Conservative Commentator D'Souza Pleads Guilty to Election-Law Charges

Admits to Funneling $20,000 in Illegal Contributions to GOP Senate Candidate

    By CHRISTOPHER M. MATTHEWS
    May 20, 2014 11:17 a.m. ET

Dinesh D'Souza, a conservative commentator and former college president, pleaded guilty Tuesday to funneling $20,000 in illegal campaign contributions to a Republican candidate for U.S. Senate in a case that had drawn accusations of political targeting.

Mr. D'Souza had pleaded not guilty in January, saying at the time he didn't dispute the facts but disagreed with prosecutors' assessment he had violated federal election laws. He had also argued he was being targeted by the Justice Department for being a Republican.

He reversed that position Tuesday, saying in court that he knew what he did was wrong.

"I deeply regret my conduct," Mr. D'Souza said.

A federal grand jury in Manhattan indicted him in January for allegedly making illegal contributions, funneling $20,000 to Wendy Long, the Republican candidate who unsuccessfully challenged Democratic incumbent Kirsten Gillibrand, New York's junior senator.

Prosecutors alleged Tuesday that Mr. D'Souza had misled Ms. Long about the contributions, and that she would have testified against him if the case had gone to trial.

A lawyer for Mr. D'Souza, Benjamin Brafman, had argued previously that the office of Manhattan U.S. Attorney Preet Bharara, appointed by President Barack Obama, had engaged in "selective" prosecution by targeting a Republican. Prosecutors pushed back, citing several similar cases they had brought against Democrats.

U.S. District Judge Richard M. Berman ruled last week that prosecutors had not engaged in selective prosecution.

Mr. Brafman said in a statement Tuesday there was no "viable defense" for Mr. D'Souza because of the technical nature of the case.

"We are hopeful that Judge Berman will recognize Mr. D'Souza to be a fundamentally honorable man who should not be imprisoned for what was an isolated instance of wrongdoing in an otherwise productive and responsible life," Mr. Brafman said.

Mr. D'Souza, an outspoken critic of the Obama administration, is a former policy adviser to President Ronald Reagan and later served as a fellow at American Enterprise Institute, a conservative think tank. He also served as the president of The King's College in New York City, a small Christian college, from 2010 to 2012.

Under campaign finance laws, individuals were limited to making a total contribution of $5,000 to any individual candidate in 2012.

According to prosecutors, Mr. D'Souza directed two close associates to contribute $20,000 to Ms. Long's senatorial campaign, and then reimbursed those individuals.

In 2012, Mr. D'Souza gave $5,000 in contributions to Ms. Long, according to Federal Election Commission records. He also campaigned on her behalf, and the two attended Dartmouth College together. Ms. Long, who hasn't been accused of wrongdoing, couldn't be reached for comment Tuesday.

Both parties jeer embrace of fraudulent voter

A Hamilton County poll worker who has been held up nationally as an example of voter fraud took the stage at a local voting rights rally – outraging Republicans and dismaying even top local Democrats.
The Rev. Al Sharpton, keynote speaker at Thursday's rally to kick-off the campaign for an Ohio Voters' Bill of Rights Ohio Constitutional amendment, even hugged Melowese Richardson.
Richardson, a Democrat, was convicted of voter fraud after using her position as poll worker to vote more than once in the 2012 presidential election. She got a five year prison term, but was released earlier this month after local Democratic activists pressed for a fairer term.
A judge sentenced her to probation instead.
Richardson was among the more than 400 at Word of Deliverance Church in Forest Park when Cincinnati National Action Network President Bobby Hilton called her on stage for a "welcome home."
A tweet from an Enquirer reporter about the moment sparked immediate outrage from Republicans on Twitter.
Melowese Richardson who was convicted of Voter Fraud and released early from a five year prison sentence was brought up on stage by Bishop Bobby Hilton as Rev. Al Sharpton joined State Representative Alicia Reece to kick off the petition drive for Ohio Vote at Word of God Deliverance Family Life Center in Forest Park.(Photo: The Enquirer/Jeff Swinger)

Even Democrat leaders questioned the idea of applauding Richardson.
"I am very glad the county prosecutor and judge reconsidered and got her out of jail, but she is not a hero," Hamilton County Democratic Party Chairman Tim Burke, who was at the rally, told the Enquirer. "What she did was criminal conduct and was particularly problematic because of her role as a poll worker."
Hamilton County Democratic Party Executive Director Caleb Faux, who was also at the rally, saw it as an attempt to portray Richardson as a martyr because of the lengthy sentence.

