It turned out all of the plaintiffs were residents, none had ever been arrested or guilty of anything except looking for day labor jobs, which is not illegal.
I'm sorry, but I'm not buying it! They may have been resident by virtue of renting in the area, but I seriously doubt they were legal residents. You stated there was no evidence to suggest they were illegal immigrants. Well, I would suggest to you that there was no evidence to indicate they were legal residents either. If the judge trying the case was anything like the ton of other activist judges we have in the country, I'm sure he didn't even ask their legal status.

Six Hispanic immigrant workers - all identified as John Doe for fear of retaliation by police or immigration authorities
This is not a reason for six individuals to file under the name of John Doe. Geez, you make it sound like we live in Communist China or something. Furthermore, it doesn't explain why two of the original eight dropped off the lawsuit. These folks were either illegal immigrants are they were living with family members that were!

they wouldn't release their IDENTITIES in court as requested by the prosecution as all the JOHN DOEs were afraid of being put into the "deportation system"...........ya think they might be ILLEGAL?

Yessirreeee, ILLEGALS harrassing American citizens while wrecking American property and a klinton judge decided to make law instead of upholding law.

    Read the Decision!

    Again, read the decision.
    http://www.prldef.org/

In the decision, the judge summarized all of the evidence presented, also noting unsubstantiated allegations from both sides that apparently had no basis in fact (i.e. conjecture). There was not one shred of evidence presented that any of the plaintiffs were illegal immigrants, lived in another town, or was connected in any way with crimes in the neighborhood. Judges aren't supposed to infer evidence where none was resented.

I searched the internet for news stories on this case, and the only thing I found about the plaintiffs is that they were all Latinos, and a mixture of illegal immigrants, legal immigrants, and U.S. Citizens. If the town was harassing legal immigrants or citizens based upon a stereotype of day laborers as illegal immigrants, then the rights of the legal immigrants and citizens were violated. Seeking day labor jobs is not against the law for legal immigrants or citizens.

If the town wants to get rid of illegal immigrant day laborers, the proper way to accomplish that is to either bring Immigration and Customs Enforcement (ICE) to the site, or have their police officers trained by Immigration to check documents.

There's already provision under Federal Immigration law for delegation of immigration enforcement to state and local police, and some states and localities already participate in the program. It requires five weeks of training and $500 to train a police officer.

Given the current hysteria and backlash against immigrants - both legal and illegal - if I were a legal immigrant or Latino citizen challenging government in this type of case I'd want to keep my name out of the media as well.

I've even noticed some stereotyping on this board! The name of this organization is Americans for Legal Immigration, not Americans Against All Immigration.
There are immigrants and there are illegal aliens. An immigrant comes here legally, obeys our laws, assimilates, and the only flags an immigrant waves is an American flag. There's no such thing as an illegal immigrant.

Please answer one question for me, bquasius. Did the judge actually inquire about the John Doe's legal status in the United States? Did the judge allow the towns attorney to inquire? I don't think such a question would have been out of the ordinary, especially considering the fact that the individuals bringing the lawsuit were listing their names as John Doe. How can alarms and whistles not being going off in your head over this case? IMHO, the case should have been dismissed. Shouldn't the defendents in the case, the village of Mamaroneck, be entitled to know the true identity of their accusers?

Regardless of the judge's findings, this case stinks of injustice and judicial activism. The town should be able to enforce it's ordinances in a fair non-discrimenatory way. Unfortunately it just so happens that all these day laborers were Hispanic. Do you honestly think the town would have acted differently if a couple of the laborers were white?

Judges aren't supposed to infer evidence where none was resented.
No, but he can require more information if deemed necessary! He should have never allowed the plantiffs to file as John Doe's. If their actual names would have become part of the record, the defendent's attorney could have researched their legal status. It's not what the judge did that makes this case stink, it's what he didn't do!

That's my opinion and I'm sticking to it..........

    The judge is an IDIOT.

    They are ILLEGALS.

The judge wouldn't allow their STATUS to be revealed.

What made this entire situation worse was the fact that the judge didn't give a damn about the threat to the residents that can't/won't utilize the town park {right there} or the area in general due to the ILLEGALS constantly harrassing them, especially in a sexual nature.

    How's them there apples!!

The men of Mamaranack should band together and dare, DARE these bastards to open their mouths at the women and kids. They should make it so uncomfortable for these bastards that they move out.

Well, they're already doing that, according to the residents that I've heard call in to 77-WABC.

Women who are mothers-and female au pairs, nurses, etc.-don't want to to bring children into a hostile environment filled with criminals who don't even speak English.

The taxpaying, LEGAL residents of that city have spent a fortune in their taxes to refurbish that park, and now it's being used as a haven for criminals.

    Drug addicts, people soliciting prostitutes.

Each and every one in this country ILLEGALLY.

You can thank that idiot James Brennan for this situation.

    Robed tyrants indeed.

Then what proof did they provide to show residency? And that is the proof required by law using only acceptable documents, not bullshit "matricula consular" cards or other bogus documents that are not legal by the laws of the US as legitimate and required documents for immigrants to have.

If they were foreigners they would be in violation of the law if they did not immigrate into the United State according to US law.

Got any more bullshit to share with this group?

Matricula Consular Cards: Myth and Facts behind the Mexican ID Cards

September 16, 2004- Matricular Consular cards are identification cards issued by the Mexican government to mainly illegal immigrants living in the United States. Currently, more than 350 financial institutions accept Matricula Consular cards as proof of identification thereby allowing thousands of illegal immigrants to have access to mainstream U.S. financial services.

Regulation in the federal budget prohibited U.S. businesses from accepting these cards, but an amendment passed September 14, 2004, which Congressman Miller opposed, that pulls this requirement.

MYTH: Matricula Consular cards are official identification issued by the Mexican government to its citizens and are a proper and reliable form of identification for Mexican workers in the United States.

FACT: The Justice Department and FBI have concluded that the Matricula Consular is not a reliable form of identification due to the non-existence of any means of verifying the true identity of the cardholder.

The documents used to obtain the Matricula Consular card have been found to be easily counterfeited.

Even worse, Matricula Consular cards have been issued upon as little as the word of the person requesting one that they are indeed who they claim to be.

The Mexican government has no centralized database to coordinate the issuance of Matricula Consular ID cards. As a result, one person can procure several cards, even under different names.

MYTH: Eliminating the use of Matricula Consular ID cards would deny many Mexican nationals access to mainstream financial services, such as bank accounts, credit cards, and loans.

FACT: According to the FBI, Matricula Consular cards are almost exclusively used by illegal aliens. Anyone here legally has valid identity documents they can present to open a bank account, such as driver's licenses, Social Security numbers, or passports.

MYTH: The Matricula Consular ID card has a dozen security features to ensure authenticity and discourage fraud, including a digitalized photo, serial number, hologram with special marks, and infrared brand.

FACT: There have been several generations of the card and even the newest version can be easily replicated, despite its security features. More than 90 percent of the Matricula Consular cards now in circulation are earlier versions of the card, which are little more than simple laminated cards without any security features.

The Matricula Consular is easily and often forged -- there is a thriving black market in fake Matricula Consular. In fact, foreign citizens, including an Iranian national, have been apprehended in possession of numerous Matricula Consular cards (issued in Mexico) with multiple identities.

There are "Day Labor Centers" in most every town in this country. The reason they don`t use they`ll have to pay taxes and they won`t be able to work under the table or get paid what they do from prophiled contractors.
