Senate Remains Up in the Air on Immigration

Senate Majority Leader Bill Frist kept colleagues guessing Tuesday about whether he would set aside his own immigration proposal in favor of bipartisan legislation approved Monday by the Judiciary Committee that would allow millions of illegal immigrants to earn citizenship.

Frist, R-Tenn., has been largely silent on his intentions. He has scheduled a 2:15 p.m. cloture vote to limit debate on a motion to proceed to his own bill (S 2454), which is targeted solely on border security and tougher enforcement of immigration laws.

Aides said Frist intended to bring up the issue Tuesday at the weekly GOP caucus lunch. Only then will he decide whether to replace his measure with the Judiciary Committee’s version, which contains important portions of bipartisan legislation (S 1033) sponsored by John McCain, R-Ariz., and Edward M. Kennedy, D-Mass.

A big question for Frist is whether he wants to allow the draft bill to be considered even though it was opposed by a majority of Republicans on the committee.

Four Republicans joined all eight panel Democrats in supporting the draft bill, which would allow the estimated 11 million to 12 million illegal immigrants in the country to stay and earn citizenship after 11 years. Six Republicans opposed it.

The bill is vastly different from legislation (HR 4437) the House passed in December, which focused squarely on enforcement and border security. Frist had hoped to go in that direction, but he may not have the 60 votes needed to get cloture on his bill.

Supporters of the committee bill say that blocking the debate would set a bad precedent.
