You're right. There are some excellent comments posted on this forum.

Now I want to ask everybody a question.

When we compare the blogs and forums today and the blogs and forums of one year ago; and when we compare the level of intellectual and responsible posts on these blogs and forums, hasn't there been an order of magnitude of improvement in all areas?

My point is that the American people seem to be getting to the roots of our problems much better today than they did a year ago.

It also appears (to me anyway) that the people are not going back to sleep, and, in fact, they appear to be much more riled up and impatient for a solution to these federal problems.

We truly live in interesting times, but we may actually start to accomplish some change to this corrupt communist system we call the federal government in the near future. I sure hope it happens soon because we don't have much time left to save our free republic.

Section 1. Parts II and IV of the Manual for Courts-Martial, United States, are amended as described in the Annex attached and made a part of this order.

Sec. 2. These amendments shall take effect 30 days from the date of this order.

(a) Nothing in these amendments shall be construed to make punishable any act done or omitted prior to the effective date of this order that was not punishable when done or omitted.

(b) Nothing in these amendments shall be construed to invalidate any nonjudicial punishment proceedings, restraint, investigation, referral of charges, trial in which arraignment occurred, or other action begun prior to the effective date of this order, and any such nonjudicial punishment, restraint, investigation, referral of charges, trial, or other action may proceed in the same manner and with the same effect as if these amendments had not been prescribed.

These changes are most likely meant to shut down Ltc Lakin's defense. And, of course, the attachments are NOT provided as part of the press release.

From what brief research I've done this morning, I can't find the changes anywhere, and this brings me back immediately to the line in 'Animal House' about the Delta guys being put on 'double secret probation.' There is no transparency in this federal government, and they are clearly circling the wagons so that they can better defend their lawless activities and their usurper POTUS.

I'm absolutely disgusted with the military brass who are apparently supporting this socialist regime.

It would seem this is another in the long list of things that will have to be un-done when Obama is (physically) removed from office.

In reference to "Executive Order-- 2010 Amendments to the Manual for Courts-Martial:"

(3) Fine. Any court-martial may adjudge a fine in lieu of or in addition to forfeitures. . . In the case of a person serving with or accompanying an armed force in the field, a summary court-martial may not adjudge a fine in excess of two-thirds of one month of the highest rate of enlisted pay, and a special court-martial may not adjudge a fine in excess of two-thirds of one year of the highest rate of officer pay.

Is the modification:

• a fine as a new punishment,
  limitation for a person serving in the field, or
  the size of the fine?

If the modification is creation of the limitation for a person serving with or accompanying an armed force in the field, that limits the punishment to,
"Pay the fine, in cash, or go to the brig."
Neither is a good choice in combat or for an essential MOS supporting troops in combat.

If the modification is a change in the limit on fines to two-thirds of a month (or year) of maximum pay, that might be insignificant compared to the value of a theft or the cost of damages. And what does "the highest rate of enlisted (or officer) pay" mean? The highest for the offender's rank, rate, or grade, or the highest possible pay for an E-9 (or an O-10)?

(4) Based on status as a person serving with or accompanying an armed force in the field. In the case of a person serving with or accompanying an armed force in the field, no court-martial may adjudge forfeiture of pay and allowances, reduction in pay grade, hard labor without confinement, or a punitive separation.

That certainly grants the authority in the field few options.
"Pay the fine, in cash, or go to the brig."

The obvious result of the impracticality of "cash or jail" in combat is breakdown of military discipline. If a soldier refuses to fight, to advance, to be the point man, or to fulfill his function in a firefight, the officer in charge is not allowed to use his sidearm to compel the soldier to do his duty - even in combat? That's just not gonna work.

(a) Paragraph 32, Article 108, Military Property of the United States-sale, loss, damage, destruction, or wrongful disposition, paragraph c.(1) is amended to read as follows:

. . . It is immaterial whether the property sold, disposed, destroyed, lost, or damaged had been issued to the accused, to someone else, or even issued at all. If it is proved by either direct or circumstantial evidence that items of individual issue were issued to the accused, it may be inferred, depending on all the evidence, that the damage, destruction, or loss proved was due to the neglect of the accused.

