    Executive Order -- Presidential Records

    By the authority vested in me as President by the Constitution and the laws of the United States of America, and in order to establish policies and procedures governing the assertion of executive privilege by incumbent and former Presidents in connection with the release of Presidential records by the National Archives and Records Administration (NARA) pursuant to the Presidential Records Act of 1978, it is hereby ordered as follows:

    Section 1. Definitions. For purposes of this order:

    (a) "Archivist" refers to the Archivist of the United States or his designee.

    (b) "NARA" refers to the National Archives and Records Administration.

    (c) "Presidential Records Act" refers to the Presidential Records Act, 44 U.S.C. 2201-2207.

    (d) "NARA regulations" refers to the NARA regulations implementing the Presidential Records Act, 36 C.F.R. Part 1270.

    (e) "Presidential records" refers to those documentary materials maintained by NARA pursuant to the Presidential Records Act, including Vice Presidential records.

    (f) "Former President" refers to the former President during whose term or terms of office particular Presidential records were created.

    (g) A "substantial question of executive privilege" exists if NARA's disclosure of Presidential records might impair national security (including the conduct of foreign relations), law enforcement, or the deliberative processes of the executive branch.

    (h) A "final court order" is a court order from which no appeal may be taken.

    Sec. 2. Notice of Intent to Disclose Presidential Records.

    (a) When the Archivist provides notice to the incumbent and former Presidents of his intent to disclose Presidential records pursuant to section 1270.46 of the NARA regulations, the Archivist, using any guidelines provided by the incumbent and former Presidents, shall identify any specific materials, the disclosure of which he believes may raise a substantial question of executive privilege. However, nothing in this order is intended to affect the right of the incumbent or former Presidents to invoke executive privilege with respect to materials not identified by the Archivist. Copies of the notice for the incumbent President shall be delivered to the President (through the Counsel to the President) and the Attorney General (through the Assistant Attorney General for the Office of Legal Counsel). The copy of the notice for the former President shall be delivered to the former President or his designated representative.

    (b) Upon the passage of 30 days after receipt by the incumbent and former Presidents of a notice of intent to disclose Presidential records, the Archivist may disclose the records covered by the notice, unless during that time period the Archivist has received a claim of executive privilege by the incumbent or former President or the Archivist has been instructed by the incumbent President or his designee to extend the time period for a time certain and with reason for the extension of time provided in the notice. If a shorter period of time is required under the circumstances set forth in section 1270.44 of the NARA regulations, the Archivist shall so indicate in the notice.

    Sec. 3. Claim of Executive Privilege by Incumbent President.

    (a) Upon receipt of a notice of intent to disclose Presidential records, the Attorney General (directly or through the Assistant Attorney General for the Office of Legal Counsel) and the Counsel to the President shall review as they deem appropriate the records covered by the notice and consult with each other, the Archivist, and such other executive agencies as they deem appropriate concerning whether invocation of executive privilege is justified.

    (b) The Attorney General and the Counsel to the President, in the exercise of their discretion and after appropriate review and consultation under subsection (a) of this section, may jointly determine that invocation of executive privilege is not justified. The Archivist shall be notified promptly of any such determination.

    (c) If either the Attorney General or the Counsel to the President believes that the circumstances justify invocation of executive privilege, the issue shall be presented to the President by the Counsel to the President and the Attorney General.

    (d) If the President decides to invoke executive privilege, the Counsel to the President shall notify the former President, the Archivist, and the Attorney General in writing of the claim of privilege and the specific Presidential records to which it relates. After receiving such notice, the Archivist shall not disclose the privileged records unless directed to do so by an incumbent President or by a final court order.

    Sec. 4. Claim of Executive Privilege by Former President.

    (a) Upon receipt of a claim of executive privilege by a living former President, the Archivist shall consult with the Attorney General (through the Assistant Attorney General for the Office of Legal Counsel), the Counsel to the President, and such other executive agencies as the Archivist deems appropriate concerning the Archivist's determination as to whether to honor the former President's claim of privilege or instead to disclose the Presidential records notwithstanding the claim of privilege. Any determination under section 3 of this order that executive privilege shall not be invoked by the incumbent President shall not prejudice the Archivist's determination with respect to the former President's claim of privilege.

    (b) In making the determination referred to in subsection (a) of this section, the Archivist shall abide by any instructions given him by the incumbent President or his designee unless otherwise directed by a final court order. The Archivist shall notify the incumbent and former Presidents of his determination at least 30 days prior to disclosure of the Presidential records, unless a shorter time period is required in the circumstances set forth in section 1270.44 of the NARA regulations. Copies of the notice for the incumbent President shall be delivered to the President (through the Counsel to the President) and the Attorney General (through the Assistant Attorney General for the Office of Legal Counsel). The copy of the notice for the former President shall be delivered to the former President or his designated representative.

    Sec. 5. General Provisions.

