamaroneck, be entitled to know the true identity of their accusers?
Regardless of the judge's findings, this case stinks of injustice and judicial activism. The town should be able to enforce it's ordinances in a fair non-discrimenatory way. Unfortunately it just so happens that all these day laborers were Hispanic. Do you honestly think the town would have acted differently if a couple of the laborers were white?
Judges aren't supposed to infer evidence where none was resented.
That's my opinion and I'm sticking to it.........."The only thing necessary for the triumph of evil is for good men to do nothing" ** Edmund Burke**

Matricula Consular Cards: Myth and Facts behind the Mexican ID Cards
September 16, 2004- Matricular Consular cards are identification cards issued by the Mexican government to mainly illegal immigrants living in the United States. Currently, more than 350 financial institutions accept Matricula Consular cards as proof of identification thereby allowing thousands of illegal immigrants to have access to mainstream U.S. financial services.
Regulation in the federal budget prohibited U.S. businesses from accepting these cards, but an amendment passed September 14, 2004, which Congressman Miller opposed, that pulls this requirement.
MYTH: Matricula Consular cards are official identification issued by the Mexican government to its citizens and are a proper and reliable form of identification for Mexican workers in the United States.
FACT: The Justice Department and FBI have concluded that the Matricula Consular is not a reliable form of identification due to the non-existence of any means of verifying the true identity of the cardholder.
The documents used to obtain the Matricula Consular card have been found to be easily counterfeited.
Even worse, Matricula Consular cards have been issued upon as little as the word of the person requesting one that they are indeed who they claim to be.
The Mexican government has no centralized database to coordinate the issuance of Matricula Consular ID cards. As a result, one person can procure several cards, even under different names.
MYTH: Eliminating the use of Matricula Consular ID cards would deny many Mexican nationals access to mainstream financial services, such as bank accounts, credit cards, and loans.
FACT: According to the FBI, Matricula Consular cards are almost exclusively used by illegal aliens. Anyone here legally has valid identity documents they can present to open a bank account, such as driver's licenses, Social Security numbers, or passports.
MYTH: The Matricula Consular ID card has a dozen security features to ensure authenticity and discourage fraud, including a digitalized photo, serial number, hologram with special marks, and infrared brand.
FACT: There have been several generations of the card and even the newest version can be easily replicated, despite its security features. More than 90 percent of the Matricula Consular cards now in circulation are earlier versions of the card, which are little more than simple laminated cards without any security features.
The Matricula Consular is easily and often forged -- there is a thriving black market in fake Matricula Consular. In fact, foreign citizens, including an Iranian national, have been apprehended in possession of numerous Matricula Consular cards (issued in Mexico) with multiple identities.

There are "Day Labor Centers" in most every town in this country. The reason they don`t use they`ll have to pay taxes and they won`t be able to work under the table or get paid what they do from prophiled contractors.
