On Fox Greta VanSustern had a story on the Texas girl and the two cousins, just about a half hour ago. I was on the phone and only caught snatches of it, but it sounded like the two are out on bail, or at least I heard her say bail had been allowed.

We had a big break on Greta's show on Fox tonight, but we have to push really hard now to get the snowball rolling down the hill.

Also, can someone get me the name of that reporter that made the claim that the sex between Dani and the illegal could have been consensual? I about jumped out of my seat when he said that!

Can someone also find me what the legal age of consent is in Oregon and Texas?

In North Carolina the legal age of consent is 16. It would have been legally impossible for Dani Peterson to have had consensual sex under our state laws.

If the age of consent in OR is 16 or higher, I'm going to bust that out on this reporter in public!

163.315 Incapacity to consent; effect of lack of resistance. (1) A person is considered incapable of consenting to a sexual act if the person is:

    (a) Under 18 years of age;

    (b) Mentally defective;

    (c) Mentally incapacitated; or

    (d) Physically helpless.

    (2) A lack of verbal or physical resistance does not, by itself, constitute consent but may be considered by the trier of fact along with all other relevant evidence. [1971 c.743 §105; 1999 c.949 §2; 2001 c.104 §52]

Hey everyone - just a couple notes ...

    1. I 'm glad that Greta carried the story - it was deserving of some national attention for sure...

    2. Re: The Oregonian newspaper / Steve Mayes the reporter...

In general, the Oregonian is a very sympathetic with illegals as is much of the MSM. There are a couple decent editorial writers / editorials on staff there, that can produce an unbiased story or coverage the situation with some semblance of objectivity. By my regular reading of the local rag (sorry, got to call it like I see it...), any story written by Esmeralda Bermudez about illegal immigration/immigration, you can patently disregard. Sarah Hunsberger does ok. Steve Mayes doesn't do a lot of the immigration-related investigation nor reporting for whatever reason.
The most 'hawk-like' writer on staff there is probably David Rheinhard. If you want to get noticed at the Oregonian paper, try addressing your comments/questions to him. I believe he is not only a more senior writer, but an editor as well. This might allow many anti-illegal comments to get past the usual wall of filtering by the usual jr. writers / interns / etc.

    3. Thanks for following up and pressing this issue everyone. Writing from 2 miles away from where this very sad thing occurred, well, I can tell you as Mr. Mayes said in his interview with Greta the issue is 'incendiary' here in the local area - people here are really pissed.

    4. I believe that the age of consent laws which apply here affix the age at 18 - I think that is correct. If you have reason to doubt it, let me know and I'll research locally as time allows.

Lt. Mike Alexander, Clackamas County jail operations manager, said local law enforcement officials are also limited in how much they can pursue federal immigration questions.

"If (inmates) choose not to tell us, we don't have any protocols that allow us to go forward," Alexander said.

    http://www.nwcn.com/statenews/oregon/st ... 260db.html[/quote]

No Protocols?!!! Would it be that danged hard to let law enforcement all over the USA have access to immigration records? We have computer networks all over the country.
Or how about that pilot program for employers to check social security numbers. It's a good bet that anyone arrested who can't provide a SS number is an illegal alien.
Get a clue Lt. Alexander, and do something to fix this problem.

Absolutely no mention on any news station in San Antonio, Texas area, nor any in the San Antonio Express-News. I sent a letter to the editor of the Express-News, but they are ALWAYS on the side of "immigrants" and constantly run articles supporting the illegals' cause. So I wouldn't count on them running anything about Dani.

    ARIZONA 18

    ARKANSAS 16

    CALIFORNIA 18

    COLORADO 17

    CONNECTICUT 16

    DELAWARE 18

The age of sexual consent is 16 for adults who are under 30 years of age,
or if the adult that is 30 years of age or older is married to the minor.

    DISTRICT OF COLUMBIA 16

    FLORIDA 18

The age of sexual consent is 16 for adults who are under 24 years of age,
or if the adult that is 24 years of age or older is married to the minor.

    GEORGIA 16

    HAWAII 16

It is illegal for minors age 14 and 15 to have consensual sex with adults
at least five years older, this law does not apply to married couples.

    IDAHO 18

    ILLINOIS 17

Illinois law makes 18 the minimum age at which teachers and their students
may legally have sex. Age 17 does not apply to teachers or any other school
employee in a "position of authority" over the minor.

    INDIANA 16

It is illegal for adults in a supervisory position of a minor aged 16 and 17
to have consensual sex with them. The crime called "felony child seduction"

    IOWA 16

    KANSAS 16

Kansas law prohibits various sexual scenarios, and has a special category
for sex with a person between 14 and 16. Adults breaching this criminal
sodomy section face harsh penalties, but Kansas lawmakers carved out some
breathing space for youthful miscreants, provided they are 18 or under, and
within four years of age of their consensual partner. Called the "Romeo and
Juliet" law, the provision limits the penalty for teen sex to 15 months in
jail, and does not require the perpetrator to register as a sex offender.
But the "Romeo and Juliet" law only applies to heterosexual teen-agers. Also
it is a felony for school employees to have consensual sexual contact with
students ages 16 or 17, even if it is only french-kissing.

    KENTUCKY 16

    LOUISIANA 17

Louisiana law allows prosecutors to seek the death penalty for people
convicted of having consensual sex with a person under 12 years old. The
Louisiana state Supreme Court declared the law constitutional in 1999
because of a 1977 U.S. Supreme Court ruling addressing the rape of an adult,
not a child. The U.S. Supreme Court in 1977 banned the death penalty for
raping adult women, but the justices did not say whether it could be applied
to child rapists. The U.S. Supreme Court declined to hear the 1999 Louisiana
case, allowing the death penalty law to stand.
