Thread: Update on Hispanic Accused of Rape in North Carolina

This is just getting more and more FRUSTRATING. This man is a DANGER to our community and state and yet we still cannot determine if he is even SUPPOSED TO BE IN OUR COUNTRY.

I'm definitely going to take William's suggestion about contacting Congressman Coble's office this morning because I just seem to be banging myself up against brick walls everywhere I turn.

OKAY, KIDS! I THINK I HAVE HIM NAILED!

Here's the deal and, if any of you law enforcement ALIPAC members can confirm, I would appreciate it. Whie I was at the dentist this morning, the detective from the Winston-Salem Police Dept. returned my call. My son happened to be here and, when the man identified himself, my son was completely taken off guard (they never know what their mother is up to!!). So, the detective asked my son if I was a member of any AGENCY and my son said all he knew was that I was a member of some kind of border control group! Then, he said the detective told him that, since it was an ongoing investigation, they couldn't release than information except to law enforcement.

BUT--not to be outdone, I called the detective back when I got home and explained that I was NOT the Border Patrol. He asked me if I worked for ICE and I explained that I didn't work for ICE but had tried to CONTACT ICE!! So, he tells me the same thing. Ongoing investigation, etc. He says that they are investigating that as well. So, I went into my little sweet-talk routine and tried to pry the info out of him. He FINALLY broke--a LITTLE. He said, "I can tell you one thing because it was mentioned on the news the other night. INS (his words, not mine) has a DETAINER on him. When I asked if that meant what I thought it meant, he wouldn't comment.

Next step--I called Congressman Coble's Greensboro office and the lady I spoke with contacted their immigration specialist and he said that what that meant was that ICE wants him after Winston-Salem and Greensboro finishes with him. He said that means that HE IS ILLEGAL.

If any of you has a different understanding of the expression, "THE INS HAS A DETAINER ON HIM", let us know.

So, in uncovering this earthshaking revelation, got any idea how many phone calls, emails and hours you spent on this project? John Q needs to know to what lengths law enforcement will go in order to keep taxpayers in the dark.

You are correct. If a law enforcement agency puts a detainer on someone who is already in jail, they more than likely have some charge pending on him.

What the detainer does is prevents the jail from releasing this person, even if the local charges are dropped.

I spent HOURS! Didn't keep up with the time because I was HOT ON THE TRAIL!!!!

After I posted the update, I called our former Sheriff for Davidson County who is a friend and asked him about the terminology. He basically confirmed what you said, JohnB. He said, in all likelihood, he was illegal but it was POSSIBLE that they had some other reason to revoke a visa. What I find interesting is that this man had already been charged with other things in the past and I wonder why he wasn't deported then.

Also, my former Sheriff (he is now the Captain in our Sheriff Dept.) friend told me that he has 20 hispanics in his jail right now and that he had no idea which were legal and which were illegal. He said that ICE is SO OVERWHELMED that they won't even bother with deporting anyone unless they have committed some MAJOR crime. AND, THEN, they don't want them until AFTER They have served their time AT OUR EXPENSE. Now, that's infuriating, isn't it???

SO--we still are not SURE, right?? My gut just tells me that a 24 year old that speaks with a Spanish accent has NOT gone through all of the legal channels to be here. And, I'm going with that!!!

What I find interesting is that this man had already been charged with other things in the past and I wonder why he wasn't deported then.

My suspicion is because of a sanctuary policy being used in the city. Some police departments will turn a blind eye to a person's immigration status feeling it is not part of their job to check it. They do this all the time in California with illegal immigrants. The most notable example of this policy is "Special Order 40" used in Los Angeles. Check out the links for more information.

William--I emailed my one reporter who really TRIED immediately after I found the information. Haven't heard back from him.

Brian--what you said is probably true about the ones here in my county but the MONSTER who is charged with serial rapes and multiple other charges is a different story. Obviously, ICE wants him.

Push your local press contacts to document the immigration status in print for us. If they have not done that by Friday, we will run it up the flagpole as an ALIPAC orginal release. Would be safer if they did it first, but we will do it if they do not.