Can anyone make sense of that? It sounds like a Hindu dualism, like "a=b & a><b", simultaneously.

Retail merchandise of service exchange stores is not military property under this article.

So merchandise in the commissary and the PX/BX/ship's store is not accorded the same military protection and penalties for theft as military items in Supply. Would you want to be an AAFES store manager if you had to prosecute each theft in a civilian court?

Those are just opinions based on my incomplete understanding of what the modifications mean. They do not appear to be relevant to LTC Lakin. But they do seem to follow the Rules of Engagement in making it more difficult (or next to impossible) to accomplish the mission of the military. Reading these modifications, the obstruction seems purposeful - almost like sabotage.

Does anyone who is intelligent, conscious, and alert not know that law abiding Americans are at war, and have been in a state of war for many years with the international banksters, progressives, liberals, communists, socialists, Marxists, and Muslims operating in our midst?

These enemies of the state have infiltrated our federal government and are doing their level best to destroy every facet of our lawful and constitutional republic for their own purposes - not the success of America. We are being viciously attacked from within.

It is my perception and belief that all of our individual efforts to influence the federal government will fail because the federal government has become a willing partner and co-conspirator with our enemies who are working for our destruction, and that our only hope in defeating these enemies will be found at the state level. There is no longer loyalty to our American culture or to our rule of law at the federal level. It's gone.

I only make these statements after watching the various federal government branches and agencies for many years, and observing the blatant non-responsiveness and vicious attacks against honest, lawful, and constitutionally protected citizen inquiries of questionable actions of the federal government.

There is no longer justice or lawful actions coming from members of the federal government. Conformance with our laws by the feds is a thing of the past.

The federal government must now be reined in and controlled by the state governments - those same sovereign entities that created this monster federal government in the first place. The states have been slackers in recent memory, rolling over so the feds can rub their bellies, and this has to change. But, you know, we can help change everything at the state level! The states are sovereign!

Time to write off the feds, Folks. We need to aim for controlling our state governments and using the state government's influence and power to win the battle against the errant and unlawful federal government. The federal government is nothing without the support of the states - we must not forget that.

As an aside, my heart and support go out to the remaining troops and federal employees who still believe in American law and our Judeo/Christian culture because they, like LtC. Lakin, will find themselves increasingly at odds with their own managers and leaders.

So, our next marches have to be on our own state capitals, with the message that THEY, the employees and elected representatives of our state governments, must clean up the federal corruption and either restore our lawful government at the federal level, or dissolve the federal government and start over again.

Let’s face it folks, communism and socialism as practiced now in America simply don’t work. Never have. Never will.

(Sept. 5, 2010) — Lucas Daniel Smith has just completed a mailing to each member of Congress a copy of a document which he stated is a certified copy of the original birth certificate of Barack Hussein Obama II showing that Obama was born in Kenya, Africa. Each birth certificate copy was sent with a seven-page, individually-notarized letter by certified mail. The project was completed on August 31, 2010.

Smith said that he obtained the document from the Coast Province General Hospital in Mombasa, Kenya in February 2009. The document became part of a lawsuit filed by Dr. Orly Taitz, Esq., in California which was denied a hearing in October 2009 by Judge David O. Carter.

My fear Juan is that the monster we call the federal government has become so large and uncontrolled that the state governments will no longer be able to fight it. Look at AZ as an example. The feds are unconstitutionally trying to squelch their sovereignty. They are not even following the constitutional path in their attempt to do this. The constitution In Article 3, Section 2, is crystal clear that only the Supreme Court has jurisdiction in this case.

In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.

By allowing this breach of jurisdiction to occur, our constitution has become a little weaker. I do believe constitutionally SCOTUS would have had to take the case. Of course, we no longer are worried about that pesky piece of paper.
