Yes, it's true if one of the parents is a US citizenship and the child is born in a foreign country, the child is automatically a US citizen IF at least one parent has lived in the US for 14 years, 5 of them over the age of 21. She had Obama at age 18. So if she did have him in Kenya (I believe it's very possible) he would have had to become naturalized. And it's quite possible that his Hawaiian BC reflects that. This would nullify any eligibility to become president.
You argue the point the it doesn't matter where he was born and yet you put the factcheck.org link of his BC stating he was born in Hawaii. So if he WAS born in Kenya, that proves he posted a phony record online. Are you okay with that? There are a lot of issues with the BC he posted, which is why there are lawsuits requesting to see the vault version (COLB). What is so difficult about that? Why doesn't he just obtain a copy and give it to the press. It would resolve this and put a lot of people's concerns to rest.

Thank you for your input, ericwilliam. You understand the issue correctly, given a minor correction in "age of 21." The immigration law in effect in 1961 required 5 years of U.S. residence after age 14. Anna Dunham Obama was 3 months shy of that.

This proviso shall be applicable to persons born on or after December 24, 1952, to the same extent as if it had become effective in its present form on that date;

The last sentence makes Barack Obama II a U.S. citizen at birth on Aug. 4, 1961, just as if the law on that date had required a parent to reside in the U.S. for "at least two" years after age fourteen instead of "at least five" years after age fourteen.

However, this statute cannot make anyone a natural born citizen, because a natural born citizen is not made one by statute, but is only one without any statute making it so. That is obvious from reading the Framers' notes on the Constitution, but it will be contested until the Supreme Court interprets the phrase, "natural born Citizen."

Hawaii considering law to ignore Obama 'birthers'

HONOLULU – Birthers beware: Hawaii may start ignoring your repeated requests for proof that President Barack Obama was born here.

As the state continues to receive e-mails seeking Obama's birth certificate, the state House Judiciary Committee heard a bill Tuesday permitting government officials to ignore people who won't give up.

"Sometimes we may be dealing with a cohort of people who believe lack of evidence is evidence of a conspiracy," said Lorrin Kim, chief of the Hawaii Department of Health's Office of Planning, Policy and Program Development.

So-called "birthers" claim Obama is ineligible to be president because, they argue, he was actually born outside the United States, and therefore doesn't meet a constitutional requirement for being president.

Hawaii Health Director Dr. Chiyome Fukino issued statements last year and in October 2008 saying that she's seen vital records that prove Obama is a natural-born American citizen.

But the state still gets between 10 and 20 e-mails seeking verification of Obama's birth each week, most of them from outside Hawaii, Kim said Tuesday.

A few of these requesters continue to pepper the Health Department with the same letters seeking the same information, even after they're told state law bars release of a certified birth certificate to anyone who does not have a tangible interest. Responding wastes time and money, Kim said.

Both Fukino and the state registrar of vital statistics have verified that the Health Department holds Obama's original birth certificate.

The issue coincides with Sunshine Week, when news organizations promote open government and freedom of information.

"Do we really want to be known internationally as the Legislature that blocked any inquiries into where President Obama was born?" asked Rep. Cynthia Thielen, R-Kaneohe-Kailua. "When people want to get more information, the way to fuel that fire is to say, 'We're now going to draw down a veil of secrecy.'"

Nobody at the hearing questioned the fact that the president was born in Hawaii.

Attorney Peter Fritz asked why the state would pass a law punishing repetitive requests for open records. Instead, the state could simply say it would only answer each person's question once.

If the measure passed, the state Office of Information Practices could declare an individual a "vexatious requester" and restrict rights to government records for two years.

The committee will schedule a vote on the measure, said Chairman Jon Riki Karamatsu, D-Waipahu-Waikele.

You say that the Hawaii Dept. of Health states that they have "Obama's original birth certificate." That much is true.

But Dr. Chiyome Fukino and Mrs. Janice Okubo of the Hawaii Dept. of Health have carefully parsed their statements to avoid perjury about what the public assumes they are saying, but which they do NOT say.