    Dems’ Voter-Fraud Denial
How do you address a problem they insist doesn’t exist? By John Fund

The spin doctors who deny the existence of voter fraud have no boundaries.

“Plans to fight voter fraud are based on nightmares, tall tales, and paranoid fears,” says Scott Keyes of the liberal Center for American Progress. Voter fraud is so rare “you’re more likely to get hit by lightning than find a case of prosecutorial voter fraud,” asserts Judith Browne-Dianis, co-director of the liberal Advancement Project.

Kim Strach, the new director of North Carolina’s Board of Elections, disagrees. She just searched a database that comprises about half the registered voters in the U.S. and found 35,750 voters in her state whose first and last names and full date of birth match with someone in another state who also voted in the 2012 election. A smaller number (765) had exact matches on Social Security numbers, but that total is artificially low because only some states provide that number for any or all of their voters.

Remember: In 2008, Barack Obama only carried North Carolina by 14,177 votes out of 2.3 million cast.
Strach is turning over her findings to the state legislature along with recommendations on what laws would help clean up the rolls.

Nor is North Carolina the only state with voter fraud in the news. Cobby Williams, a former 2012 independent congressional candidate in Mississippi, was sentenced to five years in prison this week for knowingly registering a convicted felon.

Last month, police in Pontiac, Mich., found the mummified body of Pia Farrenkopf in the garage of her foreclosed home. She had apparently been dead since 2008, but was listed as having voted in the 2010 election for governor.

Texas Democratic state representative Lon Burnam filed suit in March claiming he was defeated by 111 votes in his Democratic primary because of an illegal vote-by-mail operation, which might have been orchestrated by his opponent.
Even when fraud is obvious and proven, some liberals will dismiss or even defend it. In 2012, MSNBC host Lawrence O’Donnell, former staff director of the Senate Finance Committee, insisted it was “perfectly reasonable” for voter fraud to occur occasionally. When challenged, he repeated himself.

Also recently, former Cincinnati election official Melowese Richardson, who was released early from prison after being convicted of voting six times for Barack Obama in 2012, was called up on stage at a rally for Al Sharpton’s National Action Network for what Cincinnati National Action Network president Bobby Hilton called a ““welcome home.”“ She was also hugged by the Reverend Al Sharpton.

All that was too much for local Democratic-party chairman Tim Burke, who was at the rally.
“What she did was criminal conduct and was particularly problematic because of her role as a poll worker,” he told the Cincinnati Enquirer.

The real problem isn't the number of people voting illegally.

The problem is people who could vote legally not voting.

About 13% of registered voters cast ballots in L.A. County races

Man pleads guilty in Texas to voting twice

Man pleads guilty in Texas to voting twice

    Posted: Jun 04, 2014 4:27 AM PDTUpdated: Jun 04, 2014 4:27 AM PDT

GALVESTON, Texas (AP) - A man who voted absentee in Texas and Minnesota during the 2012 general election then touted his bogus balloting on Facebook has pleaded guilty.

A judge in Galveston on Tuesday fined Richard Alan Collier $4,000 after he pleaded guilty to a misdemeanor violation of Texas election law.

Collier, who pleaded guilty to attempt to commit illegal voting, claimed residence in both states when seeking absentee ballots for the November 2012 election. Authorities say Collier then voted in Anoka (uh-NOH'-kuh) County, Minnesota, and in Galveston County.

