Supreme Court Decision Outlines Why Illegal Aliens Are REQUIRED To Be Taught In America

Taxpayers have spent billions of dollars educating illegal aliens and their citizen children. Much of this education is required by law.
A 1982 Supreme Court case citing the 14th Amendment requires public K-12 schools to teach illegal alien children. The federal government has spent over $1 billion and states have spent over $44 billion educating approximately 12.5 million illegal aliens and 4.2 citizen children of illegal aliens, according to the Federation for American Immigration Reform.
The 1982 Supreme Court decision Plyler v. Doe prohibited states from denying K-12 students free public education on the basis of their immigration status.
The court used the Fourteenth Amendment, which states “no State shall … deny to any person within its jurisdiction the equal protection of the laws,” as the foundation for its ruling.
“By denying these children a basic education, we deny them the ability to live within the structure of our civic institutions, and foreclose any realistic possibility that they will contribute in even the smallest way to the progress of our Nation,” the justices said in a 5-4 verdict.
“The record in no way supports the claim that exclusion of undocumented children is likely to improve the overall quality of education in the State.”
Former Chief Justice Warren Burger, dissenting with the ruling, agreed with the court’s general opinion regarding the children of illegal aliens’ right to public education. However, Burger contended that school district policy should trump any federal position.
Ira Mehlman, a FAIR media director, commented on the notion that illegal alien children are entitled to education because of a presumed ability to contribute to society later in life, when speaking with The Daily Caller News Foundation.
“By that logic, we would just have unlimited immigration because everybody has the potential to contribute down the line,” he said. “At some point, it becomes an absurd argument.”
Illegal alien children are also eligible for in-state tuition at some public universities.
“No federal law expressly prohibits a state university from admitting an immigrant student present in the country without authorization,” Jennifer Chacón, a senior associate dean at the University of California, Irvine told The College Fix.
Immigration and Customs Enforcement detained University of California, Berkeley student Luis Mora in December upon discovery that his visa expired several years ago. The school and national politicians petitioned ICE for his release and Mora continues to attend the university with in-state tuition.
“Luis Mora is in excellent academic standing, attending all his classes diligently, and a positive contribution to our Berkeley community,” Berkeley officials told Campus Reform.
Mehlman said that Congress tried to outlaw state universities’ ability to provide in-state tuition to illegal aliens in the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 by requiring the institutions offer the same tuition price to out-of-state students.

02-25-2018, 05:51 PM #2Yeah, unfortunately the Justices ignored the laws the 14th Amendment was passed to ensure were protected equally, like US Civil Rights Laws, US Labor Laws, US Immigration Laws.The court used the Fourteenth Amendment, which states “no State shall … deny to any person within its jurisdiction the equal protection of the laws,” as the foundation for its ruling.

Unfortunately, that is the way it is worded. However, the solution is that, since this is a federal mandate, the federal government should be mandated to compensate any such school district for the cost of such education and any other subsequent cost, such as for an interpreter or bilingual teachers. This should also apply to hospitals and such that are required to treat illegal aliens which they will not be compensated for.The court used the Fourteenth Amendment, which states “no State shall … deny to any person within its jurisdiction the equal protection of the laws,” as the foundation for its ruling.
If the federal government doesn't like the financial burden, send the bill to the country of the illegal alien's origin!

Believe hospitals do receive $$$ for services to illegals - tax payer funded, state & federal.
If one is not legally "within a state's jurisdiction", should make a difference.

The illegal parents are the LEGAL guardians and custodians of THEIR minor children...
We, the taxpayers and our government, are not the custodians of their children.
Find the illegal parents and deport them along with every one of their minor children!
One way to get them OUT of our schools and out of our country.
They should not be deported without their children...they cannot leave them on our doorstep like a box of puppies!!!
Arrest the parents and send CPS to the house to load up their children and put them ALL on a bus out of here!ILLEGAL ALIENS HAVE "BROKEN" OUR IMMIGRATION SYSTEM
DO NOT REWARD THEM - DEPORT THEM ALL

It is a token amount. I have heard that many hospitals near the southern border had to close because they didn't get enough reimbursement. I know from my medical treatments, a $70,000 bill was only paid $1300 by the government. My provider recently had to close down 1/3 of its services because both the government and insurance companies pay as little as they can. And vendors over charge. When I started my treatments, there was a doctor, not mine, who was very well liked. He retired after many years. I was talking to him about it on one of his last days. He did not want out, but the red tape government added, the fighting for payment from government and insurance, he said even with all his years in the business, he couldn't stay financially viable. It is very unfortunate because in my area, no one I know has found a doctor that's any good.

If you really check and see what doctors/hospitals charge and what they get paid by ANY INSURER---they are being compensated, just not quite as much as they can get by primos. Shame on them!
And au contrare' - some dr/hospitals are glad to get the multitude of payments for treating illegals. They just downgrade their doctors to lower paid foreigners or limited services. Medicare/medicaid/uninsured keeps some dr/hospitals afloat moneywise. The problem for Americans is if you own anything that they can put a lien on for services - that they will do. Since I have seen the bills and I have seen the Medicare and insurance payments, I know that is bogus. I even brought it up to my provider. I know that many years ago, my daughter got her bill when she had a baby. At that time, she went into a rage about them charging $50 for aspirin. Their justification then as well as with my current provider now was that they have to make up the loss on major procedures that they are not properly paid for in order to stay in business.
In a similar strategy, talking to my truck parts supplier, he told me that large items like transmissions or engines, he sold at cost, maybe even a loss. He used this to attract customers who while there would buy small items, such as nuts and bolts, for a greatly inflated price. My observation is it would not be profitable for me to go to different stores to save 50 cents on a bolt. That's where his profit was. So I would pay the inflated price. When it came to buying an engine, a $100 dollar saving can pay for the gas and time shopping around.
And that is a preferable solution? Between all my specialists I have 5 different doctors. Being a troublemaker, I talk about my various treatments and prescriptions among each of them. And I get conflicting recommendations. Four of them I respect their recommendations, but one I don't. Yet he seems to be the best that's not miles away.

It took him about two minutes to examine me and diagnose the very problem I had been complaining about for 5 weeks. He gave a prescription which arrived about an hour later. The next day my symptoms cleared, and that after noon they started therapy again to teach me to walk. Two days later I was released.
Once home I started getting the bills. One organization billed me for doctor visits for every day I was in the hospital, I never saw one of them. Although I notified Medicare, they would not go after the doctors because Medicare declined their bills and therefore had no loss. Of course those doctors continue to come after me.
So I don't buy your contention that reducing personnel and hiring lower skilled, cheaper doctors and personnel is acceptable. What they get doesn't cover what it costs, so they have to over-bill those they can squeeze money out of. We get lower quality care for a higher price!

Exactly!!! Our entire health system is under attack by the evil of illegal immigration and the excesses of legal immigration, just like our education and welfare safety nets, jobs, wages, politics, elections. These morons worried about Russians doing research on free speech on the internet in the US need to refocus their attention and our resources on real issues like massive illegal and excess immigration.