1) They do NOT say that "Obama's original birth certificate" originated in Hawaii. It may be from Coast Province General Hospital in Mombasa, Kenya. It may be from Vital Records in Nairobi, Kenya. It may be the amended birth certificate which replaced an earlier birth certificate after his adoption (as Barry Soetoro) by his mother's second husband, Lolo Soetoro. Only they know what they've got, and the Hawaii Revised Statutes make it illegal for them or anyone else to look at it without Mr. Obama's authorization.

2) They have NOT said that the Certification of Live Birth posted online by FactCheck and DailyKos is the same document or even has the same information as the birth document in the Vital Records vault at the Hawaii Dept. of Health in Honolulu. A Hawaii Certification of Live Birth is merely a computer extract, a current printout of information on a computer database, which was typed many years ago by a clerk reading the original birth document.

3) Online images are readily altered with image editing software, such as Photoshop, hence the phrase, "Photoshopped image." According to renowned forensic expert Sandra Lines, the .jpg images posted online by FactCheck and DailyKos are not sufficient for validation of eligibility without physical access to the original document with the embossed seal. Upon 3X magnification in any image editor, the original DailyKos image (from which others were copied) shows pixelation, halos, debris, and missing anti-counterfeiting bars in the data fields - all evidence of cut-and-paste editing of important data. At least two imaging and counterfeiting experts have testified in exhaustive detail that the DailyKos image is a hoax and a forgery, and therefore, its derivatives are as well.

4) In 1961, a person born outside Hawaii, even outside the U.S., could be registered with Vital Records at the State of Hawaii Dept. of Health if a custodial parent stated his or her intent to reside permanently in Hawaii. On the mere signature of one relative, an infant under one year old who was not even present in Hawaii could be registered. A person born at home or in a foreign country would have received the same State of Hawaii Certification of Live Birth as a person born in a hospital in Honolulu. A Certification of Live Birth, like the one posted online by FactCheck and DailyKos, is not proof of Hawaiian birth. Neither the U.S. State Dept. (for a passport) nor the Dept. of Hawaiian Lands (for native entitlements) accepts such a Certification as proof of birth in Hawaii without additional corroborating documentation.

5) When investigator Jerome Corsi, Ph.D., went to the Coast Provincial General Hospital in Mombasa, Kenya, and asked to see Barack Obama II's birth certificate, he was told that Barack Obama II's documents were sealed, not that they did not exist. Kenyan authorities then held Dr. Corsi in custody until he was put on his flight out of Kenya. Ever since, there have been police guarding the records at two hospitals in Mombasa. Vital Records in Nairobi is also off limits to foreign reporters. In Kogelo, armed guards prevent reporters from speaking to Mama Sarah, Mr. Obama's paternal step-grandmother, who repeatedly stated on tape (in Swahili) that she was present in the delivery room in Mombasa when Barack Obama II was born.

6) It costs $10 to pick up a certified copy of a birth certificate at the Hawaii Dept. of Health in Honolulu. It is a demonstration of guilt that Mr. Obama has paid over $1.7 million to the Perkins Coie law firm to keep secret a birth certificate which would cost only $10 to release. If he has nothing to hide, why is he spending over $1.7 million to hide it?

We birthers are asking for what any Little League requires: a birth certificate which proves eligibility. With all the evidence (and there is much, much more), there is probable cause for a governing authority to demand discovery of Mr. Obama's original birth document and the other identifying documents he has sealed.

But Mr. Obama is Constitutionally ineligible for the Office of President in any case, because his father, Barack Obama, Snr., was a Kenyan, a British Protected Subject, and according to British law, his son was also a British Protected Subject. How could a British Protected Subject, whose birth was subject to British law, be a natural born U.S. citizen? The Framers of the Constitution risked their lives to gain independence from Great Britain. They would be rolling in their graves.

I don't know if Scribd is secure from scrubbing, but I do know that I have a copy of everything I put up there, in two formats, and I can't be scrubbed.

Well, if I get scrubbed, I will know about it.

The only real advantage to my Scribd. uploaded files is that they have been copyright approved by the authors, have been reformatted for easy download and use by anyone, and are sometimes easier to read than the original copy. Additionally, if anyone wants the original text in MS Word format, that is available on request.

Rev. Manning's detail work will have to wait until he releases it, or, alternatively, until he has sent it out to requesters.