Prosecutors in Galveston say a tip that Collier posted a Facebook message about voting twice led to an investigation and documents examined from both counties.

South Dakota US Senate candidate Bosworth arrested, charged with violating election laws

    • Article by: DIRK LAMMERS , Associated Press
    • Updated: June 4, 2014 - 5:20 PM

SIOUX FALLS, S.D. — South Dakota authorities on Wednesday arrested defeated U.S. Senate candidate Annette Bosworth and charged her with multiple counts of perjury and filing false election documents, saying she fraudulently attested to gathering voter signatures when she was really on a Christian mission trip to the Philippines.

South Dakota Attorney General Marty Jackley charged Bosworth with six counts of perjury and six counts of filing false documents related to election campaignlaws.

The arrest warrant was served a day after Bosworth lost the Republican primary with just 6 percent of the vote.

"The election complaints received by the Secretary of State involve conduct that is serious, deliberate, and must be addressed in order to preserve the integrity of our elections," Jackley said in a statement.

"Because this is a federal elected office, I have and will continue to discuss the investigation with federal authorities."

Jackley said the 42-year-old Bosworth was given notice of the warrant Wednesday morning and turned herself in to the Minnehaha County Jail. She was immediately released.

At a press conference Wednesday afternoon, Bosworth called the charges "a political intimidation scheme" against her by Jackley, who was initially appointed to his position by former Gov. Mike Rounds.

Rounds defeated Bosworth and three other Republicans Tuesday night to capture the GOP nomination for the seat being vacated by retiring Democrat Tim Johnson.

"We still believe this is a political persecution," Bosworth said in a prepared statement. She did not take questions.

Jackley in May announced that he would investigate several nominating petitions submitted by U.S. Senate candidates, including that of Bosworth, after a liberalblogger and a conservative state lawmaker raised concerns about the legitimacy of some petitions.

A complaint was also filed against Clayton Walker, an independent who did not make the November ballot, accusing him of perjury and filing false documents. A telephone message left at Walker's home Wednesday was not immediately returned.

State Division of Criminal Investigation agent Bryan Gortmaker said in an arrest affidavit that Bosworth attested to personally gathering signatures in January when she was in fact serving on a publicized medical mission trip in the Philippines. She also attested to gathering signatures on some Hutterite colonies, but residents interviewed said the documents were not signed in front of Bosworth, Gortmaker said.

"The Colony had been contacted by phone by Dr. Bosworth and one nominating petition came to them by mail, asking that the petition be signed and she would take care of the rest," Gortmaker wrote, referring to a petition sent to the Millerdale Colony in Miller. Hutterites, similar to Amish and Mennonites, live a life centered on their religion on German-speaking colonies scattered across northern U.S. states and Canada.

Bosworth said she had hundreds more signatures than were needed to get on the primary ballot, and the validity of those signatures is not in question.

"Simply put, there was no criminal intent to deceive, nor was there any reason to," she said.

Bosworth founded the mission-based health care nonprofit Preventive Health Strategies in 2011 and opened a private practice medical clinic in Sioux Falls called Meaningful Medicine.

The political newcomer raised $1.7 million dollars during her campaign but spent most of what she raised on out-of-state fundraising efforts, according to her Federal Election Commission reports. The campaign has been using Base Connect, a direct mail fundraising company that helps conservative candidates, organizations and political action committees.

Her campaign fund was in the red as of her last filing on May 14, reporting $99,000 in cash offset by debts of more than $150,000.

Bosworth has also faced accusations from several former employees, who said she has failed to pay promised wages.

One week before the primary, Bosworth staged an "adults only" press conference to highlight the hateful and hurtful phrases hurled at her by random Internet commenters during the campaign. Bosworth gave volunteers spray paint cans and had them produce a graffiti-laden backdrop of profane words and insults to make her point.

A day later she announced that she was sponsoring a last-minute Senate candidate forum to be posted on YouTube. The forum, which was also attended by two other candidates, was not open to the public