    (a) Nothing in this order shall be construed to impair or otherwise affect:

    (i) authority granted by law to a department or agency, or the head thereof; or

    (ii) functions of the Director of the Office of Management and Budget relating to budget, administrative, or legislative proposals.

    (b) This order shall be implemented consistent with applicable law and subject to the availability of appropriations.

    (c) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

    Sec. 6. Revocation. Executive Order 13233 of November 1, 2001, is revoked.

    addressed a small press conference in the ATLAH Worldwide church sanctuary.

    [45:19] We've got a couple of questions here from the, uh, chat room.

    Question #1, I can't, [gasp] is: "Where is the mainstream media?"

    Well, first of all, you've not been listening to the Manning Report. They're not the mainstream media; they're the Dung Head Media.

    Where they are, [whispered] they're hiding. [chuckle]

    The second question is, "Does anyone know why no one in our government will help us or protect us against this fraud?"

    I mean, the question is kind of open-ended - it's very broad, but let me try to address the question this way.

    Washington and Wall Street and government itself has become so corrupt that they are beyond helping themselves, or us. The uh, they're all in a political prison of maximum security. The corruption in Washington, the lies, the fraud, not only in our government but in our banking systems and our business system, is off the charts, and have been growing that way for quite some time.

    I think I need to inform you, that this is not unique for our nation, it has happened in other nations as well. Generally, when it reaches this fever pitch and point, because there is no longer a sense of any integrity left anywhere in the government, it then collapses, and the nation folds. We're at that point at present.

    I pray that we can survive collapse. [voice quivering]

    But that's why they're not here to protect us.

    Question #3: "Does Dr. Manning have a next plan of action if the House, Department of Justice, and the courts ignore this?"

    Well... I'll be willing to accept a final decision from the courts, whatever that decision is. And I can pretty much assure you that Congress and the courts will have to render a decision, whether the Congress states, "We reject this verdict outta hand and refuse to look at it," fine. Then we take the Congress to court for failure of upholding the people's right of an open and free trial, and then we'll see what the courts say. And the courts may say that the Congress is right. At that point we have an opportunity to go appeal. And if it reaches the Supreme Court, and the Supreme Court says that the people do not have a right to hold trials, that the people do not have a right to report crimes, I think when that happens, our nation is no longer a nation, and I don't think that the American people will stand for it...
    that if the courts rule that the people have no longer the right to act under the Tenth Amendment, or if a crime has been reported, that the Congress are not obligated to act upon the reporting of such crimes.

    Now, there's a second question here. It says, "Is there, is there any evidence to back up this, and will it be released to the public?"

    We will not release the transcript of the trial to the public. We will release the transcript to Congress and to the various Grand Juries around America, that they might affix it to their Grand Juries, and should they decide to affix their, their Grand Jury findings to our verdict, then that will be fine.

    Question #6 [he skipped question #5]: "Is there anything Pastor Manning wants everyone to do to help him?"

    I would, I would ask that you would simply... not be afraid of the government.

    If you can find the courage to not be afraid of losing your job or your relationship with others because you've taken a position that's unpopular, that's all I would ask.

    Question #7: "Are you aware that this new health care bill will exempt all Mus|ims?"

    Well, I mean, this press conference is about the trial and going forward, uh...

    I can say that the health care bill, as I've said over the last year, I find it psychologically... dangerous, disingenuous to say the least and hypocritical of any American, any American at all, that you are treading, treading upon, psychologically, very dangerous ground, if you believe that Barack Obama is not a natural born citizen, yet you challenge his policies, and in doing so, in effect, say that his Presidency is legitimate. If you believe that he's not a natural born citizen, then his Presidency is illegitimate! And I don't care if it's the health care bill or Cap-and-Trade, or anything else, any bill that he signs is an illegitimate bill. Why pursue Obama and Washington, the demonstrations against this bill or that, when he doesn't possess the right to pass them!

    It is psychologically disingenuous, it is most dangerous for anyone to run up to Mr. Obama and say, "We don't like your health care policy!" You are indeed saying, "We respect you as President, and we respect your right to sign [bills] into law."

    I've not seen anything as convoluted as people who continue to talk of his policies when the man has no right to be in the office.

    #8: "How long have you been investigating these allegations?"

    Well, I suppose, since December of 2007.

    And that's all the questions that we have right now.[53:01]

    I find I am in agreement with everything Dr. Manning is quoted to have said in this article especially this comment:

    "I've not seen anything as convoluted as people who continue to talk of his policies when the man has no right to be in the office."

    I think we will find an increasing large volume of evidence pointing to our usurper Obama being a 100% Marxist, and thus find our explanation of why there is so much fraud, corruption and just plain anti-American actions within our American federal government these days.

    It would appear that we have been truly usurped by the communists.

    I'm still on the lookout for true Americans in our federal government, but they continue to sit quietly on the sidelines while the country goes to hell in a hand basket.

    My letter to the FBI inquiring about the FBI investigation of the federal fraud in the Obama administration remains unanswered.
